R24-119 1 RESOLUTION NO. R24-119 2 3 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOYNTON 4 BEACH, FLORIDA, AUTHORIZING THE CITY MANAGER TO EXECUTE 5 AGREEMENTS, WITH FEDERAL, STATE, AND OTHER LOCAL LAW 6 ENFORCEMENT AGENCIES AS NEEDED OR REQUIRED UPON REQUEST OF 7 THE CHIEF OF POLICE FOR COMBINED OPERATION ASSISTANCE AND R VOLUNTARY COOPERATION; PROVIDING AN EFFECTIVE DATE; AND FOR 9 ALL OTHER PURPOSES. 10 11 WHEREAS, from time to time, the City enters into agreements with Federal, State, and 12 local law enforcement agencies, such as the Federal Bureau of Investigation, the Palm Beach 13 County Sheriffs' Office, the Fifteenth Judicial Circuit State Attorney, and the United States 14 Department of Justice Drug Enforcement Administration, which provide for cooperation and 15 combined operation assistance between the agencies and the City of Boynton Beach Police 16 Department; and 17 WHEREAS, the purpose of these agreements is to delineate the responsibilities of each 18 agency and formalize the relationships between the participating agencies; and 19 WHEREAS, in addition to operation assistance and voluntary cooperation agreements, the 20 City also executes user agreements to access intra-agency information and data-sharing networks, 21 generally known as Criminal Justice Information (CJI) systems operated and regulated by the 22 Florida Department of Law Enforcement; and 23 WHEREAS, some of the cooperative agreements are often sensitive in nature as they 24 involve criminal intelligence information and are exempt under state law from public disclosure; 25 and 26 WHEREAS, the City Commission, upon recommendation of staff, has deemed it to be in 27 the best interests of the citizens and residents of the City to authorize the City Manager, upon the 28 request of the Chief of Police, to execute agreements with Federal, State, and local enforcement 29 agencies for combined operational assistance, voluntary cooperation and access, and use of intra- 30 agency information and networks, provided that such agreements have been approved by the 31 Chief of Police and the City Attorney's Office. 32 33 34 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF BOYNTON 35 BEACH, FLORIDA, THAT: 36 SECTION 1. The foregoing "Whereas" clauses are hereby ratified and confirmed as 37 being true and correct and are hereby made a specific part of this Resolution upon adoption. 38 SECTION 2. The City Commission of the City of Boynton Beach, Florida, does hereby 39 authorize the City Manager, upon the request of the Chief of Police, to execute agreements with 40 federal, state and local enforcement agencies for combined operational assistance, voluntary 41 cooperation and access and use of intra-agency information and networks, provided that such 42 agreements have been approved by the Chief of Police and the City Attorney's Office. 43 SECTION 3.
