O65-05ORDINANCE NO. 65-5 AN ORDINANCE OF THE CITY OF BOYNTON BEACH, FLORIDA, DECLARING THE INT-ENTION OF SAID CITY TO EXTEND ITS MUNICIP~AL TERRITORIAL LIMITS- BY THE ANNEXATION OF AN UNINCORPORATED TRACT OF LAND LYING CONTIGUOUS THERETO AND WITHIN PALM BEACH COUNTY, FLORIDA, ~TO WIT: A PARCEL OF LAND LOCATED IN PALM-BEACH FARMS COMPANY PLAT NO. 8, MORE PAR.TICULARLY DESCRIBED HEREINAFTER; PROVIDING FOR REPEALING AND SAVINGS CLAUSE, AN EFFECTIVE DATE, AND OTHER PURPOSES. WHEREAS, the owners of a certain tract of land more particularly described hereinafter, lying adjacent and contiguous to the territorial limits of the CITY OF BOYNTON BEACH, FLORIDA, and within Palm Beach Count have petitioned the City Council for the annexation of said property by the City of Boynton Beach, Florida; and WHEREAS, subj~d~ tract contains less than ten registered voters; and WHEREAS, it is considered to be for the best interest of the CITY OF BOYNTON BEACH, FLORIDA, and for the owners of subject tract that same be annexed and included within the municipal territorial limits of the City; NOW, THEREFORE, be it ordained by the City Council of the CITY OF BOYNTON BEACH, FLORIDA: SECTION 1: Thai the City Council of the CITY OF BOYNTON BEACH, FLORIDA, hereby declares its intention to annex the following described tract of land to the municipal territorial limits of the City of Boynton Beach, Florida.~ at the expiration of 30 days from the passage of this ordinance. S; thence proceed westerly along said northerly right-of-way line to the point of intersection with the west line of Lot i0, of said PALM BEACH FARMS COMPANY PLAT NO.'8; .thence proceed southerly along the west line of Lot l0 and Lo~~ 23 of said Subdivision to the southwest corner of said Lot 23, PALM BEACH FARMS COMPAN~ PLAT NO. 8; thence proceed easterly along the south line of Lot 23 and Loi 24 of said Subdivision to the southeast corner of said Lot 24; thence proceed northerly along the east line of Lot 24 and Lot 9 of said Subdivision to the point of intersection with ihe southerly right-of-way line of New Boynton Road West; thence proceed easterly al©ng the southerly right-of-way line to New Boynton Road West to the point of intersection with the west line of Lot 2 of said PALM BEACH FARMS COMPANY PLAT NO. 8; thence p~oceed nor~therly to the point of beginning. SECTION 2: The above property, upon annexation, shall be zoned "ZONE C-2" pursuant to the provisions of Ordinance No. 62-9, constituting lhe master zgning Code of the City of Boynton Beach, Florida. SECTION 3: All ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 4: Should any section or provision of this ordinance , or' any portion hereof be declared by a court of competent jurisdiction to be invalid, such decision shall not affect the validity of the remainder hereof as a whole or any part hereof, other than the part declared to be invalid. SECTION 5: This ordinance shall become effective in the manner and at the time provided by the charter and ordinances of the City of Boynton Beach, Florida. First reading this I~'~ day of (~i~ . A.
