Minutes 07-10-72~LINUTES OF THE BOARD OF ADJUSTMENT MEETING HELD AT CITY HALL, BOYNTON BEACH, FLORIDA, JULY 10, 1972 AT 5:30 P. M. PRESENT: Ezell Hester Lester Cousins Foy Ward Frank Lucas Robert Ness, Building Inspector ABSENT: Robert Hueston ~alter Rutter Robert Beane Mr. Hester called the meeting to order at 5:34 P. M. ~_D~ov~ of~£inutes - June~5~l 2~-~June 26~~ ~Lr. Cousins moved that the minutes of June 5th and June 26th be approved as written, seconded by F~. ~ard. Motion carried 4-0. Parcel #1 - Relief from 75' frontage requirement to 60 ' front platted Lot 39, North Ridge Estates Recorded in Plat Book 25, Page 144 Palm Beach County Records Address: 121 South Atlantic Drive Applicant: Lila E. Brye The purpose of the variance, as stated in the application, is to build a duplex. The City requires 75' frontage, the lot is 60' x 125'. Mr. Hester stated he received the letter to the effect that Larry Giddens is to represent the applicant. Mr. Giddens stated t~t the area is zoned duplex and ~s. Brye wishes to build a duplex on this lot. It would be one bedroom, one bath and will meet the City setback requirements. If the variance does not go through, Mrs. Brye is going to sell the lot and an FHA subsidized house will be built. Across the street is a 5unit apartn~nt building, 5 more are going up. Mr. Lucas stated that he went to this property and noticed the For Sale sign on it. Mr. Giddens stated that the property will be sold if the variance is not granted° ~r. Atlantic Drive is opposed to the variance because the whole street is' single family homes. This w~s originally set up for 60' lots for single homes. Marie Dettoni, 107 S. Atlantic Drive is against the variance. She has a one family home. The whole street should remain one fam~ l~y homes. Mr. Hester pointed out that it is zoned R-2 and can either be single family or duplex. Mr. Ness stated that it was zoned R-2 in 1962 and can build up to 8 units if they have the proper footage. Charles Watson, 120 S. Atlantic Drive stated that he thought R-2 for duplex means 2. Now you are saying you can go up to 8 units. He is against it. Julius Vogelmann, ll2 S. Atlantic Drive is against the variance. It is zoned for single dwellings. We were not notified of th~.t 5 unit apartment building across the street. Mr. Hester stated that the builder had enough front footage to put those untis in R-2 which can either be single family or multiple units. Etienne Jansegers, 118 S. Atlantic Drive stated that it is hard to believe that the zone was changed to R-2 in 1962. %~hen they built the 5 unit apartment we were never notified, we did not know about it. He objects to the variance. ~. Hester stated that he had enough footage to build those apartments in this zone. The City did not have to notify you of the building of that apartment because he did not get a variance. Mr. Jansegers asked if the Board members work for the City. Mr. Lucas stated that the Board of Adjustment is an independent body. Mrs. Engelmann, llO S, Atlantic Drive could not understand why the City sent a letter now for a duplex but never sent a letter for the 5 apartments. Mr. Hester stated that he had enough front footage to build the 5 apartments. The requirement is 75', that is why he did not need a variance. This lot is only 60', that is why a variance is needed. On 60' lots a si~gte faEb~ly resddence m~y be built. Lots 75' and up in R-2 allow single family and multiple family which includes duplex. --2-- MINUTES BOARD OF ADJUSTMENT P2~ETING JULY 10, 1972 Multiple family may be built providing you have square footage for each unit s~nd no more than 8 families per principal unit. R-2 also permits other types of buildings; churches, schools, clubs, nursing and convalescent homes. If it were zoned R-2A it would only be residential. Alfred Binner, 123 S. Atlantic Drive is opposed to the variance. A duplex should not be permitted on a 60' lot. ~r~e believe that z duplex does not belo~ on a 60' lot in Private residential areas. Mrs, Louis DiNardo, ll8 Arthur Court is opposed to the variance. If the requirement is 75' then it should stay that way. Letters of objection dated July 7 were received from ~illiam Vandermay and Jeanne and Silas Narland. Mr. Giddens stated that if the variance goes through he is going to build on this lot, if not, the property will be sold and the builder will build an FHA subsidized house. Mr. Lucas moved that the request be denied, seconded by Cousins. Motion carried 3-1. M~r. Ward voted Request Denied. Mr. P~ard moved to adjourn, seconded by Mr. Lucas. Meeting adjourned.
