R24-105 RESOLUTION NO. R24-105 2 3 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOYNTON 4 BEACH,FLORIDA,APPROVING THE SECOND AMENDMENT TO TASK ORDER 5 NO. UT-2A-02 FOR ADDITIONAL ENVIRONMENTAL SERVICES FROM 6 JACOBS (FORMERLY CH2M HILL ENGINEERS) FOR THE GENERATOR 7 REPLACEMENT PROJECT AT THE EAST WATER TREATMENT,APPROVING A 8 PURCHASE ORDER INCREASE OF $47,612 FOR A NEW TOTAL PURCHASE 9 ORDER AMOUNT OF$173,508,AND AUTHORIZING TH E CITY MANAGERTO 10 EXECUTE A LIMITED TERM EXTENSION EXTENDING THE CONTRACT TIME 11 FOR COMPLETION OF THE TASK ORDER; AND PROVIDING AN EFFECTIVE 12 DATE; AND FOR ALL OTHER PURPOSES. 13 14 WHEREAS, pursuant to section 287.055, Florida Statutes, the Consultants' Competitive 15 Negotiation Act and the City's Procurement Code,the City of Boynton Beach solicited proposals 16 pursuant to RFQ No. 046-2821- 17/TP for professional consulting services from qualified 17 engineering firms for required City services; and 18 WHEREAS,the City Commission designated Jacobs(FormerlyCh2m Hill Engineers)as one 19 of several qualified consulting firmsto provide General Consulting servicesto the City and entered 20 into a General Consulting Services Agreement dated August 22, 2018; and 21 WHEREAS,on May 16, 2023,the City and the Consultant entered into a First Amendment 22 amending the General Consulting Services Agreement to remain consistent with Florida Statue, 23 as to the maximum contract values for study activity and construction costs for continuing 24 contracts,and also extending the General Consulting Services Agreement for an additional 180 25 days, through February 16,2024,or until the new solicitation is awarded, whichever is less; and 26 WHEREAS,the City issued Task Order#UT-2A-02 for Professional Services for Generator 27 Replacement at East Water Treatment Plant and issued Purchase Order#191014 on April 24, 2019 28 for an amount of$84,074 to Jacobs(Formerly Ch2m Hill Engineers),and issued a purchase order 29 change order increasing the purchase order by an amount of$41,822 on April 15,2022 for a new 30 total purchase order amount of $125,896; and 31 WHEREAS, as part of the East WTP Generator Replacement project, an area is being 32 repurposed where a former Florida Power and Light(FPL) transformer vault and an aboveground 33 diesel storage tank(AST) were located.The City engaged Nutting Environmental of Florida (NEF) 34 to conduct a soil assessment to determine whether soils had been impacted by diesel fuels 35 associated with the AST or polychlorinated biphenyls (PCBs) associated with the electrical 36 transformer formally at this location; and 37 WHEREAS,the NEF investigations concluded that there were no significant impacts on 38 soils associated with diesel from the AST; however, PCBs were detected in soils at levels regulated 39 under the Toxic Substances Control Act (TSCA) in 40 CFR Part 761 (PCB Clean-up and Disposal 40 Regulations)and atlevelsthatexceed the Florida Departmentof Environmental Regu lation(FDEP) 41 residential direct exposure Soil Cleanup Target Levels(SCTL)for PCBs,as specified in Chapter 62- 42 777 Florida Administrative Code (FAC); and 43 WHEREAS, based on the NEF report, the City has determined that the removal and 44 disposal of impacted soil delineated in the NEF report best serves the public interest.The City now 45 desires to move forward with developing an Impacted Soil Removal and Disposal work plan and 46 requested a scope of work from Jacobs (Formerly Ch2m Hill Engineers); and 47 WHEREAS,the City Commission, upon recommendation of staff, has deemed it to be in 48 the best interests of the citizens and residents of the City to approve the Second Amendment to 49 Task Order No. UT-2A-02 for additional Environmental Services from Jacobs(formerly CH2M Hill 50 Engineers)for the Generator Replacement project at the East Water Treatment Plant,approve a 51 purchase order change order increasing Purchase Order #191014 to a new total amount of 52 $173,508,and authorize the City Manager to execute a limited term extension extending the time 53 for completion of the Task Order through and including December 31, 2024. 54 NOW,THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF BOYNTON 55 BEACH, FLORIDA, THAT: 56 SECTION 1. The foregoing "Whereas" clauses are hereby ratified and confirmed as 57 being true and correct and are hereby made a specific part of this Resolution upon adoption. 58 SECTION 2. The City Commission of the City of Boynton Beach, Florida, does hereby 59 approve the Second Amendment to Task Order No. UT-2A-02 Professional Services for Generator 60 Replacement at East WTP for Environmental Management of Impacted Soils, between CH2M HILL 61 Engineers Inc,a subsidiary of Jacobs Engineering Group Inc.,and the City in form and substance 62 similar to that attached as "Exhibit A." 63 SECTION 3. The City Commission of the City of Boynton Beach, Florida, does hereby 64 approve a purchase order change order increasing Purchase Order#191014 by$47,612 to a new 65 total amount of $173,508. 