CALL TO ORDER Chairman DeLiso called the meeting to order at 7:05 p.m. II. APPROVAL OF MINUTES Mr. Foot noted that he abstained from voting on the last motion on Page 4. He requested that the motion be changed to indicate that it passed 6-1 with Mr. Foot abstaining. Mr. Foot inquired if staff has reviewed the minutes. Mr. Blasie said that he reviewed the minutes in their entirety. Motion, Mr. Foot moved to approve the minutes, as amended. Motion seconded by Ms. Zibelli and unanimously carried. III. Motion Mr. Foot moved to approve the agenda, as amended. Motion seconded by Mr. Walsh and unanimously carried. IV. SWEARING IN OF WITNESSES AND INTRODUCTION Chairman DeLiso requested that the Recording Secretary administer the oath to all persons who would be testifying. Mr. Blasie called the roll and noted that people who were present would have their cases heard first. Chairman DeLiso explained the plea system to the audience. V. NEW BUSINESS A. CASES TO BE HEARD Chairman DeLiso requested that Case 01-2110 be heard first. Case #01-2110 Property Address: Violation: GVH Estates Homeowners Association 2775 SW 14th Street SBC '97 Edition 104.1.1; Permit is required for awning over entrance to clubhouse. Inspector Roy presented the case on behalf of the City. The property was originally cited on AugUst 13, 2001 through a citizen's complaint. Service was accomplished by certified mail. The City recommends 30 days. Mr. Richard Philpott, President of the Golfview Harbour Homeowner's Association, pointed out that the correct name of the respondent is Golfview Harbour Homeowner's Association. Mr. Philpott was not certain how he should plead. They relied on the contractor to obtain the proper permits when the awning was put up. However, the contractor never applied for the permit. Mr. Philpott presented a copy of a letter sent to the contractor by certified mail. There has been no response. Chairman DeLiso pointed out that the Homeowner's Association is ultimately responsible for securing the proper permitting and suggested that the respondent plead no contest. The respondent also presented Meeting Minutes Code Compliance Board Boynton Beach, Florida October 17, 2001 a copy of the receipt, which showed that the awning has been paid in full. Mr. Blasie pointed out that this case involves an awning attached to the clubhouse to provide shelter to the sidewalk. Attorney Tolces requested that the respondent furnish copies of the documents to the Board, which Mr. Philpott said he would make available. He requested 60 days, to which the City agreed. Motion Based on testimony and evidence presented in Case No. 01-2110, Mr. Foot moved that this Board find, as a matter of fact and as a conclusion of law, that Golfview Harbour Homeowner's Association is in violation of the Standard Building Code '97 Edition 104.1.1. Mr. Foot moved to order that the Respondent correct the violation on or before December 17, 2001. If the Respondent does not comply with this Order, a fine in the amount of $25.00 per day, plus administrative costs, shall be imposed. The Respondent is further ordered to contact the City of Boynton Beach Code Compliance Division to arrange for reinspection of the property to verify compliance with this Order. Motion seconded by Vice Chair Hammer and unanimously carried. Case #01-1704 Carrie M. Terranova Property Address: 123 SW 13th Avenue Violation: SBC '97 Edition 104.1.1 and Section 10-3 B.B.C. of Ord.; Please apply for and receive proper permits and inspections for the new storm shutters that were installed; pressure treated wood frame structure that has been installed on the north property line also requires a building permit and inspections; or needs to be removed due to hurricane hazards. Inspector Lewis stated the property was originally cited on July 18, 2001. Mr. Don Terranova, 123 SW 13th Avenue, Boynton Beach pled no contest and requested 30 days. Motion Based on testimony and evidence presented in Case. No. 01-1704, Vice Chair Hammer moved that this Board find, as a matter of fact and as a conclusion of law, that Carrie M. Terranova is in violation of the Standard Building Code '97 Edition 104.1.1 and Section 10-3 of the City Code of Ordinances. Vice Chair Hammer moved to order that the Respondent correct the violation on or before November 19, 2001. If the Respondent does not comply with this Order, a fine in the amount of $25.00 per day, plus administrative costs, shall be imposed. Motion seconded by Mr. Walsh and unanimously carried. Case #01-1708 Property Address: Violation: Robert R. and Barbara A. Orlando 536 NE 20th Avenue Chapter 15, Article IX-15-120 (D), Inc. and 20-6 B.B.C. of Ord.; Boat must be parked on hard surface or parked behind front roofline. Remove all loose trash and miscellaneous items; mow grass and weeds; install grass where bare spots occur. inspector Roi' stated the case was originally cited on July 19, 2001 through a complaint from a neighbor. Service was accomplished by certified mail and the City recomm(inds 30 days. The only remaining violation is the grass and the respondent h~ls already placed dirt on the ground. Mr. Robert ¢~rlando, 536 NE 20th Avenue, Boynton Beach, pled no contest. The respondent requested 60 days because he needed to install an irrigation system. The irespondent was iadvised to speak with the Building Division in the event permitsiwere necessary. Motion Based on testimony and evidence presented in Case No. 01-1708, Mr. Foot moved that this Board find, as a matter of fact and as a conclusion of law, that Robert R. and Barbara A. Orlando are in violation of Code Sections Chapter 15, Article IX-15-120(D), Inc. and 20-6 of the Boynton Beach Code of Ordinances. Mr. Foot moved to order that the Respondents correct the violations on or before December 17i, 2001. If the Respondents do not comply with this Order, a fine in the amount of $25.00 per day, plus administrative costs, shall ~be imposed. The Respondents are further ordered to contact the City of Boynton Beach Code Compliance Division to arrange for reinspection of the property to verify compliance with this Order. Motion seconded by Vice Chair Hammer and unanimously carried. Case #01-2397 Property Address: Violation: Gracie M. Denson 220 NW 6th Avenue Chapter 15, Article IX-15-120 (D) .lA and 10-3 B.B.C. of Ord.; Please remove all loose trash and debris that are hurricane hazards; remove inoperable unlicensed vehicle. Inspector Webb stated the property was originally cited on September 5, 2001 through routine neighborhood inspection. Service was obtained by certified mail. Ms. Gracie M. Denson, 220 NW 6th Avenue, Boynton Beach, was uncertain on how to plead. Ms. Denson said that her son is currently incarcerated and she is keeping the car on her property until he is released. She was informed that if the car were kept covered, it would be permissible on her property. Ms. Denson stated that she does not have any money to have the vehicle removed or licensed. She was informed that the Code requires that the vehicle be licensed and operable. Ms. Denson requested she be allowed to keep the vehicle until next February or March when her son is expected to be released. The trash has been removed from the property. Chairman DeLiso requested to view the photos. Ms. Zibelli pointed out that the car being covered and kept on the property is considered open storage, which is not permissible. Motion Based on testimony and evidence presented in Case No. 01-2397, Mr. Foot moved that this Board find, as a matter of fact and as a conclusion of law, that Gracie M. Denson is in violation of Code Section 10-3 of the B.B.C. of Ordinances, Mr. Foot moved to order that the Respondent correct the violation on or before January 2, 2001. If the Respondent does not comply with this Order, a fine in the amount of $25.00 per day, plus administrative costs, shall be imposed. The Respondent is further ordered to contact the City of Boynton Beach Code Compliance Division to arrange for reinspection of the property to verify compliance with this Order. Motion seconded by Ms. Zibelli and unanimously carried. OLD BUSINESS A. LIEN PENALTY CERTIFICATIONS (Tabled) Case #01-1111 Elizabeth Gamble & Willie Denson 115 NW 6th Ave. Inspector Webb stated the notice of violation was dated May 17, 2001 for violation of the Community Appearance Code. No one appeared at the July 18, 2001 hearing date. A compliance date of August 13, 2001 was set or be fined $25.00 per day. The property is not yet in compliance. Ms. Betty Denson, 710 NW 3rd Street, Boynton Beach, stated she was present on behalf of Willie Denson. Elizabeth Gamble is deceased and Willie Denson is suffering from cancer. Ms. Denson said that her sister was informed by someone in the Code Compliance Office that if the car was covered and kept under the carport, it would be allowed on the property. Ms. Denson stated that the vehicle is operable, but because of her father's illness, he is unable to get the vehicle registered. Meeting Minutes Code Compliance