AN ORDINANCE OF THE CITY OF BOYNTON BEACH, FLORIDA,
DESIGNATING SAID CITY AS A BIRD SANCTUARY:~ ESTABLISH~
ING REGULATIONS TO PROTECT BIRDS AND WILD FOWL;
AND. PRESCRIBING PENALTIES.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CiTY OF BOYNTON
FLORIDA, AS FOLLOWS:
SECTION 1: That the entire area embraced within the corporate
]iraiis of the City' of BOYnton Beach, Florida, be and lke same is hereby
designated as a Bird Sancluary.
SECTION 2: That it shall be unlawful for any person to lrap, hunt,
shoot or attempt to trap, hunt, shoot or' m~les! any bird or wild fowl in any
manner or to rob bird nests or wild fowl nests; except, provided, however,
if starlings or~.similar birds are found to be congregated in such numbers
in any particular locality within said City lo the extent that complaint is made
to the City Manager. thai such birds constitute a nuisance or menace to health
or properly, +Jhen in such case a meeting shall be called by the City ~nager
of representatives of ihe Audubon Society, Bird Club, Garden Club, Humane
Society, or as ma~uy of said clubs as are fo~and to exisl in said City, after
having given al least three days actual notice of the Iime and place of said
meeting. Thereupon, if as a result of said meeling, no acceptable a~iernate
is found to abate such nuisance, then such .birds may be destroyed in such
numbers and in such manner as is deemed advisable by the City Manager under
the-supervision of the Chief of Police of said City or such other officer as
may be designaled by the said Chief of Police.
SECTION 3: Any person who shall violate any of the provisions of
~his ordinance sh~ll be deemed ?uil!y of a misdemeanor, and upon conviction
thereof shall be punished by a fine of not more than $100. 00 or imprisonment nc
exceeding 30 days.