66 SECTION 4. Lamb 105 i U' ORPOR : $ II �•1N� ZO ; ; Task Order No. UT-2A-02 Professional Services for Generator Replacement at East WTP, Amendment 2 Environmental Management of Impacted Soils Background The City of Boynton Beach (CITY) authorized CH2M HILL Engineers Inc, a subsidiary of Jacobs Engineering Group Inc. (CONSULTANT), to execute Task Order #UT-2A-02 to provide Professional Services for the Generator Replacement project at the East WTP (dated 04/24/2019). The original task order consisted of two tasks, covering Task 1 Design Criteria Package and Bidding Support and Task 2 Services during Final Design and Construction. An amendment was issued to this task order adding services for Task 3 Environmental Assessment, Determination and Compliance Findings for HUD- assisted Project (dated 04/15/2022). As part of the East WTP Generator Replacement project, an area is being repurposed where a former Florida Power and Light (FPL) transformer vault and an aboveground diesel storage tank (AST) were located. CITY engaged Nutting Environmental of Florida (NEF)to conduct a soil assessment to determine whether soils had been impacted by diesel fuels associated with the AST or with polychlorinated biphenyls (PCBs) associated with the electrical transformer formally at this location. NEF conducted an initial assessment in 2020 and a final assessment in 2023. The NEF investigations concluded that there were no significant impacts to soils associated with diesel from the AST. However, PCBs were detected in soils at levels regulated under the Toxic Substances Control Act (TSCA) in 40 CFR Part 761 (PCB Clean-up and Disposal Regulations) and at levels that exceed the Florida Department of Environmental Regulation (FDEP) residential direct exposure Soil Cleanup Target Levels (SCTL) for PCBs, as specified in Chapter 62-777 Florida Administrative Code (FAC). TSCA requirements are under EPA authority and are not delegated to the states. PCBs were used in electrical transformers manufactured and installed between 1929 and 1979 when PCB use was banned in new transformers. According to CITY's records, the transformer was present at the site since at least May 1975, based on the record drawings for the Phase II Expansion WTP Expansion completed by Russell and Axon (File No. 6858-15, Sheet 27 of 38). Based on CITY's records,the electrical transformer was removed in 2018 during the Ion Exchange project. Since the former transformer was in service sometime before 1975, it typically would have contained PCBs and would be a probable source of the PCB impacted soil. FPL has not confirmed spills at this location. If the original site transformer contained PCBs, the unit would likely have been replaced (or PCB oil replaced) sometime in the 1980s as a publicly reported five year $30 million program that replaced hundreds of PCB-containing transformers and capacitor with non-PCB containing units. Based in NEFs report, CITY has determined that removal and disposal of impacted soil delineated in the NEF reports best serves their interest. CITY now wants to move forward with developing an Impacted Soil Removal and Disposal work plan and requested a scope of work from CH2M HILL Engineers, Inc. (CONSULTANT). Scope of Services CONSULTANT will make the following amendments to the scope of work of Task Order#UT-2A-02: TASK 1 —DESIGN CRITERIA PACKAGE AND BIDDING SUPPORT No changes to this task. TASK 2 — SERVICES DURING FINAL DESIGN AND CONSTRUCTION No changes to this task. TASK 3— ENVIRONMENTAL ASSESSMENT, DETERMINATION AND COMPLIANCE FINDINGS FOR HUD-ASSISTED PROJECT No changes to this task. TASK 4— IMPACTED SOIL REMOVAL AND DISPOSAL WORK PLAN As part of this new task, CONSULTANT will provide professional services during the preparation of an impacted soils removal and disposal work plan: 4.1 Hold a kickoff meeting on MS-Teams or attended by in person for up to two team members at the East WTP to discuss the project execution plan including project schedule and approach. 4.2 Develop the work plan (scope of work (SOW))for the impacted soil removal and disposal project. This SOW will include a narrative of the work to be performed and draft drawings, photographs, or as needed plan and profile of the PCB impacted soils area to be removed. In addition, the SOW will define project requirements including mobilization, excavation, impacted soil transport and disposal, site restoration, permitting or other regulatory requirements, specifications, as-needed survey, confirmation sampling requirements, laboratory analysis, documentation, sample results, record drawings, Health and Safety, and QA/QC.A MS-Teams call or in person meeting attended by up to two team members will be held with CITY to review the draft. 