AN ORDINANCE OF THE CITY OF BOYNTON BEACH~
FLORIDA, EXTENDING THE TERRITORIAL LIMITS
OF SAID MUNICIPALITY BY THE ANNEXATION
OF A CERTAIN UNINCORPORATED TRACT OF LAND
CONTAINING LESS THAN TEN REGISTERED VOTERS,
LYING CONTIGUOUS THERETO AND WITHIN THE SAME
COUNTY; TO-WIT: A PARCEL OF LAND LOCATED IN
THE SW 1/4 SECTION 34, TOWNSHIP 45 SOUTH, RANGE
43 EAST, INCLUDING PORTION OF LOT 11, BENSON
BROS. SUBDIVISION, ACCORDING TO THE PLAT
THEREOF RECORDED IN PLAT BOOK 5, PAGE 27
PUBLIC RECORDS OF PALM BEA. CH COUNTY, FLORIDA;
REDEFINING THE MUNICIPAL BOUNDARIES; REPEALING
ALL ORDINANCES OR PARTS OF ORDINANCES IN
CONFLICT HEREWITH; PROVIDING FOR AUTHORITY
TO CODIFY, AN EFFECTIVE DATE, AND FOR OTHER
PURPOSES.
WHEREAS, the owners of the property more particularly des-
cribed hereinafter have heretofore petitioned the City Council of the City of
Boynton Beach, Florida, requesting the annexation of certain property lying
adjacent and contiguous to the territorial limits of said municipality and
within the same County, to the municipal territorial limits of said City; and
voters; and
WHEREAS,
said tract of land contains less than ten registered
WHEREAS, all requirements of the charter of the City of
Boynton Beach, Florida, relative annexation of contiguous territory have been
complied with; and
WHEREAS, the City Council of the City of BoYnton Peach, Flori
deems the annexation of subject tract to be beneficial to the municipality and
to the owners of said tract,
NOW, THEREFORE,
City of Boynton Beach, Florida;
be it ordained by the CitY Council of the
SECTION 1: That the City of Boynton Beach, Florida, hereby
annexes the following-described tract of land to the territorial limits of the
City of Boynton Beach, Florida

Commence at the intersection of the existing easterly
municipal boundary line of the City of Boynton Beach,
Florida, with the north line of the SW 1/4 Section 34,
Township 45 South, Range 43 East; thence proceed
easterly along the said north line to the northeast
corner of Lot 11, BENSON BROS. SUI~)IVISION, acc-
ording to the Plat thereof recorded in Plat Book 5,
page 27, public records of Palm Beach County, Florida;
thence proceed southerly along the easterly line of said
Lot 11, BENSON BROS. SUBDIVISION to the southeast
corner thereof; thence proceed westerly along the south
line of said Lot 11, BENSON BROS. SUBDIVISION and
the westerly extension tt~ reof to the existing easterly
municipal boundary line of tha City of Boynton t~ach,
t~lorida; thence proceed northerly along said boundary line
to the point of beginning, excluding therefrom the east
150 feet of the south 150 feet of the north 165 feet of said
parcel.
SECTION 2: That subject property, upon annexation, shall be
zoned ZONE C-1 to authorize use as a Trailer Park or in the alternative, as
a condominium or co-operative apartment complex,
of Ordinance No. 62-9 of the City of Boynton Beach,
the master zoni~ng code of said City.

SECTION 3: The territorial boundaries of the City of Boynton
Beach, Florida, are hereby redefined so as to include the above-described
property.
SECTION 4: Separability. Each of the provisions of this
ordinance are separable and if any section, subsection, clause, phrase or
portion of this ordinance is for any reason held invalid by any Court of
competent jurisdiction, the remaining portions shall not be affected but shall
remain in full force and effect.
SECTION 5: Authority to ~Codif~. Specific authority is hereby
granted to codify and incorporate this ordinance in the City's existing code.
SECTION 6: Repealing Provisions. All ordinances or parts
of ordinances in conflict herewith are hereby repealed.

SECTION 7: EFFECTIVE DATE. This ordinance shall becom~
effective the manner and at the time provided by the chart er and ordinances
of the City of Boynton Beach, Florida.
