NOTE: NO .RECORD ~VAS ~A~ OF THIS ?METING. Minutes of last meeting. ~.~r. Davis moved that the reading of the minutes be dispensed with and that they be approved as written. Seconded by ~4r. Yates. Unanimusty carried. BUSINESS Parcel I: Request variance in front footage (lot width) require- ments, South S1-1/2' of Lots 2], 22, 25 and_ 24, Block 3, McDonald Park Subdivision, as recorded in Plat Book 12, Page 69, Palm Beach County records. Address: 908 S. W. 2nd Street Otmer: Harman }V. Kilby ~ Ida ~ay Kilby The above property is presently zoned R-IA. 6,000 square feet required. RequeSt variance of lot to 5,400 square feet to meet required home that they want to put on there. Lot width, variance from 60' to 51.6'. Reason is to build a two bedroom,carport, screened porch and one and a half bath home on a lot 51-1/2' x 101'. Special conditions and hardship: No other property on either side that my be purchased to increase the size of the said lot. He did not build t&,e houses on either side. He advised he did not knowwho did build them, but he did not, He has a lady who wants to have a house built on this lot. ~.~ir. Davis: Mr. Kilby, how long did you o~m this lot? K~. Kitby: I've owned the lot for four ),'ears. ~. Yates: (In answer to a question from the audience) The City has never required 100' lots. k'T. Davis: Those lots originally ran North and South, and you wound up with your lot ly~g East and tCest and n~' you want to build a house facing West. Same conc!ition on both sides of you. }4r, Yates: As ~ %understand it, ye, x are building a house over 1,250 square feet, gaud are you obseT.,..~ing all setbacks? ~r~ Kilby: Yes~ Mr. Curtis %t%aver: Did I understand that t~h.e adjacent properties are not available £Dr purdmse? b~. Kilby: Yes. Mr, Salhast: Is this in compliance with the Zoning requirements? Mr. Davis: Yes. ~'~. Salhast: Since 1962 there has been a house built ~ there on a 60' lot. Mrs. Jack Gundiach: (Speaking for her mother) We have a 50' x 124' lot and we have 2,400 square feet in our house and. I tmow you can get what this gentleman wants on his lot. b~r. Lockridge: Quite a few of us paid more for the lots and we were advised that there was not going to be any crowded building and we could have gone other places to build our houses at that time. ~4r. M. E. Dittes: Our objection is that we objected to putting four houses where only two should be. Now, as soon as he builds this one he has this other one for sale now. It ~ill reduce the desireability of our places and our loss of revenue, because the value of our houses will go down. B'fr. Kilby: I just o~m the one lot. bYr. Ridgeway: I have a lot next to me that I wish someone would build on. If I ~re living there, I would much prefer to have a house built in accor- dance with City Ordinance. Mr. Davis: This Board has §ranted this s~veral times Jn the past. ii' this lot was platted ~ 1962 as such, ~d if it appears that this change would not harm the neighborhood, and for a one fan~ly hot,se, this Board has the power to grant such a request. ~!r. Yates: He is observin~ the setback reqiuirements of 7-1/2' from each property line on the site~ 15' between the houses, according to the setbacks on the side. ~:'~rs. Hoffmm~: ~%% signed this letter before we lauew the neighbors objected to it. h% have to live here ~nd we don't w~t any trouble in the area. Mr. Davis: Yes. ~4r. Ridgeway: He has over the required footage there. Mr. Rebb: }~. Yates, you are in the real estate business, am I right? You want to sell fl~e lot on the other corner. ~,Ir. Yates: Yes, I mm in the real estate business. It is a 60' lot that I have for sale. Mr. Rebb: ;~en ;~r. Kilby's brother purchased the other lot, he knew then that they would build houses on it. ~Irs. Gonmman: Those lots were zoned and could not be built on, unless they were 60' lots. ~4r. Kilby: This situation was there before this gentleman even built there. I~'!r. Ridgeway asked for comments from. the Board. There were none. Mr. Davis: (Mr. Kilby I sympathize with you paying taxes on the lot and also getting the ~rrong information from t~he Building Department.) Mr. Davis moved that the Variance be denied. Seconded by Ezell Hester, 2 votes in favor of the motion. 2 votes against the motion. Nr. Curtis Weaver abstained, due to the fact that his brother is involved. }.lotion defeated. Mr. Davis: It. takes a vote of 4 to 1 of a full Board and as you cmn see, we don't have a full Board. 3fe ~,~11 have to place this in the hands of the City attorney, as we have to have a legal opinion on this. I believe that this means the variance is not g-ranted. If we are wrong, there would have to be another meeting. Mr. Kilby: I ma going to deed this lo't to the City as a playground. The deed is already- typed up, and I will call my attorney in the mornin£ and have it recorded. Mr. Ridgeway: This will be tum~ed over to *.he City attorney as soon as possible for his opinion and all the people will be notified of the resultS. Iww.
