Rep. J. Lester Cousins, Vice Chairman V~alter B. Rutter~ Secretary Frank Go Lucas A1 Boeltz Simon Ryder, Alternate ABSENT Eze!l Hester, Alternate Chairman Ward called the meeting to order at 7:00 P.M. and introducedithe Members of the Board~ the Building Official and the ReCording Secretary. The Mmnu~s of March 25 were read. Mr. Cousins made a motion to approve the minutes as written and it was seconded by Ryder. Motion carried 6-0. Parcel #1 - Relief from 25 ft. rear setback requirement to 21 ft. rear setback, to allow for a room addition. Lot 7, Block 15, Golf View Harbour, 1st Sec. Recorded in Plat Book 26, Page ~78 Palm Beach County Records Address: 256~ S. W. ~ ~h Street Applicant: Alcur Mfg. Corp. for Mr. and ~.~s. John Roche ~, Rutter informed the Board the reason for this application was for a room addition. He then read a letter addressed to ~. Aitken from M~. and Mrs. Roche authorizing the Alcur M~uu~. facturing Corporation to act for them. ~. Bernard Casey stated his name and that he wms a represen- tative of Alcur Manufacturing Corporation. He informed the Board that this application is for a screen room addition. ~ere appears to be plenty of room in the rear. They just want a casual screen enclosure for barbequi~ etc. Chairman Ward asked ~. Casey to verify the plot plan and Casey agreed to the plan presented° Chairman Ward pointed out that if it was correct, the building is non-conforming having 23½ ft. in the front. Mr. Casey replied that he was not aware of this ~ud assumed the plan was wrong. Mr. Aitken stated he did not believe this house had a variance for the 23½ ft. in the front~ Chairman Ward stmted that since a sur- vey was not included, we must consider this sketch. Mr. Casey stated that he did not measure this and was only con- cerned with the back. Originally when the house was built, they must have gone back 25 ft. Mr. Aitken stated that possibly a mistake was made. ~. Aitken asked if the Board could act on this if it is a non-conforming house to begin with? Chairman Ward replied: No. P~. Aitken cls~ified not until it was substantiated whether thelr~gh~ setbacks a~e there or not. M~. John Roche stated his name and his address as 2561 ~th Street. He informed the Board that the house was a Eingsberr~ model. I can only state that my house does not jut out lw ft. from the rest of the homes on the block. Mr. Lucas askediwhen he purchased the home and ~. Roche replied in January~ ~97~o ~. Casey added that a house that new should be conforming. Chairman Ward stated that in lieu of a certified survey, we have this plot plan and we must assume the measurements are correct. Mr. Rutter added that he thought it had been covered very well and they could see the position the Board was in. M~. Cousins suggested that possibly this be tabled to give them a chance to get a certified survey. Chairman Ward agreed this. could be done, but it would not mean it would be granted. ~o Roche asked what they could do if it was only 23½ ft, in the front? Chairman Ward stated they could not improve a non-conforming property. Mr. Roche questioned whether this applied to the rear and Chairman Ward referred to the City Code stating you could not improve on a non-conforming property. Mro Roche asked if he didn't conform in the front~ it means i cannot do anything in the back? ~. Aitken clari- fied that a~ non-conforming house is one that does not come up to the setbacks in any way and a non-conforming house can- not be added to in any way. Mr. Roche stated the other houses lined up wilth his. ~ Cousins replied that they could not make any imiprovements either. Chairman Ward added that they could keep iit in repair, but not make improvements. Mr~ Roche quest!ioned the reason for this and Chairman Ward re- pl_em it was stated in the ordinance ~. Aitken stated if his house is lined up, something must be wrong with the sketch and !?hr. Roche agreed. M~. Cousins made a motion to table action on this petition subject to the condition of f~nishing a certified survey indicating the dimensions shown on this sketch. Mr. Lucas ~seconded the motion~ Motion carried 5-0. Chairman Ward added if the certified survey was ready for the Board's next meeting in two weeks, they would consider it then.
