AN EMERGENCY ORDINANCE OF THE CITY OF BOYNTON
BEACH, FLORIDA, PROVIDING FOR THE DISBURSEMENT OF
RIOTOUS ASSEMBLY; PROVIDING FOR PENALTIES AND FOR
OTHER PURPOSES.
PREAMBLE.
This ordinance is deemed to be an emergency ordinance enacted
under the police power of the City of Boynton Beach, Florida, for the
immediate preservation of the public peace, l~.r:~perty, health and safety
of the inhabitants and citizens of the said City, by providing for the dis-
bursement of any riotous assembly.
SECTION 1. If any ~mumber of p~r:s.:~m% whether armed or not,
are unlawfully, riotously or tumultuously assembled within the territorial
limits of the CITY OF BOYNTON BEACH, FLORIDA, or at any park or other
public property owned by the said City without its municipal territorial
limits, the mayor, any councilman, city manager, or chief of police is
hereby authorized to go among the persons so assembled, or as near to
them as may be with safety, and shall in the name of said City command
all the persons so assembled immediately and peaceably to disbu~e; and
if such persons do not thereupon immediately and peaceably disburse, the
said officers shall command the assistance of all available persons in
seizing, arresting and securing such persons in custody; and if any
persons present being so commanded to aid and assist in seizing and securin
such rioter or persons so unlawfully assembled, or in suppressing such
riot or such unlawful assembly, refuse or neglect to obey such commantt,
or, when required by such officer to depart from the place, refuses and
neglects to do so, he shall be deemed one of the rioters or one of the person~,
unlawfully assembled and may be prosecuted and punished accordingly.
If any such riotens assembly should occur at a public park
or other public facility either within or without the municipal limits
of the City of Boynton Beach, Florida, any or all of the above named
authorized personnelti~ hereby further empowered
to immediately close subject operation to 'the public
if~in his or their discretion~such action is necessary to
immediately protect the general public,
Section 2. Penalty Any person or persons unlawfully participating
in any riotous assembly as hereinabove described shall be deemed guilty
of violating this ordinance and shall be punished by fine of not more than
$500. 00 or imprisoned in the city jail for not more than sixty days~or both.

the remaining provisions shall not be affected but shall remain in full force

Section 4. Repealing Provisions. All ordinances or parts of
ordinances in conflict herewith are hereby repealed.
Section 5. Effective date. This ordinance is deemed to be an
emergency ordinance and shall take effect immediately upon passage.
