AN EMERGENCY ORDINANCE OF THE CITY OF
BOYNTON BEACH, FLORIDA, AMENDING SECTION
24-11 OF THE CODE OF ORDINANCES OF SAID CITY,
ESTABLISHING A MAXIMUM SIZE FOR BILLBOARDS
ERECTED WITHIN THE MUNICIPAL LIMITS OF THE
CITY OF BOYNTON BEACH; REPEALING ALL
ORDINANCES IN CONFLICT HEREWITH: PROVIDING
AUTHORITY TO CODIFY, AN EFFECTIVE DATE
AND FOR OTHER PURPOSES.
PREAMBLE.
This ordinance is deemed to be an emergency measure
enacted for the immediate preservation of the health, peace, property
and safely of the Inhabitanls of the CITY OF BOYNTON BEACH, FLORIDA,
and for the daily operation of the Building and Planning Departments of
said City.
SECTION 1. Section 24-11 of lhe Code of Ordinances of lhe
City of Boynton Beach, Florida, is hereby amended to read:
"Sec. 24-11. Billboards.- size; locations.
No Billboard exceeding the dimensions of 8 feet in height
and 12 feet in width shall be erected at any location within
said City.
No other Billboards shall be erected:
(1) Upon any property zoned and classified as within
a residential district.
(2) In any block in which a majority of the buildings on
either side of lhe slreet within such block are used for
residential, hotel or apartment purposes.
(3) Within two hundred feel of a public, private or
parochial school, church, park, playground or cemelery.
(4) Within one hundred feet of any residence, hotel
or apariment.
(5) Within twenty4five feet of the inside edge of any sidewalk.
(6) Wiihin lwent~five feet of the property line on streets
having no sidewalks.
(7) On any corner in such a manner as to obstruct the
field of vision of persons using the slreeis for a distance
of seven%y-five feel from the nearest corner."
SECTION 2: Separability. Each of the provisions of lhis
ordinance are separable, including word, clause, phrase, or senlence,
and if any provision hereof shall be deClared invalid by any courl of
competent jurisdiction, the remaining provisions shall not be affected but
shall remain in full force and effect.
SECTION 3: Repealing ProvisiOns. Ail ordinances or paris
of ordinances in conflict herewith are hereby repealed.
SECTION 4: Aulhoriiy to Codify. Specific aulhority is
hereby granted to codify this ordinance.
SECTION 5: Effective Date. This Ordinance is deemed lo be
an emergency measure and shall becOme effeclive immediately upon passage