Board Boynton Beach, Florida October 17, 2001 Ms. Denson was advised to get the vehicle registered on behalf of her father in order to meet compliance, otherwise a lien would be placed on the property. The respondent requested 60 days. Motion Mr. Foot moved that Case No. 01-1111 be tabled until the Code Compliance Board Meeting to be held on December 19, 2001. Motion seconded by Mr. Walsh and unanimously carried. Case #01,1192 Margaret Newton 701 NW 4th Street Inspector Pierre stated the property was cited on May 29, 2001 for violation of the Community Appearance Code. No one appeared at the July 18, 2001 hearing date. A compliance date of August 2, 2001 was set or be fined $25.00 per day. The property complied on September 10, 2001 for 38 days of non- compliance. Ms. Margaret Newton, 70'1 NW 4th Street, Boynton Beach, stated she never received notice of the violation. Ms. Newton was shown the certified receipt and stated that it was not her signature and she had not received any other information from the City. She said as soon as she was informed of the violation, she cleaned up the property. The City recommended no fine. Motion Based on the testimony and evidence presented in Case No. 01-1192, Mr. Walsh moved that this Board find, as matter of fact, that the Respondent, Margaret Newton, was in violation of Code Sections Chapter 15, Article IX-15-120 (D), Inc., subsequent to the date of compliance specified in this Board's Order of July 18, 2001. Mr. Walsh moved that this Board find that the Respondent failed to comply with this Board's Order, and that this Board impose and certify no fine. Motion seconded by Ms. Zibelli and unanimously carried. B. LIEN PENALTY CERTIFICATIONS Case #0'1-1231 John & Jalene Edmond 306 NW 7th Court Inspector Webb stated that the notice of violation was dated May 31, 2001 for violation of the Community Appearance Code. No one appeared at the August 15, 2001 Code Compliance Board hearing. A compliance date of September 17, 2001 was set or be fined $25.00 per day. The property is not yet in compliance. Mr. John Edmond, 306 NW 7th Court, Boynton Beach, stated that he no longer parks his car on the grass and that the grass has grown back. Chairman DeLiso stated that after looking at current photos, it appears that the property is still in need of grass and is not in compliance. The respondent was advised that all the property being cited needed to be resodded. Motion Mr. Foot moved that Case No. 01-1231 be tabled until the Code Compliance Board Meeting to be held on November 19, 2001. Motion seconded by Mr. Walsh and unanimously carried. C. LIEN REDUCTIONS (Tabled) Case #98-3856 Charles Raymon & Marie Luma 526 NE 2nd Street Mr. Blasie reported that the property was originally cited on November 9, 1998 for violation of the Community Appearance Code. Service was made by posting. No one appeared at the January 20, 1999 Code Compliance Board hearing. A compliance date of February 15, 1999 was set or be fined $25.00 per day. The property complied on September 11,2001, for 938 days of non-compliance. This amounts to a fine of $23,450, plus administrative costs of $634.12. Mr. Blasie reported that since 1998 the property has been in poor shape. The backyard is normally filled with cars and repairs are taking place. Mr. Blasie said that the respondents came into his office when they learned that there was a lien on their property. They stated that they never received any mail. Mr. Blasie pointed out that the County property records show that their address of record is 526 NE 2® Street. Mr. Blasie presented current photos showing that the property has been cleaned up. Marie Luma, 526i NE 2nd Street, Boynton Beach, stated she was very sick and was in the hospital. Although she lives at another address, she discovered the letter when she ireturned home from the hospital. Ms. Zibelli inquired if the property was rental property and the respondent stated that her cousin lives on the property and Pays no rent. Mr. Foot inquired when the respondent first determined there was a lien and she stated in August when she came home from the hospital. Mr. Foot inquired if there has been any other correspondence with the respondent since the property was cited back in 1999. Mr. Blasie replied that there have been two additional citations on the property in August of this year and the property has had a vehicle problem dating back to 1996. At one time there were four liens on the property. Since 1996 the property has been cited 12 