Minutes 11-19-65Minutes of the Board of AdJustmont Meeting held in City Hall, Boynton Beach, Florida, November 19, 1965, at 5:00 P.M. PRESENT: George Davis M. L. Doughty William Yates Jay Sarno Albert Wehrell, Alternate Harold Blanchette, Building Inspector F. T. Kain, City Manager ABSENT: David Swank The meeting was called to order by the Chairman at 5:00 P.M. Mr. Doughty made a motion to dispense with the reading of the previous minutes. Motion was seconded by Mr. Sarno and carried unanimously. The minutes were approved as written. NEW ~USINES$ Food Fair Stores, Inc. is applying for the variance indicated under and pursuant to the provisions of the Zoning Code of said City: Variance in setback requirement along east property line Lot 41, less North 100' thereof, and less West 150' thereof, and less the Easterly. 2.5' for N. Eo 6th Court and less the Southerly 4~ feet for Ocean Avenue, Dewey's S/D as recorded in Plat Book l, page 37, Palm Beach County Records. Address: 100-108 North Federal Highway Owner: George Corporation Applicant: Food Fair Stores~ Inc. Mr. Wood, Secretary of George Corporation, Mr. Weiss, attorney, and Mr. Kansman, engineer, representing Food Fair Stores, Inc., and the Board members discussed the use of space available in order to supply parking spaces and have area to build and supply the super market. It was pointed out that 4 feet should be allowed in the back for adequate landscaping. The parking area is to be reduced from ll0' to 108'. Mr. Blanchette was asked if the parking plan could be used with 108' when it legally should be llO'. He stated that it was his opinion that the application should be amended to include 2' in the front parking lot. There was also a discussion of having one-way aisles in the 108' parking area. Mr. John Cassidy, of Coral Ridge Properties, was introduced and he stated that he was present in the absence of Mr. Benton and that Coral Rid. ge Properties had no objeCtion to the k' setback if there is no loading in this area. Mr. Cassidy stated that he hoped that this side of the store will be taken care of to protect the beautification of his property. There were no other objectors present in the audience. There being no further questions~ the chairman asked for a motion. Mro Yates made a motion to grant applicants 8' variance instead of 6'. Motion was seconded by Col. Wehrell. This motion was rescinded by Mr. Yates because after some discussion it was decided it was not legally feasible. Mr. Kain was asked his opinion as to how the motion should be stated and he said he thought that it should be as originally presented based on the old requirements and that the Board could not grant a variance which has not been applied for. He was of the opinion that there should be a new requirement. Mr. Doughty then made a motion allowing ~' variance, as adver- tised, with the recommendation from the Board that the Building Department and City waive the llO' to 108'parking area and to change parking to one-way aisles.
