AN E}~£RGENCY ORDINANCE OF THE CITY OF
BOYNTON BEACH, FLORIDA, SUPPLEMENTING
AND AMENDING CPL~PTER 11 OF THE CODE~..OF
ORDINANCES~OF ~i2 CITY OF BOYNTON ~ACH,
FLORIDA. PERTAINING TO.~FILLING~ STATiONS,~
REPEALING ALL ORDINANCES IN CONFLICT HEREWITH.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BOYNTON BEACH,
FLORIDA, AS FOLLOWS:
The following emergency ordinance is hereby enacted
under the provisions of and pursuant to the Police power vested
in the CITY OF BOYNTON BEACH, FLORIDA, for the purpose of imme-
diately protecting the peace, property, health, safety and wel-
fare of the citizens of said municipality and for preserving the
orderly development of the community.
Section 1. Chapter 11 of the Code of Ordinemces
of the CITY OF BOYNTOy ~ACI%, FLORIDA, is hereby supplemented and
amended as follows:
"Sec. l_l-3. Additional Requirements: In addition
to the other requirements set forth in this Chapter, prior
to the issuance of a permit for the construction, installation
or operation of any new filling station, or the expansion of
any existing filling station within the municipal limits
of the CITY OF BOYNTON BEACH, FLORIDA, such permit must be
approved by the City Council. If, after due deliberation,
it is the judgment of the City Council that the construction,
installation, operation or expansion of any such filling
station described he re inabove would increase or create fire,
traffic, or other dangerous hazards, endangering children or
the geaeral public, emit offensive noise or noxious odors, or
otherwise constitute an objectionable nuisance, adversely
affect property values or otherwise be detrimental to the
health, safety and general welfare of the community, and in
the absence of counterbalancing public- demand for another
service station in the vicinity in quest_on, the Council
may deny any such permit.
The requirements set forth in this Section of the Ordinance
shall be applicable irregardless of the zoning classifica-
tion of the property location connected with any filling
station permit application contemplated herein."
SECTION 2. SEP~ILITY: Each of the provisions
of this Ordinance are separable, including word, clause, phrase
or sentence, and if any provision hereof shall be declared null
and void, the remaining portion shall not be affected but shall
remain in full force and effect.
sEcTIoN 3, REPEA~ING~ ' T PROVISIONS: All ordinances,
or parts of ordinances in conflict herewith are hereby repealed.
This measure is determined to be an Emergency
Ordinance enacted for the immediate preservation of the public
peace, property, health, safety and welfare of the citizens of
the CITY OF BOYNTON BEACH, FLORIDA, e_nd shall become effective
immediately upon passage.
