An Ordinance of the City of Boynton Beach, lo~mda, provld!ng for the appointment of a Czty ~anager and designating the duties, responsibilities and powers of said office, and for other purposes. BE IT ORDAINED by the City Ceunci! of the City of Boynton Beach lorlaa, as follows: Pursuant to the provisions of Section 49 of the Charter of the City of Boynton Beach, Florida, Chapter 24398 Special Act of the 1947 Florida Legislature, providing for the appointment of a City Manager, the following Ordinance is hereby enacted and adopted: SECTION 1. APPOINTMENT. QUALIFICATIONS. ~ The City Council shall appoint a City Nanager who shall be the Chief Executive Officer and the Administratfive head of the Nunicipal Government under the direction and supervision of the City Council and who shall held office at the pleasure of the City Council. He shall be chosen solely on the basis of his execu- tive and administrative qualifications, without regard to his political belief or persuasion. It shall not be necessary that the City Nanager be a resident of the City at the time of his appointment, however during his tenure o£ office he shall reside within the City. No member of the City Council shall be eligibl~ for appointment to the office of City Nanager within two years of the expiration of his last term of office. SECTION 2. ABSENCE OF THE CITY~4ANAGER. To perfo~ his duties during hi~ temporary absence or disability~ the City ~anager~may designate by letter filed with the City Clerk~ a qualified administrative officer of the City. In the event of the~fai~re of the City Nanager to make such'designation, the City Council may by resolution appoint an officer of the City or other qualified person to perform the duties of the City Nanager until he shall return, or his disability shall cease. SECTION ~. CO~PENSATION. The City Nanager shall receive a compensation for his services, to be fixed by the City Council. ~CTION ~. RENOYAL AND SUSPENSION. The City Nanager ma) be removed or suspended by a majority vote of the City Council adoptihg such action. SECTION $. ATIENDANCE AT CO~UNCIL ~ETINGS The City Nanager shall be entitled to a seat on the Council and shall have the right to take part in the discussions on all matters coming before the Council relative the administrativefunctions' of the municipality but shall have no vote therein, SECTION 8. POWERS ANDDUTIES. The City Nanager shall be responsible to the City Council for the proper administration of the affairs of the City and to that end, subject to the personn~ and other provisions of the City Charter, he shall have the power and shall be required to: (a) See that the laws and ordinances are enforced; (b) Appoint and when necessary for the good of the City, remove all officers and employees of the City, except the City Attorney and Nunicipal Judge, and except as otherwise provided' ~ ~?~ the City charter, and existingOrd~nances~ of the City, and except as he may authorize the head of a department or office to appoint and remove subordinates in such department or office; (c) Fix the salary of officers and employees in the un-- classified service, except as otherwise provided in the City Charte (d) Endorse on all contracts, bonds and other instrum~ in writing in which the ~{unicipality is interested, his approval authorized to ~n a±± checks a~d vouqher$ o t e Ci . ~ (e) Prepare tSe budget annually an~ suomi~ ~ to ~e Clty Council, and be responsible for its administration after adoption. (f) Arrange for the preparation of and submit to the City Council, as of the end of the fizcal year, a report on the financi and administrative ac ~v~t~es of the City for the preceding year; (g) Keep the City Council advised of the lnanclal condition and future needs of the City, smd make such recommenda- tions as may seem to him desirable; (h) Recommend to the City C ouncll after approval by the civil s ervlc.e board, the salary and wage scale proposed to be paid for the ensuing year, noting thereon any proposed cha~ges recommended; (i) Perform such other duties as may be prescribed the City Charter or required of him by the City Council, not onslstent herewith. SECTION 7. BON__~D. Upon appointment of a person to the office of City Nanager and during his tenure of office, the City shall, at its expense, procure and maintain a proper fidelity andJor in- demnity bond in the' minimum amount of $5,000.00 covering any perso] so appointed to the said office of City Nanager in connection with the exercise and xecut~on of the duties of said office. e SECTION 8. SEPARABILITY. Should any part or parts of this Ordinance be declared unconstitutional or void by a Court of competent jurisdiction, the r ' ematn~ng parts shall remain in full force and effect. · ___~CTION 9.
