I. CALL TO ORDER
Hilary Zalman, Community Standards Special Magistrate, called the Hearings to order
at 9:06 a.m. and explained the Magistrate's role and the procedures. Pursuant to Chapter
162, Florida Statutes, all orders are appealable only to the Circuit Court in Palm Beach
County and not to the City Commission. Also, a fine will be imposed if the violation(s) are
not corrected by the deadline.

inspection date was May 30, 2023. This is not a repeat violator. An initial verbal notice

on September 25, 2023, and signed green card on October 19, 2023. Permit was applied
for on October 11, 2023, then disapproved with comments on October 28, 2023. To date,

had no drywall is a load-bearing wall and was already cited. The City recommends

October 2, 2023. The property owner installed a fence surrounding the pool without
obtaining the required permits. The property was last inspected November 14, 2023. This

Mr. Durgan said the fence has been there since he purchased it, and he repaired sections
of the fence after three different hurricanes. He said his neighbor's invasive tree is growing
into his property and he could not replace the section of the fence where the tree's roots
are growing. He said he put up a decorative wall. Ms. Zalman said he needs to get a
permit for any work.
Ms. Zalman recommended meeting with the Building Department regarding the fence,
tree, and permit.
Mr. Durgan reiterated the fence has been there for years. He said the County told him he
does not need a permit.
Supervisor Hart further explained that anytime the materials change, a permit is required.

Mr. Raz asked if he was an owner, on record, would it apply. Ms. Zalman said it would
not apply.
Mr. Ireland said Mr. Raz has always lived there. Ms. Zalman said if he becomes a co-
owner, he can notify the City and this case would be closed.

Mr. Aurus confirmed they planned to do the repairs. He asked for 90 days to complete
the work and complete the inspection. Officer Redondo had no objection.
Supervisor Hart explained to Mr. Aurus is it his responsibility to keep his address updated
in public record.

process.

be moved to March 14, 2024, due to the fact they know they will not be able to comply in
the amount of time given at the last extension. He confirmed the City has not objection.
Josh Buendia, Property Manager, was present. Ms. Zalman said no affidavit was received
so he cannot speak on the case.

Mr. Alexander-Burleigh said he spoke to the Building Department, and they said it was
fine and closed the permit. He said he will speak with the Building Department to resolve.
Director Stone said they have been going back and forth with Zoning. She noted there
was a zoning permit approved but the building permit was not approved. She stated the
Building Department spoke to Mr. Alexander-Burleigh about this.
Mr. Alexander-Burleigh said he did not know he needed a building permit.
Discussion ensued about the building permit. Ms. Zalman said there appears to be a
misunderstanding with the owner.
Officer Redondo reiterated this is a health and safety violation. Mr. Alexander-Burleigh
said he is eager to comply. Ms. Zalman asked what his intention is with the shed. Mr.
Alexander-Burleigh stated he will get it permitted. Officer Redondo explained the health
and safety concern.

on February 11, 2023. Mr. Souffrant examined the green card and stated it was not his
signature.
Ms. Zalman said the City recommends reducing the lien to $7,384, which is 15% plus the
administrative fees. She asked if there are tenants.
Mr. Souffrant said there is one tenant but they are moving out so he can move into the
property on January 23, 2024.
Ms. Zalman recommended $5,234.12.
Mr. Souffrant explained his family situation. He said he is living paycheck to paycheck.
Officer Hart stated they are steadfast in their position of$7,384.