times. Mr. Foot asked the respondent how long she was in the hospital and she responded seven months. The respondent stated that she had no money to pay any fines. In light of her financial situation, Chairman DeLiso asked the 7 Meeting Minutes Code Compliance Board Boynton Beach, Florida October 17, 2001 respondent if she wished to withdraw her lien reduction case and have her fee refunded. Ms. Luma requested to move on with the case. Inspector Pierre interpreted for the respondent. After discussion, she said she could pay up to $5oo. Motion Based on the testimony and evidence presented in Case #98-3856, and having been advised that the Respondents have complied with all lien reduction procedures set forth in Sections 2-84 through 2-89 of the City of Boynton Beach Code of Ordinances, Ms. Zibelli moved that this Board find that the fine instituted in Case No. 98-3856, by virtue of this Board's Order of January 20, 1999, be reduced to $2,000. This order is not final until the expiration of the time of appeal expires under Ordinance 01-07. Motion seconded by Vice Chair Hammer. Motion failed 3-3 (Chairman DeLiso, Mr. Foot and Mr. Walsh dissenting). After discussion, Vice Chair Hammer requested that the motion be amended to reduce the fine to $1,000. Ms. Zibelli did not wish to amend her motion. Chairman DeLiso Called for a new motion. Motion Based on the testimony and evidence presented in Case #98-3856, and having been advised that the Respondents have complied with all lien reduction procedures set forth in Sections 2-84 through 2-89 of the City of BoyntOn Beach Code of Ordinances, Mr. Foot moved that this Board find that the fine instituted in Case No. 98-3856, by virtue of this Board's Order of January 20, 1999, be reduced to $1,000, including administrative costs. This order is not final until the expiration of the time of appeal expires under Ordinance 01-07. Motion seconded by Vice Chair Hammer. Motion carried 4-2 (Mr. Rossi and Ms. Zibelli dissenting). D. LIEN REDUCTIONS Case #98-2165 Gary & Earlene Roberts 702 SE 1st Street Mr. Blasie reported that the case was originally cited on June 5, 1998 for violations of the Community Appearance Code. The respondent appeared at the November 18, 1998 Code Compliance Board hearing. A compliance date of January 18, 1999 was set or be fined $25.00 per day. The property complied on June 17, 1999 for 149 days of non-compliance. The fine in the case comes to $3,725, plus $826.18 in administrative costs. Mr. Roberts has ;been ill and has been unable to maintain the property. Mr. Blasie presented photographs of the property taken on February 17, 1999. The 8 Meeting Minutes Code Compliance Board Boynton Beach, Florida October 17, 2001 property has now been cleaned up and the fence is gone. The respondent informed Mr. Blasie that he was behind in his payments and may lose his house. Mr. Gary Roberts, 702 SE Ist Street, Boynton Beach, was administered the oath by the Recording Secretary. Mr. Roberts said that he cleaned the property up in 1999 and Inspector Lewis approved it. The respondent didn't know there was a lien on the property until he received an offer on the house. Mr. Roberts stated he is in very poor health and is unable to care for himself. Mr. Blasie reported that the respondent's neighbor offered to purchase the property. The property is zoned commercial and they would like to expand their business. Mr. Foot suggested a fine of administrative costs. Chairman DeLiso felt that there should be no fine assessed because of the health of the respondent. Motion Based on the testimony and evidence presented in Case #98-2165, and having been advised that the Respondent has complied with all lien reduction procedures set forth in Sections 2-84 through 2-89 of the City of Boynton Beach Code of Ordinances, Vice Chair Hammer moved that this Board find that the fine instituted in Case No. 98-2165, by virtue of this Board's Order of November 18, 1998 be reduced to $0. This order is not final until the expiration of the time of appeal expires under Ordinance 01-07. Motion seconded by Mr. Walsh and carried 5-1 (Mr. Foot dissenting). Case #99-2176 Michelet & Renose Louis 300 NW 14th Ave. Mr. Blasie stated the property was originally cited on August 27, 1999 for violations of the Community Appearance Code. No one appeared at the November 17, 1999 hearing date and service was made by posting. A compliance date of December 13, 1999 was set or be fined $25.00 per day. The property complied on October 8, 2001 for 