BEACHt. FLORIDA, PERTAINING. TO USED CAR LOTS,
REPEALING ALL ORDINANCES IN~ CONFLICT HEP~fITHo
BE IT ORDAIh~D BY THE CITY coUNcIL OF¥~ CITY OF BOYNTON BEACHt
FLORIDA, AS FOLLOWS:
The following emergency ordinance is hereby enacted
under the provisions of and pursuant to the Police power vested
in the City of Boynton Beach, Florida, for the purpose of imme-
diately protecting the peace, property, health, safety and welfare
of the citizens of said municipality and for preserving the orderl'
development of the community.
Section 1. Definitions: ~ "Used Car Lot".
For the purposes of this ordinance, a used car lot shall be
considered to be any business locaiion within the municipal
limits of the City of Boynton Beach, Florida, engaged in the

wholesale or reta_~ sale of second hand or used automobiles,
used
or other type of/motor vehicles and other services normally
attendant to such business.
Section ~., Approval of Licenses: Prior to the
issuance of any occupational license authorizing the operation of
a used car lot within the City of Boynton Beach, Florida, such
license must be approved by the City Council. In addition to the
other requirements set forth in this ordinance and other existing
ordinances of the City of Boynton Beach, Florida, pertaining to
the installation o~ operation of a used car lot, if, after due
consideration, of any license application for the operation of
any such business it is the judgment of the City Council that the
issuance of such license shall result in increasinq or creating
fire, traffic or other dangerous hazards, endangering children or
the general public, the emission of offensive noise or noxious
odors, or otherwise constitute an objectionable nuisance, adversel
affect property values, or otherwise be detrimental to the health,
safety and general welfare of the community, and in the absence
of counterbalancing public demand for the issuance of such 1

ance shall be applicable irregardless of the zoning classificatio]
of the property location connected with any such license app!ica-
tion contemplated herein.
In addition, the City Council reserves the right
in connection with tlhe approval and issnance of any such license,
to impose reasonable restrictions or requirements upon the opera-
tion of such business relative installation of sanitary and
facilities, paving and lighting installation and reasonable hours
and times of business operation.
Section 3. Separability_.' Each of the provisions
of this Ordinance are separable, including word, clause, phrase
or sentence, and if any provision hereof shall be declared null
and void, the remaining portion shall not be affected but shall
remain in full force and effect.
Section 4. Repea~ Provisions: All ordinances or
parts of ordinances in conflict herewith are hereby repealed.
This measure is determined to be an emergency
enacted for the i~ediate preservation of the public peace, pro-
perry, health, safety and welfare of the citizens of the CITY OF
BOYNTON BEACH, FLORIDA, and shall become effective immediately
upon passage
