New Business
Request for variance in front lot width and side setback requirements
on the following described property.
Lots 31 and 32, Block 2
McDonald Park Subdivision
as recorded in Plat Book 12, Page 692
Palm Beach County records.
Address: 233 S. W. 8thAvenue
Owner: Jack Gundlach
Mr. Gundlach came forward advising that he wanted to build a house similar
to those in the same neighborhood. He had house planned for a 50 foot
lot~ almost exactly the same as the house right beside his lot. He is
building it to live in himself. He did not know about setbacks when he
purChased the property from the real estate agent. He is requesting a
I% foot variance on each side of the 50 foot lot.
Mr. Selhast, of 312 S. W. 8th Avenue, came fom~?ard to advise there were
only one or two houses there when he purchased his property. One bank had
a deed restriction of i00' only. We have had 70', 60' and 50' lots. There
is one 50' lot built on and built with the same specifications that everyone
else lives up to. He does not feel it is anyone elses headache but Mr.
Gundlach's.
Mr. Hartman, of 213 S. W. 8th Avenue came fo~ard to advise that the man that
sold him the lot, should have advised him of this when he purchased the lot
and Mr. Gundlach should have checked this himself before purchasing it.
Mr. August Getz, of 212 S. W. 7th Avenue came forward, advising it is
possible for Mr. Gundlach to get the square footage required in the house
on this property.
Mr. Archie Vick came fo~¢ard and advised he feels the same as everyone else,
but he feels that the members sitting on these various boards, in their own
way, stipulate certain things. He is for upholding the present measurements.

Mr. Ridgeway advised he Lad three letters from people livingtin that area

Hr. Gur, dlach advised that what he had in mAnd is, he was going to buy a lot
on S. W, 10th Avenue and set back 6' and so he purchased this other lot,
fJ~guring that t~o blocks North wouldn't vary that much, From his lot to
the co).~e:c~ is 231 feet and according to his survey, that makes three
60' lots, plus a 50~ lot and that someone is going to have to build on it
and he happened to wind up with the 50' lot. The elevation is almost
exactly like the one next to him. He is only asking for 18 inches on each
side. He is no~ going to hurt anyone in the neighborhood.
Several questions asked Mr. Gundlach by the Board:
Mr. Se!hast: I understand that on a 50' lot, with a 6' variance beseech
the side of the house and the lot line, I have been told that it is pretty
difficult to build a house with 1250 square feet.
There were no further complaints from the audience.
Discussion by the Board:
M~.yates advised that where the house has not been started yet, he does
not feel a hardship is present at this time.
Mr, Gundlach advised that he has a loan from the Bank already and if he goes
back to the Bank, they would have to change the Bank loano If I have to
take 18 inches off either side of the house, it will make a big difference
in the loan from the Bank. That is my hardship in this case.
Mr. Yates advised the reason they raised the setback to 7½ 'feet is because
it is a very nice section over there and they want to keep it that way.
Mr. Gundlach stated that either his 50' lot is done m, ay w~th, or let it
sit there, If I m,~i~~ a house on it and had to make it smaller, it would
not be in good taste with the rest of the houses in the neighborhood.
~L~i~_~s: Are you all on different sized lots? Is 50~ lot in the mim~
ority? This is no hardship to you and it should have been checked before
your purchase of the property. If we give you a variance, it would be
giving ~ou an advantage over those already built there. You must prove a
certain unique hardship and from what you have given us, it does not show
a real
Further discussion held, Mr, Davis read from the variance of record at
this time.
Mr. Yates moved that this request for the side setback variance be denied.
Seconded by Mr. Davis. Unanimously carried.
Mr. Davi_ s moved that Mr. Gundlach be given his request of 50' frontage non-
conforming lot. Seconded by Mr. Yates. Unanimously carried.
Mr. Davis moved the meeting be adJourmed. Seconded by Mr. Brand, Unamimous-
