O61-03ORDINANCE No. 61-3 AN EMERGENCY ORDINANCE OF THE CITY OF BOYNTON BEACH, FLORIDA, CREATING A ~,I~JNICIPAL PLAN- NI :I~.: PROVII)ING FOR THE APPOINT~NT AND TERMS, OF OFFICE OF THE MEMBERS THEREOF; DEFII~ING THE POWERS AND DUTIES OF SAID BOARD; REPEALING ALL ORI~INANCES IN CONFLICT THEREWITH; PROVIDING AN EFFECTIVE DATE THEREFOR. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BOYNTON BEACH, FLORIDA, AS FOLLOWS: The following emergency ordinance is hereby enacted under the provisions of and pursuant io the police po~zers vested in the CITY OF BOYNTON BEACH, FLORIDA, for the purpose of .immediately protecting .the peace, property, health, safety and-welfare of the citizens of said municipality for the purpose of implementing a master plan .for said City and preserving orderly development of the community. SECTION 1. CREATION OF M~CNICIPAL PLANNING BOARD. That in order to guide and accomplish a coordinated, adjusted, and harmonious development of municipality andits environs which will, in accordance with present and future needs, best promote health, safety, morals, order, convenience, prosperity, and general welfare, as well as efficiency and economy in the process of development; including among other things, adequate: provision for traffic, the promotion of safety from fire and other danmgers, adequate provision for light and air, the promolion of healthful and convenient distribution of population, the promotion of good civic design and arrangement, wise and efficient expenditures of public funds, there is hereby created and established the Boynton Beach Planning Board, hereinafter referred to as the Planning Board, and said Board shall be organized and empowered as hereinafter set forth. SE CTION 2. MEMBERSHIP. The Planning Board shall consist of seven members, who shall be residents of the City of Boynton Beach, Florida, and appointed by the City Council of the City. The terms of the initial members appointed to the first Planning Board shall expire on the ~te of the first meeting of the City Council in January of 1962. The terms of th~ee.~.~3~ members appointed to the Planning Board in January of 1962 shall be for one year ar, d the term of the remaining four members shall be for two years. The terms of all members appointed.thereafter shall be for 1two years. Each member appointed to this Board. shall be ~Iiig~ie for reappointment. Any vacancy in membership shall be filled for the unexpired term by the City Council who shall have the authority to remove any member for cause, upon written charges, after a public hearing. Ail members shall serve without compen- sation, but may be reimbursed for actual expenses incurred in connection wiih their official duties, upon being approved by the City Council. The Mayor and the City Manager shall be ex officio members of the Planning Board. and shall receive no compensation for their work .on the Planning Board other than .the fixed salary of lheir office. SECTION 3. QUORUM. Four members of ihe Planning: Board shall constitute a quorum for %he transaction of business providing, however, that no action shall be taken which is binding 'upon said Planning Board unless concurred inl~ less than a majority of all members comprising the Planning Board, SECTION 4. ORGANIZATION, RULES, STAFF' AND FINANCES. The Planning Board. shall elect its Chairman from among, its members. The term of the Chairman shall be one year with eligibility for re-election. The Planning Board shall appoint a Secreiary, who may be an officer or employee of the municipality° The Planning Board shall make its own rules of procedure and determine its time of meeting. Ail meetings of the Planning Board at which official action is taken shall be open to the public and all records of the Planning Board shall be a public record. SECTION 5. POWERS AND DUTIES. From and after the time when the Planning Board shall have organized and selected its officers and shall have ado:pied its rules of pro- cedure, Ihen said Planning Board shall have all the p,owers, dulies and re- sponsibilities set forth herein. SECTION 6. COMPREHENSIVE PLAN. The-~lanning Board shall have the power and the duty'to prepare and recommend ~o the City Council for adoption of a Comprehensi~re Plan1 for ihe physical development of the CITY OF BOYNTON BEACH and to perfect it from time: to time. In conducting its work the Pla~uing Board may conside~ and investigate any subjecl matter.tending to the development and bettermeni of the municipality and may make recommendations' as it may deem advisable concerning the adoption thereof to the City Council. Such Comprehensive Plan may show, among other things: exisiing and proposed streets, highways, expressways, bridges, tunnels and viaducts and approaches lhereto; routes of railroads and transit lines; terminals, ports and airports; parks, playgrounds for'es%s, reservations, and other public open space's~ sites for public buildings and structures; districts for residence, business, industry, recreation, agri- culture and forestry; special districts for other purposes; limited de~elopmenl districts for purposes of conservation; v~ater supply, sanitation, drainage., protection againSt floods, and the like; areas, for housing deveicrpments, slum clearange, urban renewal and redevelopment; location of public utilities whether publiCl~or p~ivately owned, including but not limited to sewerage ar, d waier supply systems; together with time and priority schedules and cost estimates for' the accomplishment of the proposals. The Comprehensive Plan shall be k~ased upon. and include appropriate studies of the location and exteni of present and anticipated.use of land, population, social and economic resources and pro-btems, and other useful data. The Comprehensive Plan shall be a public record, but its purpose mud effecl shall be solely to. aid the Planning Board .in the performance of its duties. SECTION 7. Zoning. The Planning Board shall act as the Zoning Commission for the CITY OF BOYNTON BEACH as provided for in Municipal Zoning, Chapter 176, Florida Statutes, and shall have all the powers, duties and responsibilities set forth therein. -2- SECTION 8. SUBDIVISION OF LAND. The Planning Board shall pre:pare and recom~endio the City Council for adoption rules and regulations governing the approval Of maps and plats of ihe subdivision of land within the corporaie limits of the CITY OF BOYNTON BEACH in. accordance wiih the requirement of Maps and. Plats, Flo-rida Statutes, Chapter 177. SECTION 9. SEPARABILITY. Each of the provisions of this or--ce are separable, .including word, clause, phrase or sentemnce, andif any provisions hereof shall be declared null and void, the remainipgportion shall noi be affected but shall remain infulI force and effect. SECTION 10. REPEALING PROVISIONS. All ordnances, or parts of ordinances in conflici herewith .are hereby repealed. This measure is determined to be an emergency for the immediate preservation of the public peace, property,, health, safety and welfare o£ the citizens of the CITY OF BOYNTON BEACH, FLORIDA, and shall become effective immediately upon passage.
