SWEARING IN OF WITNESSES AND INTRODUCTION Chairman DeLiso requested that the Recording Secretary administer the oath to all persons who would be testifying. Inspector Lewis called the roll. Chairman DeLiso explained the plea system to the audience. V. NEW BUSINESS A. CASES TO BE HEARD Case #01-1792 Property Address: Violation: Olive B. & Wilbert S. Hall 248 SW 4th Avenue SBC '97 Edition 104.1.1; and receive a building canopy structure Please apply for permit for the Inspector Lewis stated that the property was originally cited on July 24, 2001. Wilbert S. Hall, 248 SW 4th Avenue, Boynton Beach, pled not guilty. Inspector Lewis presented photographs of the canopy to the Respondent and then to the Board and stated there is no record of a permit. Chairman DeLiso inquired if the canopy can be permitted and Inspector Lewis was not certain. Inspector Lewis 2 Meeting Minutes Code Compliance Board Boynton Beach, FL March 20, 2002 responded that he sent copies of the requirements issued by the Building Division for canopies to the Respondent. Chairman DeLiso was under the impression that the City's Building Department would be contacting all residents who own canopies to attend a meeting. Mr. Blasie reported that Code Compliance sent letters to all current owners of canopies informing them how to bring the canopies into compliance, Mr. Foot asked Attorney Tolces if the Board should proceed to hear the case. Attorney Tolces responded that the Board could choose whatever action it wished to take. Mrs. Hall said that when they purchased the house in 1995, the canopy was present. She felt that they should not be required to have a permit for the canopy since it was already on the property when they bought the house. Mr. Rossi pointed out that it was incumbent upon the property owners when purchasing property to determine if there was anything illegal on the property. Mr. Hall responded that they relied upon the realtor when they purchased the property. Chairman DeLiso asked Attorney Tolces how canopies were addressed in the City's Code. Attorney Tolces responded that the Code has not been changed, but a determination was made that canopies were structures that require a permit. Also canopies must meet the windload requirements. Motion Based on the testimony and evidence presented in Case No. 01-1792, Mr. Foot moved that this Board find, as a matter of fact and as a conclusion of law, that Olive B. and Wilbert S. Hall are in violation of the Standard Building Code '97 Edition 104.1.1. Mr. Foot moved to order that the Respondents correct the violations on or before May 20, 2002. If the Respondents do not comply with this Order, a fine in the amount of $25 per day, plus administrative costs shall be imposed. The Respondents are further ordered to contact the City of Boynton Beach Code Compliance Division to arrange for reinspeCtion of the property to verify compliance with this Order. Motion seconded by Mr. Rossi. Motion carried 5-1 (Vice Chair Hammer dissenting.) Case #01-1794 Property Address: Violation: Paul O. Williams 320 SW 4th Avenue SBC '97 Edition 104.1.1; and receive a building canopy structure Please apply for permit for the Inspector Lewis stated the case was originally cited on July 24, 2001. 3 Meeting Minutes Code Compliance Board Boynton Beach, FL March 20, 2002 Paul O. Williams, 320 SW 4th Avenue, Boynton Beach pled not guilty. Inspector Lewis presented photographs to the Respondent and then to the Board. Mr. Williams stated that his wife would speak. Mrs. Williams said that when they put the canopy up two years ago, she called the City and was informed that she did not need a permit if the canopy was not attached to the house. Chairman DeLiso referred to the previous case. He noted that when this issue first came before the Code Board, some of the members felt that a canopy was a temporary structure. The Board then asked the City Commission to define a canopy and whether or not it had to be permitted, The City Commission determined that canopies were structures and needed to be permitted, as well as meeting the necessary setbacks. Motion Based on the testimony and evidence presented in Case No. 01-1794, Mr. Miriana