A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF BOYNTON BEACH, FLORIDA VACATING
AND ABANDONING A RIGHT-OF-WAY CONCEP~ING
PROPERTY HEREINAFTER DESCRIBED; RESERVING
AND EASEMENT FOR PUBLIC UTILITY PURPOSES
OVER, UNDER AND ACROSS SAID PARCEL~
AUTHORIZING THE MAYOR AND CITY CLERK
TO EXECUTE A DISCLAIMER FOR SAID RIGHT
OF WAY; PROVIDING AN EFFECTIVE DATE;
AND FOR OTHER PURPOSES~
WHEREAS, Bethesda Memorial Hospital, as owner of
certain property located within the City of Boynton Beach, Florida
has requested the abandonment of the hereinafter described right-
of-way.; and
WHEREAS, co~r~ments have been solicited from the
appropriate City Departments; and
WHEREAS, Public Hearings have been held before the
City's Planning and Zoning Board and City Council on the proposed
abandonment; and
WHEREAS, based on the foregoing information, said
right-of-way no longer serves any useful purpose; and
WHEREAS, it is necessary for the City to reserve an
easement over, under and across the subject parcel for public
utility purposes.
NOW, THEREFORE, BE AND IT IS HEREBY RESOLVED BY THE
CITY COUNCIL OF THE CITY OF BOYNTON BEACH, FLORIDA, that:
Section 1: The City of Boynton Beach, Florida, by
and through its City Council does hereby vacate and abandon for
right-of-way purposes a piece of real property located in the
City of Boynton Beach, Florida, to wit:
That part of Section 33~ Township 45
South, Range 43 East, Palm Beach County,
Florida, described as follows:
Begin at the northwest corner of Lot 5,
Pine Crest Ridge, according to the plat
thereof recorded in Plat Book 24 at
Page 153 of the Public Records of Palm
Beach County, Florida; thence south
(assumed), along the west line of
said Lot 5, 63.56 feet to a point
of curvature of a curve concave
easterly with a radius of 25.00
feet and a central angle of 56°
04'11"; thence southerly, along
~the arc of said curve, 2.4.46 feet;
thence S.56°04'00"E., along the
southwesterly line of Lots 6,7,8
and 9 of said plat of Pine Crest
Ridge, 432.65 feet to a point of
curvature of a curve concave north-
erly with a radius of 25.00 feet
and acentral angle of 90°00'00";
thence easterly along the arc of
said curve, 39.27 feet to the
westerly right of way line of Sea-
crest Boulevard; thence S.33°56'00"W,
along said westerly right of way
line, 100.00 feet to a point on a
curve concave westerly with a radius
of 25.00 feet, a central angle of
90~00'00'', and chord bearing N.11°
04'00"W.; thence northerly, along
the arc of said curve~ 39.27 feet;
thence N.56°04'00"W., along the
northeasterly line of Lots 1,2,3
and 4 of said plat of Pine Crest
Ridge, 412.32 feet to the west line
of said Lot 4; thence south, along
said west line, 12.87 feet; thence
N. 89°03'00"W., and parallel with
the north line of Lot 5 of said
plat of Pine Crest Ridge, 50.01 feet
to a line 50.00 feet west of and
parallel with the weSt line of said
Lots 4 and 5; thence north, along
said parallel line, 150.00 feet to
the intersection with the westerly
extension of the north line of said
Lot 5, thence S89°03'00"E., along
said westerly extension, 50.01 feet
to the said point of beginning.
(Being S.W. 26th Avenue and a portion
of S. W. 2nd Street). Containing
30,502 square feet, more or less.
Section 2: This vacation and abandonment of the
above-referenced right-of-way is expressly subject to the
reservation of' an easement over, under and across the subject
parcel for public utility purposes..
Section 3: The Mayor and City Clerk are hereby
authorized and directed to execute and deliver the attached
Disclaimer and cause the same to be filed in the Public Records
of Palm Beach County~ Florida.
Section 4:
immediately upon passage.
This Resolution shall take affect
1986.

State of Florida does hereby abandon and disclaim for right-
of-way purposes the following described property situate and
located in Palm Beach County, Florida, to wit:
