O60-04mO. 60-'4.- AN ORDINANCE OF~..~L~IE CITY OF BOYNTON BEACH~ FLORIDA, SUPPI~NENTiNG AND ~3~ENDING CHAPTER ~ OF THE CODE ~OF ORDINANCES OF T~r~' CITY OF BOYNTON BEACH~ FLORIDA~ PROVIDING FOR ~ LICENSING OF ALL DOGS WITHIN THE CORPORATE LIMITS OF THE CITY OF BOYNTON BEACH, FLORIDA: PROHIBITING TBE DOGS~ PRO~ RUNNING AT LAR~ ~ffiTHIN THE CORPORATE LIgnITE OF SAID CITY: AUTHORIZATION OF IMPOUNDING AND DESTRUCTION OF DOGS: PROVIDING A PENALTY: AND REPEALING ALL ORDINANCES IN CONFLICT BE IT ORDEINED by the City Council of the City of Boynton Beach, Florida, as follows: The following Ordinance is hereby enacted under the pro- visions of and pursuant to the police power vested in the City of Boynton Beach, Florida, for the purpose of preserving and protect. ing the morals, health, Safety and welfare of the citizens of sale municipality. SECTION 1. DEFINITION OF ~ERNS:. As used in this Ordin- anco, unless the context otherwise indicates: (a) "Dog" shall be intended to mean both male and female (b) "Owner" shall be intended to mean any person or persons, firm, association or corporation owning, keeping, or harboring a dog. (c) "At large" shall be intended to mean off the premises of the owner, and not under the control of the owner or a member of his immediate family either by leash, 9ord, chain or othe~..~'~' *'~'~ o of mechanical restraznt. SECTION 2. LICENSE REQUIRED: No dog shall be permitted to be or remain in the City of Boynton Beach, Florida, without being, licensed as herein provided. -SECTION $. LICENSE FEES: All dogs kept in the City shall be registered as to sex, breed, name and address of owner and name of dog. At the time of s~ch registration, such owner shall obtain a license for such dog and shall pay a fee of for each doq. It shall be the duty of said owner to cause such li eense tag to be securely attached around the dog's neck and kept there at all times during the license period. Prior to the issuanc~ of any such license, the issuing authority shall satisfy themse!ve~ that each dog to be issued a license provided hereunder has been properly vaccinated in accordance with the provlslons' ' of this ordinance relative thereto. The owners of all dogs within this City shall be given a period of 45 days from the effective date of this ordinance within which to comply with the terms and requirements of the licensing section hereof. Thereafter annual renewals of such licenses shall be made effective November 1st of each ensuing year. Such licenses shall be issued by or under the direction of the City Clerk. SECTION 4. DANGEROUS DOGS: No. vicious, dangerous, ferocious dog or dog sick with or liable to communicate hydro- phobia or other contagious or infectious desease shall be permitte, to run at large in the City. SECTION 5. DIS~3~BING PEACE: No person owning any dog shall suffer or permit a dog to disturb the peace and quiet of the neighborhood by barking, making other loud or unusual noises or by ruhning through or across or depositing waste on any cultiva: grounds, fields or lawns. SECTION 6. NUISANCE: Any dog found in the City either without a license, running at large or otherwise violating the ditions set forth herein is hereby declared a nuisance and shall be impounded as herein provided. SECTION 7. DUTIES OF POUND KEEPER: In connection with the enforcement of this ordinance, there shall be appointed by the ' ' ~ ..... ~ ' , a pound KEEPER WHO IS CHARGED %frITH THE DUTY OF I~OUNDINC ALL DOGS RUNNING at large or otherwise in violation of this ordinance. He shall be a special Police Officer and is hereby authorized to make all ~ecessary arrests in carrying out the provisions of this ordinance. The salary of such pound keeper shall be fixed by the City Council. SECTION 8. LICENSED DOG INPOUNDED. It shall be the duty ~f the pound keeper to cause notice to be served by mail upon the registered owner of any licensed, dog impounded under the provisions of this aricle, such notice to be mailed at least ~ days prior to the posting of notice of impounding herein provided for. SECTION 9. DOG BITES: Whenever any dog bites a person, the owner of said dog shall notify the Chief of Police who shall order the dog held on the owner's premises or shall have it im- pounded for a period of two weeks. The dog shall be examiaed promptly after it .has bitten anyone and again at the end of the above two weeks period. If at the end of two weeks a qualified veterinarian is convinced that the dog is free from rabies, the dog shall be released from quarintine or from the pound as the case may be. If the dog dies in the meanwhile, its head shall be sent to the Florida State Department of Health for examination for rabie If any impounded dog is found to be diseased to the detriment of )ublic health~ such dog shall be humanely disposed of under and ~pon the authority of the Chief of Police. SECTION 10. S~P/h~ABILITY: Each of the provisions of this Article are separable, including word, clause, phrase or sentence, if any provision hereof shall be declared null aad void, the ~aining portion shall not be affected but shall remain in full forc~ ~nd effect. SECTION il. REPEALING PROVISIONS: All ordinances, or parts )r ordinances in conflict herewith are hereby repealed. SECTION 1~. PENALTIES: Any owner violating any of the ~rovisions of this Ordinance shall, upon conviction thereof, be ,enalized by fine of not less than $8.00 or more than $$00.00, or mprisoned in the City jail for a period not exceeding 90 days, or ~oth much fine and imprisonment for each offense, and a separate ,ffense shall be deemed committed on each day during or on which a iolation occurs or continues.