moved that this Board find, as a matter of fact and as a conclusion of law, that Paul O. Williams is in violation of the Standard Building Code '97 Edition 104.1.1. Mr. Miriana moved to order that the Respondent correct the violations on or before May 20, 2002. If the Respondent does not comply with this Order, a fine in the amount of $25 per day, plus administrative costs shall be imposed. The Respondent is further ordered to contact the City of Boynton Beach Code Compliance Division to arrange for reinspection of the property to verify compliance with this Order, Motion seconded by Mr. Rossi. Motion carried 5-1 (Vice Chair Hammer dissenting.) Case #02-154 Property Address: Violation: Bethie D. Mondesir & Mislaine Emilcar 171 SE 27th Place Chapter 15, Article IX-15-120 (D), Inc.; Remove all inoperable cars; re-sod area east of driveway. Inspector Roy stated the property was originally cited on January 17, 2002. Mislaine Emilcar, 171 SE 27TM Place, Boynton Beach, pled no contest and asked for additional time to remove the car. He cannot afford to get the car registered because the car needs to be repaired and insured. Chairman DeLiso inquired about the re-sodding. Inspector Roy stated that the Respondent told him that he would be re-sodding or de-weeding the property to bring it into compliance. The City recommended 30 days. Case #02-156 Property Address: Violation: Cleo Briggs 2867 SE 2nd Street Chapter 15, Article IX-15-120 (D), Inc.; Re- sod yard and maintain weed-free; recap driveway Inspector Roy stated that the case was originally cited on January 18, 2002 through routine neighborhood inspection. Service was made by certified mail. Isaac James, 217 NW 7th Court, Boynton Beach, appeared on behalf of Cleo Briggs, who was sick. Mr. James said that Mr. Briggs has submitted the survey to the City and should know shortly if it is approved. After the driveway is repaired the Respondent will fix up the yard. Staff agreed to 90 days. Motion Based on the testimony and evidence presented in Case No. 02-156, Mr. Foot moved that this Board find, as a matter of fact and as a conclusion.of law, that Cleo Briggs is in violation of Code Sections Chapter 15, Article IX-15-120 (D), Inc. of the City Code of Ordinances. Removal of the buckets, barrels and other miscellaneous items has complied. The property was cited through a complaint from a neighbor, Ulrick Notrez, 325 NE 16th Avenue, Boynton Beach, requested 30 days to remove the truck. Motion Based on the testimony and evidence presented in Case No. 02-249 Mr. Foot moved that this Board find, as a matter of fact and as a conclusion of law, that Ulrick Notrez and Gertrude St. Fort are in violation of Code Sections 14-3 B.B.C. of Ordinances. Mr. Foot moved to order that the Respondents correct the violations on or before June 19, 2002. If the Respondents do not comply with this Order, a fine in the amount of $25 per day, plus administrative costs shall be imposed. The Respondents are further ordered to contact the City of Boynton Beach Code Compliance Division to arrange for reinspection of the property to verify compliance with this Order. Boynton Beach Blvd. PT 3-LDR, Chapter 20-VIII, Section 2.A, VIII, Section 2.C, VIII and Section 2.H; 10-2 B.B.C. of Ord.; and Chapter 15, Article IX- 15-120 (D) I.H; Please replace and paint as needed all fascia wood; repair vent screens to prevent rodent entry; trim all trees away from building; remove all Florida Holly trees Inspector Webb stated the property was originally cited on November 19, 2001 through a tenant complaint. Service was accomplished by hand carry. Terry Chase, 815 W. Boynton Beach Boulevard, Boynton Beach, pled no contest and requested 90 days. Board members viewed the photos. Motion Based on the testimony and evidence presented in Case No. 01-3158, Mr. Foot moved that this Board find, as a matter of fact and as a conclusion of law, that Boynton Beach Lakes Ltd. is in violation of PT 3-LDR, Chapter 20-VIII, Section 2.A, VIII, Section 2.C, VIII and Section 2.H; 10-2 B.B.C. of Ord.; and Chapter 15, Article IX-15-120 (D) 1.H of the City Code of Ordinances. Mr. Foot moved to order that the Respondent correct the violations on