AN ORDINANCE OF THE CITY OF BOYNTON BEACH,
FLORIDA, AMENDING SECTION 31-13. OF THE CODIFIED
ORDINANCES OF SAID CITY PERTAINING TO OFF-STREET
~A~Ut~- AND LOADING REGULATIONS; REPEALING
ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT
HEREWITH: PROVIDING FOR AUTHORITY TO CODIFY,
AN EFFECTIVE~DATE, AND FOR OTHER PURPOSES.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BOYNTON
BEACH, FLORIDA:
SECTION t: That Section 31-13 of the Code of Ordinances of
the CITY OF BOYNTON BEACH, FLORIDA, be and the same is hereby
amended to read:
"Section 31 -13. Off-Street Parking and loading regulations-
DEFINITIONS.
(1) For the purpose of this chapter~ the term "off-streeT parking
space" shall mean a parking space constructed of a hard surface and shall
consist of a minimum net area of one hundred sixty-two square feet (162) of
appropriate dimensions, and not less than nine feet (9) in width, for parking
an automobile, exclusive of access drives or aisles thereto or any street or
alley right-of-way.
(2) For the purpose of this chapter, the term "off-street loading
or unloading space" shall mean a vehicular loading space constructed of hard
surface and shall consist of a space with dimensions not less than twelve feet
(12) in width, thirty-five feet (35) in length, and fourteen feet (14) in height,
exclusive of access aisles, maneuvering space or alley right-of-way.
(3) For the purpose of this chapter, the term "storage area" t
shall mean those areas located within the principal structure actually utilized
by the owner, occupant or tenant of such premises for purposes of storing
dormant equipment or material and shall not be construed to mean any vacant
area or areas utilized for the display or placement of merchandise, equip-
ment or materials intended for sale or utilization by occupant in connection
with his normal business routine.
(B) OFF-STREET PARKING REGULATIONS.
At the time of the erection of any principal building or structure
or at the time any principal building or structure is enlarged or inc~e, ased
in capacity by adding dwelling units, guest rooms, floor space or seats, ther,
shall be provided minimum off-street parking space with adequate means for
ingress and egress from a public street or alley by ar~ automobile of standard
size, in accordance with the foDlowing ~equirements:

Parking space requirements for any
use not specifically set forth herein-
above shall be determined by the City
Council after recommendal ion by the
Palnning & Zoning Board.
(C) Location of off-street parking spaces.
(1) Parking spaces for all dwellings shall be located on the
same parcel with the main building to be erected.
(2) Parking spaces for other uses shall be provided on the sam
lot or not more than three hundred feet (300) distant, as measured along the
nearest pedestrian walkway.
(3) Parking requirements for two or more uses, of the same
or different types, may be satisfied by the allocation of the required number
of spaces of each use in a common parking facility, provided that the total
number of spaces is not less than the sum of the individual requirements and
thai the requirements of location are compl ted with.
(D) Off-streeT loading and unloading regulations.
(1) At the time of construction of one of the following categories
of buildings, or at the time of structural alteration for an increase in size or
capacity, there shall be provided minimum ogf-street loading or unloading
space with adequate means of ingress and egress from a public street or
alley in accordance with the following requirements:
(a) Every hospital, institution, hotel, commercial warehouse
or industrial building of similar use having a floor area i~×cess of 20,000
square feet requiring the receiption or distribution by vehicle of materials
and merchandise shall have at least one permanently maintained off-street
loading space for each 10, 000 square feet of gross floor area or fraction ther
(E) Permanent reservations.
(1) Areas reserved for off-street parking or loading in accord-
ance with the requirements of this section shall not be reduced in area or
changed to any other use unless the permitted use which it serves fs discon-
tinued or modified or unless equivalent parking or loading is provided on
another approved site or parking structure to the satisfaction of the Board of
Adjustment.
SECTION 2: Separability. Each of the. provisions of this
ordinance are separable, including word, clause, .phrase, or sentence, and
if'any portion hereof shatl, bya court of competent jurisdictior~ be declared
invalid, the remaining portion shall not be affected but shall remain in
for and effect.
SECTION 3: Repealing Provisions. All ordinances or paris of
ordinances in conflict herewith are hereby repealed.
SECTION 4: Authority to Codify. Specific authority is hereby
granted to - codify and incorporate this ordinance in the City's existing code.
SECTION 5: Effective Date. This ordinance shall become effecti
in the manner and at the time provided by the Charter and Ordinances of the
CITY OF BOYNTON BEACH, FLORIDA. -3-
