3 A RESOLUTION OF THE CITY OF BOYNTON BEACH,
4 FLORIDA, APPROVING AND AUTHORIZING THE CITY
5 MANAGER TO SIGN A MEMORANDUM OF UNDERSTANDING
6 TO AMEND THE OCTOBER 1,2023,THROUGH SEPTEMBER 30,
7 2026, WHITE COLLAR SEIU COLLECTIVE BARGAINING
8 AGREEMENT, BETWEEN THE CITY OF BOYNTON BEACH
9 AND SEIU FLORIDA PUBLIC SERVICES UNION, CTW, CLC
10 WHITE COLLAR UNIT REGARDING WAGES AND
11 CLASSIFICATIONS FOR THE COMMUNICATION DISPATCH
12 DIVISION OF THE POLICE DEPARTMENT; AND PROVIDING
13 AN EFFECTIVE DATE.

15 WHEREAS, on August 15, 2023, the City Commission ratified the collective
16 bargaining agreement for the City's SEIU White Collar employees; and
17 WHEREAS, the City and SEIU Public Services Union engaged in impact
18 bargaining relating to the wages and classifications for the Communication Dispatch
19 Division of the Police Department; and
20 WHEREAS, the City and the Union desire to memorialize their agreement to
21 include the Communications Operator positions in the White Collar bargaining unit and to
22 set forth their respective pay plans included in the Memorandum of Understanding; and
23 WHEREAS, the City Commission of the City of Boynton Beach deems it to be in
24 the best interests of the residents and citizens of the City to approve and authorize the City
25 Manager to sign a Memorandum of Understanding to amend the October 1, 2023, through
26 September 30, 2026, White Collar SEIU Collective Bargaining Agreement, between the
27 City of Boynton Beach and SEIU Florida Public Services Union, CTC, CLC White Collar
28 unit regarding wages and classifications for the Communication Dispatch Division of the
29 Police Department.
30 NOW,THEREFORE,BE IT RESOLVED BY THE CITY COMMISSION OF
31 THE CITY OF BOYNTON BEACH, FLORIDA,THAT:
32 Section 1. The foregoing "WHEREAS" clauses are true and correct and hereby
33 ratified and confirmed by the City Commission.
34 Section 2. The City Commission of the City of Boynton Beach, Florida, does
35 hereby approve and authorize the City Manager to sign a Memorandum of Understanding
36 to amend the October 1, 2023, through September 30, 2026, White Collar SEIU Collective

37 Bargaining Agreement between the City of Boynton Beach and SEIU Florida Public
38 Services Union, CTC, CLC White Collar unit regarding wages and classifications for the
39 Communication Dispatch Division of the Police Department. A copy of the Memorandum
40 of Understanding is attached hereto and incorporated herein by reference as Exhibit "A."
41 Section 3. This Resolution will become effective immediately upon passage.

MEMORANDUM OF UNDERSTANDING
by and between
SEIU FLORIDA PUBLIC SERVICES UNION, CTW, CLC— WHITE COLLAR UNIT
and the
CITY OF BOYNTON BEACH
WHEREAS, SEIU Florida Public Services Union, CTW, CLC (the "Union") is the certified bargaining
agent for a bargaining unit of white-collar employees of the uty of Boynton beach (the -City-) pursuant
to the State of Florida Public Employees Relations Commission Certification No. 1211;and
WHEREAS, the Union and the City are parties to a collective bargaining agreement covering the
period October 1, 2023,to September 30, 2026(the "CBA"),which sets forth the terms and conditions of
employment of the City's White Collar employees and which was ratified by the City Commission on
August 15, 2023; and
WHEREAS, the City currently maintains the following job classifications that are not covered by
any existing bargaining unit within the City:Communications Operator I,Communications Operator II,and
Communications Operator III;and
WHEREAS, the Union and City wish to include the foregoing job classifications in the Union's
white-collar bargaining unit;
WHEREAS,the Union and City have successfully negotiated pay plans for these classifications;and
WHEREAS,the City and the Union desire to memorialize their agreement to include the foregoing
positions in the white-collar bargaining unit and to set forth their respective pay plans.
NOW,THEREFORE, IT IS AGREED by and between the Union and the City as follows:

2. The Union and City agree to recognize the positions of Communications Operator I,
Communications Operator II, and Communications Operator III as part of the SEIU White
Collar Unit
3. The Union and City agree to amend Article 30 of the CBA to include the attached pay plan for
the positions of Communications Operator I, Communications Operator II, and
Communications Operator III as follows:
30.4 Year One: October 1, 2023 —September 30, 2024. There is no payment or advancement beyond
Step 1 for Communications Operator I, Step 2 for Communications Operator II, and Step 7 for

4. The provisions of this MOU will be retroactive to October 1st, 2023
5. Upon request of either party,the Union and the City agree to loorsaffithese provisions after
ci
ninety (90) days following ratification, and the Parties will maintain the status quo during
those negotiations.
6. This Agreement will become effective upon ratification by the Union and City Commission.
