AN ORDINANCE OF THE CITY OF BOYNTON BEACH, FLORIDA,
AMENDING SECTION 1348 OF THE CODE OF ORDINANCES
OF SAID CITY CLARIFYING THE PROCEDURE FOR MAIN-
TAINING SANITARY CONDITIONS ON PROPERTY LOCATED
T/I~Ei~N; PROVIDING AN EFFECTIVE DATE AND FOR
OTHER PURPOSES.
PREAMBLE.
This Ordinance is deemed to be an emergency ordinance providing
for the immediate preservation of the public peace, property, health and
safety of the i~ah ab it ant s of the CITY OF BOYNTON BEACH, FLORIDA,
by establishing requirements for the maintenance of sanitary conditions
and abating fire hazards and other health dangers within the municipal limits
of said city.
BE IT ORDAINED by the City Council of the City of Boynton Beach,
Florida:
SECTION 1.
That Section 13-18 of the Code of Ordinances of the
City of Boynton Beach;~:~ Florida, is hereby amended
to read:
SECTION 13-18. Lands to be kept free from weeds, trash and filth.
Ail lands in the city shall be kept free from weeds of a
height exceeding eighteen inches. The word "Weeds" as used herein st
be held to include all rank vegetation, growth which exhale obnoxious
or unpleasant odors or which might be a source of disease or physical
distress to human beings, or constitute a fire or other health hazard,
and the word shall also be deemed to include all high and rank
vegetation that might conceal pools of water, trash, filth or other
deposits which may be detrimental to health or harbor snakes, vermin
or other forms of wild animal life. The existence of any such
weeds or growth is hereby declared a nuisance.
Ail lands in the city shall be kept free from any kind
of trash or filth, including specifically~ but without limitation,
any broken tree limbs, leaves or branches, any uncontained
garbage or refuse or any other type of material which might
conceal pools of water, create breeding ground for mosquitos
or which m~ght otherwise be detrimental to the health and
safety of the inhabitants of the city. The existence of any
such trash or filth is hereby declared to be a nuisance.
SECTION 2. Separability; Each of the provisions of this
ordinance are separable, including word, phrase, clause or sentence, and
if any provision hereof shall be declared invalid by a court of competent
jurisdiction~ the remaining provisions hereof shall not~b~raffe~ted but shall
remain in full force and effect.
SECTION 3. Repealing Provisions: All ordinances or parts of
ordinances in conflict herewith are hereby repealed.
SECTION 4. Effective datE; This ordinance is deemed to be an
emergency ordinance and shall take effect immediately upon passage.