4.3 Confirm the approach for removing PCB remediation waste (i.e., PCB impacted soil) in accordance with TSCA under 40 CFR Part 761.61(b)(1) Performance-based cleanup of PCB remediation waste (PCB Clean-up and Disposal Regulations). 4.4 Confirm the type of PCB remediation waste present at the site as defined in TSCA (40 CFR 761.3). Assuming that the transformer is the source of PCBs at this site, specifically confirm: - Whether the PCBs in soil were released/disposed of prior to April 18, 1978 and are currently at concentrations ?50 ppm PCBs; or - Whether the PCBs in soil were released/disposed after 1978 and are currently at concentrations >_1 ppm PCBs. 4.5 Establish minimal qualifications for the soil removal and disposal contractor. 4.6 Assist CITY with finalizing the SOW and preparing the work plan documents for the contractor, participate in the pre-mobilization meeting attended by up to two team members and provide responses to technical questions for up to two addenda to answer any technical questions or address any changes or clarification required to the work plan documents. 4.7 Review and finalize the work plan documents. Deliverables: • Meeting agendas and summaries (electronic) • Draft and final ready for construction work plan document(electronic) • Technical information SOW for work plan addenda (electronic) TASK 5— IMPACTED SOIL REMOVAL AND DISPOSAL SERVICES DURING CONSTRUCTION As part of this task, CONSULTANT will provide professional and Owner Rep. services during the implementation of the SOW for the impacted soil removal project: 5.1 Observe all on-site soil removal activity, soil testing and site restoration by one team member. Results will be documented in observation/witness sheets and made available to CITY. 5.2 Verify soil removal contractor provides required documentation, including lab results, surveys, proof of excavated soil (volume or weight), waste manifests, and landfill certificates of disposal and other waste shipping and disposal documents (e.g., weight tickets, etc.). 5.3 Prepare a Project Completion Report for the CITYs records and (if needed) regulatory submittal. This report will contain a brief summary of the field activities along with project documentation. Deliverables: • Project Completion Report, implementation observations and documentation(electronic) Assumptions The following key assumptions were made in the compilation of this scope of work and the estimation of the level of effort: 1. CONSULTANT will prepare a plan and profile, or alternatively will prepare or supplement existing drawing with a performance description of work pan implementation. 2. The existing studies and record are available from CITY in organized folders and are in Adobe Acrobat format. Also, any information the CITY requests and receives on the former transformer from FPL will be provided in a timely manner. The CITY will address any FDEP notification requirements, as applicable. 3. Project completed in accordance with TSCA under 40 CFR Part 76.61(b)(1) Performance-based cleanup of PCB remediation waste or 40 CFR Part 76.61(b)(3) Performance-based disposal (PCB Clean-up and Disposal Regulations). 4. CITY will confirm the type of PCB remediation waste present at the site, based on available records and knowledge of past operations. 5. The soil removal and disposal contractor will be procured by CITY or by its design-builder and meet the minimal qualifications established in the SOW. 6. The soil removal and disposal contractor will prepare record drawings and only require one re- submittal. The soil removal and disposal contractor will perform any construction related testing, including PCB testing and soil compaction testing, witnessed by CITY and CONSULTANT. 7. The number of reviews of work plan addenda, final design drawings, shop-drawings and RFIs, are based on CONSULTANT's experience with similar work. If, for whatever reason, actual numbers deviate from proposed numbers proposed, CONSULTANT may request an amendment to this task order to account for the difference in the level of effort. 8. The CITY will provide timely review and approval of draft and final documents. 9. Any permits required for the project will be obtained by CITY, by its design-builder or directly by the soil removal and disposal contractor. Compensation CONSULTANT proposes to perform the work described herein on a lump sum basis based on the Fee Table of the contract. The total engineering fee including labor and expenses associated with the task order is $47,612.00, as shown in the table below. CONSULTANT will provide CITY a monthly invoice for the services provided based upon the schedule values detailed in the compensation table above, along with a summary of activities performed under this contract. An estimated earned value (percent complete)for each project sub-task will be the basis for progress payments.
