R24-079 1 RESOLUTION NO. R24-079 2 3 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOYNTON 4 BEACH, FLORIDA, DECLARING AN APPROXIMATELY.012-ACRE PORTION 5 OF THE PROPERTY LOCATED AT 3501 S. CONGRESS AVENUE, BOYNTON 6 BEACH, TO BE SURPLUS, SELECTING THE METHOD OF DISPOSITION TO 7 BE TRANSFERRED TO PALM BEACH COUNTY, AND AUTHORIZING THE 8 MAYOR TO SIGN A WARRANTY DEED BETWEEN THE CITY OF BOYNTON 9 BEACH ("GRANTOR") AND PALM BEACH COUNTY ("GRANTEE") 10 CONVEYING TITLE TO THE RIGHT-OF-WAY CORNER CUP FOR THE 11 INTERSECTION IMPROVEMENTS AT CONGRESS AVENUE AND MINER 12 ROAD; AND PROVIDING AN EFFECTIVE DATE; AND FOR ALL OTHER 13 PURPOSES. 14 15 WHEREAS, Palm Beach County ("County") is doing an intersection improvement at 16 Congress Avenue and Miner Road, Project No. 2019112.The County requested the City convey 17 title to a .012-acre piece of a right-of-way corner clip adjacent to City Fire Station No. 3, located 18 at 3501 S. Congress Avenue; and 19 20 WHEREAS, Chapter 2, Article IV, Section 2-56 (c) of the City of Boynton Beach Code of 21 Ordinances authorizes the City Commission to dispose of real property that is determined to 22 be in the best interest of the City; and 23 24 WHEREAS, before any improved or unimproved property owned by the City can be 25 sold, the City Commission must first declare the property to be surplus; and 26 27 WHEREAS, the City Commission, upon recommendation of staff, declares an 28 approximately.012-acre portion of the property located at located at 3501 S.Congress Avenue, 29 as further described in "Exhibit A," to be surplus; and 30 31 WHEREAS,the Commission, upon recommendation of staff, has deemed it to be in the 32 best interests of the citizens and residents of the City to declare the property surplus and 33 approve and authorize the Mayor to sign a Warranty Deed between the City of Boynton Beach 34 ("Grantor") and County ("Grantee") for the right-of-way corner clip for the intersection 35 improvements at Congress Avenue and Miner Road within the City of Boynton Beach. 36 37 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF 38 BOYNTON BEACH, FLORIDA, THAT: 39 40 SECTION 1. The foregoing "Whereas" clauses are hereby ratified and confirmed as 41 being true and correct and are hereby made a specific part of this Resolution upon adoption. 42 43 SECTION 2. The City Commission of the City of Boynton Beach, Florida, does hereby 44 declare an approximately .012-acre portion of the City owned property located at 3501 S. 45 Congress Avenue, further described in "Exhibit A" as surplus, select the method of disposition 46 to be conveyance to the County, and approve the Warranty Deed between the City of Boynton 47 Beach ("Grantor") and Palm Beach County ("Grantee") for the right-of-way corner clip for the 48 intersection improvements at Congress Avenue and Miner Road within the City of Boynton 49 Beach. 50 51 SECTION 3. The City Commission hereby authorizes the Mayor to execute the 52 Warranty Deed, in form and substance similar to "Exhibit A," and any other documents 53 necessary to effectuate the transaction, subject to approval by the City Attorney's Office. 54 55 SECTION 4. Upon execution of the Warranty Deed by the City, the City Clerk shall 56 record the Deed in the Public Records of Palm Beach County. 57 58 SECTION 5.