664 days of non-compliance for a fine of $16,600, plus administrative costs. Mr'. Blasie presented photographs of the property taken on November 14, 1999 and one taken today. There was a note in the file that indicated Inspector Roy spoke to Mrs. Louis approximately one year ago and advised her what needed to be done to the property. The respondents also had difficulty maintaining grass in the swale because it is a school bus stop. Ms. Michelet Louis, 300 NW 14th Avenue, Boynton Beach, stated when she was first cited she did all the work that was required. However, the children are always walking in the grass. She pointed out that she was unable to water the grass due to the water restrictions. Chairman DeLiso informed the respondent that the water restrictions have been lifted. Also, the restrictions didn't come into 9 Meeting Minutes Code Compliance Board Boynton Beach, Florida October 17, 2001 effect until sometime late last fall and the property has been out of compliance for 664 days. The respondent stated she was a single parent and could not pay a large fine. She is currently liVing at the property and is not planning to sell it. Motion. Based on the testimony and evidence presented in Case #99-2176, and having been advised that the Respondent has complied with all lien reduction procedures set forth in Sections 2-84 through 2-89 of the City of Boynton Beach Code of Ordinances, Vice Chair Hammer moved that this Board find that the fine instituted in Case No. 98-2165, by virtue of this Board's Order of November 17, 1999 be reduced to $1,000. This order is not final until the expiration of the time of appeal expires under Ordinance 01-07. Motion seconded by Mr. Foot, The motion failed 3-3 (Chairman DeLiso, Mr. Rossi and Ms. Zibelli dissenting). Chairman DeLiso recommended increasing the fine to $1,660. Vice Chair Hammer amended her motion to this effect. Mr. Foot agreed to amend his second of the motion. The motion carried 6-0. The respondent stated she could not pay the fine and that she is not well. The respondent was informed that she could appeal to the City Commission if she did not agree with the finding. CASES TO BE HEARD Case #01-1558 Property Address: Violations: Luis A. & Deirdre A. Benitez 505 NW 8th Court Chapter 15, Article IX-15-120 (D), Inc. and 120 (E) 2C; Please repair driveway and replace all broken windows to comply with City Codes. Deirdre A. Benitez stated that she repaired the door and the windows will be repaired this week. The respondent stated she is divorced and filing Chapter 13 to save her home. She pled no contest and requested 60 days. Motion Based on the testimony and evidence presented in Case No. 01-1558, Mr. Foot moved that this Board find, as a matter of fact and as a conclusion of law, that Louis A. and Deirdre A. Benitez are in violation of Code Sections Chapter 15, Article IX-15-120 (D), Inc. and 120 (E) 2C of the City Code of Ordinances. Mr. Foot moved to order that the Respondents correct the violations on or before December 17, 2001. If the Respondents do not comply with this Order, a fine in. the amount of $25.00 per day, plus administrative costs, shall be imposed. The Respondents are further ordered to contact the City of Boynton Beach Code 10 Meeting Minutes Code Compliance Board Boynton Beach, Florida October 17, 200t Compliance Division to arrange for reinspection of the property to verify compliance with this Order. Motion seconded by Mr. Walsh and unanimously carried. LIEN PENALTY CERTIFICATIONS Case #01-1272 Francisco Alvares 111 NE 16th Avenue Inspector Roy reported that the property was originally cited on June 4, 2001 for violation of the Community Appearance Code. No one appeared at the August 15, 2001 Code Compliance Board hearing. A compliance date of August 31, 2001 was set or be fined $25.00 per day. The property is not yet in compliance. Mr. Roy stated he received a call late yesterday afternoon from Mr. Alvares who told him the property was in compliance. Inspector Roy checked the property this afternoon and the property had not been cleaned up. The Recording Secretary administered the oath to Mr. Guy Estrella. Mr. Guy EStrella, 212 SW l0th Street, Boynton Beach, stated he was representing the owner and that a tow truck was supposed to remove the vehicles today. Chairman DeLiso asked what his relationship was to the owner and Mr, Estrella stated that he loaned the respondent money to keep his property from being foreclosed upon. He stated he could have the property in compliance