or before June 19, 2002. Pool must be removed or filled in, or have pool permitted and inspected. A proper pool barrier must be installed. InspectOr Webb stated that the property was originally cited on December 12, 2001 through routine neighborhood inspection. Service was accomplished by posting. Dale Kaus, 926 NE 7th Street, Boynton Beach, pled no contest and requested time for compliance. Mr. Kaus stated the property has been sold as is and he is not certain what the new owner wants to do. Motion Based on the testimony and evidence presented in Case No. 01-3399, Mr. Foot moved that this Board find, as a matter of fact and as a conclusion of law, that Dale and Tina Kaus are in violation of SBC '97 Edition 104.1.1 and 105.6. Mr. Foot moved to order that the Respondents correct the violations on or before April 19, 2002. If the Respondents do not comply with this Order, a fine in the amount of $25 per day, plus administrative costs shall be imposed. The Respondents are further ordered to contact the City of Boynton Beach Code Compliance Division to arrange for reinspection of the property to verify compliance with this Order. Griffin 219 NW 11th Avenue SBC '97 Edition 104.1.1; Chapter 15, Article IX-15-120 (D).lA, 120 (E) 2A and 120 (E) 2C; Please remove unpermitted shed or obtain permit; Permit needed for wooden fence; repair all fascia boards and soffit screens; and remove all loose trash and debris Inspector Webb stated that the property was cited on January 16, 2002 through a citizen's complaint. Service was obtained by certified mail. The Respondent was administered the oath. Meeting Minutes Code Compliance Board Boynton Beach, FL March 20, 2002 Jannie M. Griffin, 219 NW 11th Avenue, Boynton Beach, pled no contest and stated that the shed had been torn down. The screens have also been repaired. The Respondent asked for 30 days to tear the fence down. Motion Based on the testimony and evidence presented in Case No. 02-115, Mr. Miriana moved that this Board find, as a matter of fact and as a conclusion of law, that Jannie M. Griffin. is in violation of SBC '97 Edition 104.1.1; Chapter 15, Article IX- 15-120 (D) .lA, 120 (E) 2A and 120 (E) 2C of the City Code of Ordinances. Mr. Miriana moved to order that the Respondent correct the violations on or before April 17, 2002. If the Respondent does not comply with this Order, a fine in the amount of $25 per day, plus administrative costs shall be imposed. Case #01-3440 Property Address: Violation' Alphae Edwards & Penny Jones 117 NE 13th Avenue Chapter 15, Article IX-15-120 (D), Inc.; Please de-weed front yard and install sod to comply with City Codes Penny Jones, 117 NE 13th Avenue, Boynton Beach, pled no contest. The Respondent stated she is applying for assistance to obtain grass. Chairman DeLiso suggested tabling the case. Motion Vice Chair Hammer moved that case No. 01-3440 be tabled until the Code Compliance Board Meeting to be held on May 15, 2002. Motion seconded by Mr. Walsh and unanimously carried. Case #01-3492 Property Address: Violation' James E. and Eddie W. McGrady 309 NW l0th Avenue Chapter 15, Article IX-15-120 (D), Inc.; Unregistered/inoperative vehicles sre not allowed in residential area; Please remove all vehicles; Sod west side of driveway The Recording Secretary administered the oath to the Respondent. Inspector Pierre stated that the case was originally cited on December 21,2001. 8 Meeting Minutes Code Compliance Board Boynton Beach, FL March 20, 2002 James E. McGrady, 309 NW 10th Avenue, Boynton Beach, pled not guilty. The Respondent Said that the vehicles on his property are operable and registered. Inspector Pierre presented photos. The Respondent stated that one of the vehicles belongs to his brother and he did not know if this car was registered. Motion Based on the testimony and evidence presented in Case No. 01-3492, Vice Chair Hammer moved that this Board find, as a matter of fact and as a conclusion of law, that James E. and Eddie W. McGrady are in violation of Code Sections Chapter 15, Article IX-15-120 (D), Inc. of the City Code of Ordinances. Vice Chair Hammer moved to order that the Respondents correct the violations on or before April 