23-010 1 ORDINANCE NO. 23 -010 2 3 AN ORDINANCE OF THE CITY OF BOYNTON BEACH, FLORIDA, 4 DESIGNATING THE MEEKS PROPERTY LOCATED AT 413 NE 12th 5 AVENUE, BOYNTON BEACH, WHICH IS MORE FULLY DESCRIBED 6 HEREIN, AS A LOCAL HISTORIC SITE AND THE ADDITION OF THIS 7 1941, WOOD FRAME VERNACULAR, ONE-STORY SINGLE-FAMILY 8 HOUSE TO THE CITY'S LOCAL REGISTRY OF HISTORIC SITES; 9 PROVIDING A NON-SEVERABILITY CLAUSE AND AN EFFECTIVE DATE. 10 11 WHEREAS, Chapter 2, Article II, Section 6.B of the City of Boynton Beach Land 12 Development Regulations provides for the designation and protection of historic sites in the 13 City of Boynton Beach, and the guidelines and eligibility criteria in Chapter 4, Article IX, 14 Section 6.B.1; and 15 WHEREAS, the home was constructed c.1941 and is a Wood Frame Vernacular, the 16 earliest form of construction within the City of Boynton Beach and is one-story single-family 17 house; and 18 WHEREAS, the Historic Preservation Board of the City of Boynton Beach on April 10, 19 2023 recommended that the property at 413 NE 12th Avenue, Boynton Beach more 20 particularly described as Lot 17, Block 1, HAPPY HOME HEIGHTS, according to the Plat 21 thereof on file in the office of the Clerk of the Circuit Court in and for Palm Beach County, 22 Florida in Plat Book 11, Page 30, be designated a historic site; and 23 WHEREAS, Staff and the City's Historic Resources Preservation Board recommends 24 that the subject ordinance be approved thereby adding the Meeks property at 413 NE 12th 25 Avenue to the City's Local Registry of Historic Sites; and 26 WHEREAS, the City Commission of the City of Boynton Beach has conducted a duly 27 noticed public hearing in regard to the designation of the Meeks property at 413 NE 12th 28 Avenue, Boynton Beach as a historic site. 29 NOW THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF 30 BOYNTON BEACH, FLORIDA, THAT: 31 Section 1. The foregoing whereas clauses are true and correct and are now ratified 32 and confirmed by the City Commission. The Meeks home located at 413 NE 12th Avenue is hereby designated 2 in accordance with and under the provisions of the Land Development Regulations, Chapter 3 2, Article II, Section 6.B, and the guidelines and eligibility criteria in Chapter 4, Article IX, 4 Section 6.B.1 of the City of Boynton Beach Land Development Regulations and shall be added 5 to the City's Local Registry of Historic Sites. 6 Section 3. It is the intention of the City Commission of the City of Boynton Beach 7 that this Ordinance and each and every of its terms be considered a part of a single whole 8 and that the Ordinance not be severable and that if a court of competent jurisdiction finds 9 that any section of this Ordinance is unlawful or unenforceable the Ordinance shall be 10 unenforceable it its entirety. 11 Section 4.
