3 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOYNTON
4 BEACH, FLORIDA, APPROVING TERMINATION OF AN INTERLOCAL
5 AGREEMENT BETWEEN THE CITY OF BOYNTON BEACH AND THE CITIES OF
6 BOCA RATON AND DELRAY BEACH FOR THE OPERATION OF A BIOLOGY
7 PROCESSING LABORATORY TO PREPROCESS DNA SAMPLES PURSUANT TO
8 CRIMINAL INVESTIGATIONS; PROVIDING AN EFFECTIVE DATE; AND FOR
9 ALL OTHER PURPOSES.

11 WHEREAS, the City of Boynton Beach entered into an Interlocal Agreement with the City
12 of Boca Raton and the City of Delray Beach, dated September 4, 2020, for a Biology Processing
13 Laboratory used to process DNA Samples pursuant to criminal investigations, approved by
14 Resolution No. R20-069; and
15 WHEREAS, Section 8.3 of the Interlocal Agreement allows the City of Boynton Beach to
16 terminate participation in the Interlocal Agreement for any reason upon one hundred eighty(180)
17 days written notice to the other parties; and
18 WHEREAS, the City's Police Department desires to terminate the Interlocal Agreement
19 due to an unbudgeted increase in cost of $70,000; and
20 WHEREAS, the City Commission, upon recommendation of staff, has deemed it to be in
21 the best interests of the citizens and residents of the City to approve the termination of an
22 Interlocal Agreement between the City of Boynton Beach and the Cities of Boca Raton and Delray
23 Beach for the operation of a biology processing laboratory to preprocess DNA samples pursuant
24 to Criminal Investigations.

26 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF BOYNTON
27 BEACH, FLORIDA, THAT:
28 SECTION 1. The foregoing "Whereas" clauses are hereby ratified and confirmed as
29 being true and correct and are hereby made a specific part of this Resolution upon adoption.
30 SECTION 2. The City Commission of the City of Boynton Beach, Florida, does hereby
31 approve the termination of an Interlocal Agreement between the City of Boynton Beach and the
32 Cities of Boca Raton and Delray Beach for the operation of a biology processing laboratory to
33 preprocess DNA samples pursuant to Criminal Investigations.
34 SECTION 3. The City's Police Department shall provide one hundred eighty (180) days
35 written notice to the City of Delray Beach and the City of Boca Raton, and such notice must be
36 reviewed by the City Attorney's office prior to sending to the parties.
37 SECTION 4. The City Commission of the City of Boynton Beach, Florida, hereby
38 authorizes the City Manager to execute the written notice and such other related documents as
39 may be necessary to accomplish the purpose of this Resolution.
40 SECTION 5. This Resolution shall take effect in accordance with law.