17, 2002. If the Respondents do not comply with this Order, a fine in the amount of $25 per day, plus administrative costs shall be imposed. The Respondents are further ordered to contact the City of Boynton Beach Code Compliance Division to arrange for reinspection of the property to verify compliance with this Order. Case #02-088 Property Address: Violation: Jerry McAdoo 411 NE 2nd Street Chapter 15, Article IX-15-120 (D), Inc.; Please install sod on both sides of property Inspector Pierre stated that the case was originally cited on January 14, 2002. Jerry McAdoo, 411 NE 2nd Street, Boynton Beach, stated that the property was rental property and he needed time to bring the property into compliance. He said that he has financial problems and was present tonight for his mother's property, as well. The Respondent requested six months in order to install an irrigation system. He stated he had spent $3,000 to place a driveway on his mother's property, since she is disabled and he is her sole support. Photos of the property were presented to the Respondent and then to the members. The Respondent stated that a relative occupied the property rent-free. Motion Based on the testimony and evidence presented in Case No. 02-088, Vice Chair Hammer moved that this Board find, as a matter of fact and as a conclusion of law, that Jerry McAdoo is in violation of Code Sections Chapter 15, Article IX-15- 120 (D), Inc. of the City Code of Ordinances. Vice Chair Hammer moved to order that the Respondent correct the violations on or before September 19, 2002. If the Respondent does not comply with this Order, a fine in the amount of $25 per day, plus administrative costs shall be imposed. Motion seconded by Mr. Walsh and unanimously carried. Case #02-228 Property Address: Violation: Edens &Avant Properties Lt. Partners 350 N. Congress Avenue Chapter 15, Article IX-15-120 (D), Inc.; Please remove loose trash and trim hedges on Hoadley Road. Remove dead tree. Repair all dumpster enclosures and maintain. Repair all sprinkler heads to comply with City Codes. Inspector Pierre stated the property was cited on January 23, 2002. Dan Ginsler, Regional Property Manager for Edens & Avant Properties, stated that the property is now in compliance. He received notification on January 28, 2002 to bring the property into compliance by February 2, 2002 and that it was impossible to bring the property into compliance in that short period. He relayed this to Inspector Pierre. Inspector Pierre agreed that most of the property has complied, but no~ed that there is still trash on the property and that the trimmings from the hedges were left on the ground. He further stated that these are reoccurring violations and noted that the City was requesting a cease and desist order. Inspector Pierre presented photographs. Mr. Ginsler responded 'that the property is cleaned everyday and they pay $60,000 to the City to have the trash hauled away. He stated that on several occasions, when the trash is picked up, some of it falls on the ground and it doesn't get picked up until his maintenance people come to work at night. Mr. Ginsler would like to have rollers placed under the dumpsters so that they could be pulled out and cleaned underneath. However, the City told him that they do not place rollers on dumpsters and that he should do this himself. Mr. Rossi, after viewing the photographs, felt it would be in order to provide the City with a cease and desist order. Motion Mr. Rossi made a finding that Edens & Avant Properties Limited Partners'have violated Chapter 15, Article IX-15 120 (D), Inc. of the City Code of Ordinances and based on the nature of the violation, Mr. Rossi moved that a Cease and Desist Order beginning on March 27, 2002, be imposed with a fine in the amount of $25.00 per reoccurrence of the violation. 