within the next few days. Mr. Foot asked Attorney Tolces if Mr. Estrella could speak for the owner. Attorney Tolces Said if the Board wished to have more proof, the Board could require Mr. Estre!la to provide something in writing. Attorney Tolces suggested tabling the case until next month. Motion Vice Chair Hammer moved that Case No. 01-1272 be tabled until the Code Compliance Board Meeting to be held on November 19, 2001. Motion seconded by Mr. Walsh and unanimously carried. Attorney Tolces requested when Mr. Estrella attends the November meeting he provide proof that he is authorized to appear on behalf of the owner. RECESS WAS CALLED AT 8:50 P.M. Inspector Laverdure stated the case was cited on July 20, 2001 through routine inspection. Service was accomplished by certified mail. The City recommends 30 days. Motion Based on the testimony and evidence presented in Case No. 01-1731, Vice Chair Hammer moved that this Board find, as a matter of fact and as a conclusion of law, that Kirk and Susan Angelocci, are in violation of Code Sections Chapter 15, Article IX-15-120 (D) .lA of the City Code of Ordinances. Vice Chair Hammer moved to order that the Respondents correct the violations on or before November 19, 2001. If the Respondents do not comply with this Order, a fine in the amount of $25.00 per day, plus administrative costs, shall be imposed. The Respondents are further ordered to contact the City of Boynton Beach Code Compliance Division to arrange for reinspection of the property to verify compliance with this Order. Motion seconded by Mr. Walsh and unanimously carried. Case #01-1812: Everett D. & Doris Matthews Property Address: 3008 E. Palm Drive Violations: Chapter 15, Article IX-15-120 (D) .lA and 10-2 and 10-52 (A) B.B.C. of Ord.; Mow and de-weed your yard; remove all trash and debris; register and make operable all your vehicles parked on side and rear yards. Inspector Laverdure stated that the case was originally cited on July 25, 2001 through routine neighborhood inspection. Service was accomplished by certified mail. The City recommends 30 days. It was suggested that the lien reductions be limited to a certain number, but Mr. Blasie stated that this was not feasible due to various time constraints. Chairman DeLiso suggested that the cases on the agenda could be limited to a certain amount and that a second meeting be held for lien reductions only, plus any overflow from the regUlar meeting. Mr. Rossi pointed out that a great majority of the people cited do not show up for the meetings. Mr. Rossi would also like to see some guidelines in place on determining the lien reductions due to the great amount of controversy that takes place for each case being considered. If the Board met twice monthly, Mr. Blasie pointed out that this might necessitate staff having to attend, as well as locating a time and place for a second meeting. Members were pOlled on their opinions regarding a second meeting. Attorney Tolces did not think that covering two meetings would pose any problems for the City Attorney's Office. Mr. Foot pointed out that the Statute provides that there could be a second board, if needed. Chairman DeLiso asked if a motion would be necessary. Attorney Tolces suggested that the Board make a recommendation that staff investigate the possibility of the Board meeting twice monthly and report back to the Board at the next meeting. Mr. Blasie said he will investigate what times and venues would be available for a second meeting. Aisc, the attendance policy for Board members would have to be looked at if there were two meetings a month. Chairman DeLiso requested that Mr. Blasie rePort back to the Board at the November meeting on his findings. Mr. Foot wished to revisit the minutes from the last meeting. He felt there were issues during the Maas case that should have been included. Motion Mr. Foot moved that the minutes be expanded to include the statement that there were questions about the statements made by Mrs. Maas of her financial limitations. Aisc, it was noted that she showed above average knowledge of the real estate business. He requested that this additional language be added to page 14 at the end of the second full paragraph. Attorney Tolces noted that the minutes have already been approved and the person who approved the minutes needs to move to amend the minutes. Motion Mr. Foot moved to amend the minutes to include the statements that there were questions about :her statements of her financial limitations.