10 Meeting Minutes Code Compliance Board Boynton Beach, FL March 20, 2002 After discussion, Mr. Rossi amended his motion to change the amount to $50.00 per reoccurrence. Motion seconded by Mr. Foot. Mr. Walsh stated that his condominium complex obtained dumpsters with casters through Mr. Larry! Quinn of the Public Works Department. He suggested that the Respondent contact Mr. Quinn. The motion unanimously carried. Attorney Tolces explained the cease and desist order to the Respondent. Case #02-271 Property Address: Violation: Billie J. Sanders 613 NW 2nd Street Chapter 15, Article IX-15-120 (D), Inc.; Remove unregistered and inoperative vehicle. Remove all ~oose trash and debris, including engine block. Inspector Pierre stated the property was originally cited on January 28, 2002. Billie Sanders, 613 NW 2nd Street, Boynton Beach pled not guilty. Inspector Pierre presented photos to the Respondent and then to the Board members. The Respondent stated that the car has been removed, as well as the loose trash and the engine block. Chairman DeLiso suggested that the case be dismissed. Motion Mr. Foot moved that Case #02-271 be dismissed. Motion seconded by Mr. Walsh and unanimously carried. Case #02-329 Property Address: Violation: Isaac James 215 NW 7th Court Chapter 15, Article IX-15-120 (D), Inc.; Please remove all unregistered/inoperable vehicles. Also, remove trash and debris from property. Inspector Pierre stated the property was originally cited on February 7, 2002. Mr. Isaac James, 215 NW 7th Court, Boynton Beach, stated that he did not own the white car and it is not on his property. Inspector Pierre stated that the vehicle was in the Respondent's driveway and presented photographs to the Respondent. After viewing the photographs, the Respondent acknowledged that the car was on his property. 11 Meeting Minutes Code Compliance Board Boynton Beach, FL March 20, 2002 Motion Based on the testimony and evidence presented in Case No. 02-329, Mr. Foot moved that this Board find, as a matter of fact and as a conclusion of law, that Isaac James is in violation of Code Sections Chapter 15, Article IX-15-120 (D), Inc. of the City Code of Ordinances. Mr. Foot moved to order that the Respondent correct the violations on or before April 19, 2002. If the Respondent does not comply with this Order, a fine in the amount of $25 per day, plus administrative costs shall be imposed. The Respondent is further ordered to contact the City of Boynton Beach Code Compliance Division to arrange for reinspection of the property to verify compliance with this Order. Motion seconded by Mr. Miriana and unanimously carried. LIEN PENALTY CERTIFICATIONS Case #01-1450 Suau Enterprises, Inc. 2360 N. Federal Hwy. 10218 Allamanda Blvd. West Palm beach, FL 334'10 Inspector Cain stated the notice of violation was dated June 18, 2001. No one appeared at the September 19, 2001 Code Compliance Hearing. A compliance date of January 14, 2002 was set or be fined $25.00 per day. The'property is not yet in compliance. Beryl Kruger was present to represent the Respondent. Mr. Kruger noted that the case was tabled last month and asked that it be tabled for an additional 90 days. He stated that he has met with the City Attorney, the Planning Division and Mr. Blasie and that it is going to take a minimum of nine months to resolve the issues. It may be necessary to obtain site plan approval, which would then require an additional nine months to erect the building. Mr. Kruger felt that within 90 days he should know exactly what must be done to bring the property into compliance. Motion Mr. Walsh moved that Case No. 01-1450 be tabled until the Code Compliance Board Meeting to be held on June 19, 2002. Motion seconded by Mr. Miriana. Mr. Foot noted that the fine will continue to accrue and Mr. Kruger requested that the fine be frozen until the issues can be worked out with the City. Mr. Kruger informed the Board that the only items stored in the trailer were sodas and because of this, the Respondent has to build a storage room and additional time is now needed. Mr. Blasie acknowledged that staff has been working with the owner and developer to straighten out the problem. This is not a life-safety issue, and when the project is completed, staff would hope that the Board would 12 Meeting Minutes Code Compliance Board Boynton Beach, FL March 20,2002 reconsider its previous actions. Mr. Blasie said that there have been no complaints from the neighbors regarding the trailer, which has been on the property for a long time.
