Heeting Minutes Regular City Commission Heeting Boynton Beach, Florida May 21~ 2002 II. PUBLIC AUDIENCE: INDIVIDUAL SPEAKERS PRESENTATIONS WILL BE LIMITED TO 3-MINUTE Barry Silver, 7777 Glades Road #308, Boca Raton, said he was present to speak about a matter of urgency. The State of Florida Eradication Program is threatening the citrus trees in Boynton Beach. Broward County, Boca Raton and other municipalities have already instituted a lawsuit in Broward County. He will be appearing before .]udge Barkdull at the Palm Beach County Courthouse filing a lawsuit tomorrow and requested that the Boynton Beach City Attorney be present with him.' He asserted that there is an incredible amount of fraud being perpetrated on the citizens of Florida. Various judges thrOughout the State have thrown the program out as exceeding governmental authority or as being invalid. Unfortunately, the Appellate Court has reversed these decisions. He stated that the program is based upon "junk science and greed." The State has declared a permanent State of Emergency and in so doing has taken people's constitutional rights away. The program is being supported with taxpayer money and to date almost one-half billion dollars has been spent to defend the declared State of Emergency. Hr. Silver said if the City did not react by tomorrow, the citrus trees in Boynton Beach would all be gone by next week. Hr. Silver will be asking .Judge Barkdull to put the eradication of citrus trees in Palm Beach County on hold Until he can hear the evidence. Hr. Silver distributed to the Commission a copy of the complaint that he will be filing and requested that someone from the City appear with him in Court tomorrow. Harold Hiller, 229 NW 3rd Avenue, Boynton Beach, stated that about a year ago the City retirees requested a raise. After a long period of time, the City agreed to give the retirees an additional check each year. He asked when the retirees could expect this check. Mayor Broening informed Hr. Hiller that he would receive a letter in answer to his question. Sean Monroe, 2508 SW 23rd CranbrOok Drive, Boynton Beach, was present also to express his concern regarding the eradication of the citrus trees in Boynton Beach. He respectfully asked that the City protect the rights of its citizens and join in the lawsuit, in order to prevent the State from cutting down the citrus trees in Boynton Beach. He was informed that representatives of the State will be in Boynton Beach around Hay 28th and something needs to be done right away. Lloyd Powell, stated that he was past President of the Gold Coast Lodge #49 of the Fraternal Order of Police Associates, of which he is now the Secretary and Treasurer. Every year, during the third week in Hay, a police officers' memorial week is observed to honor all fallen peace officers that gave their lives in the line of duty during the past 2 Heeting Minutes Regular City Commission Heeting Boynton Beach, Florida May 21, 2002 year. He commended the Boynton Beach Police Department on presenting a very moving memorial service on Wednesday, May 15th, at the Village Royale auditorium. Mr. Powell thanked Sgt. Richard Root, Chairman of the Committee, for putting on the best memorial service he has seen. He also thanked Village Royale on the Green and its Executive Board for providing the use of their facilities for the ceremony. In addition to recognizing the fallen officers, Canine Zeus was also honored for giving up his life in the line of duty. Lt..lack Cambrio of the New York Police Department was present at the ceremony and presented a slide presentation of the aftermath of 9-J. 1. Herb Suss, requested that the City look into the citrus canker program to protect the citizens of Boynton Beach. Mr. Suss would also like the City to protect itself from urban sprawl and pollution. He had fears that as the City grew, pollution could become a serious problem and there would not be enough water for everyone. There is too much building going on in the City and he would like to see a slowdown. Lisa Landis, 620 NE 20th Lane, Boynton Beach, inquired about the status of Intracoastal Park. She said she spoke to the Commission last November and it appears that nothing has been done since then. The area is very unsightly. She was told when she spoke last November that she would be furnished with a photograph of the park, which she never received. Mr. Bressner responded that the bid opening is scheduled for next week and requested that Assistant City Manager Dale $ugerman respond to her concerns in writing and to include a copy of the plan with the bid schedule. III. OTHER: Informational Items by Members of the City Commission Commissioner McCray reported that 44 participants in the City's P.A.L. track team went to Melbourne, Florida to compete recently. This is the third year that the children have competed and the team has won first place all three years. Commissioner McCray read a letter from the Imperial Conference Center that complimented the City's P.A.L. children and stated that they were the best behaved group of children that ever stayed at their establishment. Commissioner McCray urged the City to continue to support the P.A.L. Program. Mayor Broening announced that Bill Lynch has resigned from the General Employees Pension Board due to illness. He has served on the Board for ::LO years and will be missed. Presentations: Proclamations: Meeting Minutes Regular City Commission Heeting Boynton Beach, Florida Hay 21f 2002 "The Boynton Veterans Council Memorial Day Celebration" May 26, 2002 Mayor Broening read the Proclamation declaring Sunday, May 26, 2002 as the Boynton Veterans Council Memorial Day Celebration. Mayor Broeninc~ will present the Proclamation at the ceremonies scheduled for 2:00 p.m. at Boyr~ton Beach Memorial Park. Presentation of grant check to local Habitat for Humanity members from World Mortgage Co. Mr. Kenneth Aguon from World Savings Bank thanked the Commission for allowing them to present the check at the meeting. To date, Habitat for Humanity has built 47 homes in South Palm Beach County and six in Boynton Beach. The check was presented to representatives from Habitat for Humanity. Commissioner Fisher pointed out that there is a City team and a Chamber team that work together on the houses and he would like to see more houses built. It was noted that there are plans to build the 50m house on NE 12th Avenue in Boynton Beach this Fall. 3. Intentionally left blank 4. Presentation of Certificates of Appreciation to the volunteers in the 2002 Great American Cleanup, held on Saturday, April 27, 2002 Mayor Broening introduced Dan DeCarlo, the City's Neighborhood Specialist. Mr. DeCarlo noted that the City participates in this program that takes place every year throughout Palm Beach County. The program affords volunteers an opportunity to contribute to the City. OR AS SOON THEREAFTER AS THE AGENDA PERMITS A. Project: Agent: Description: Federal Highway Corridor Community Redevelopment Plan Nix Use-Low Zoning District (IVlU-L); and Nix Use-High Zoning District (MU-H) City of Boynton Beach Request for an amendment to Chapter 2, Zoning, Section 6 to establish the Nixed Use-Low ]:ntensity (MU-L) zoning district for the purposes of implementing the Federal Highway Corridor Redevelopment Plan and accommodating redevelopment within planning areas #2 and #4; and Request for an amendment to Chapter 2, Zoning, Section 6 to establish the Nixed Use-High ]:ntensity (MU-H) zoning district for the purposes of implementing the Federal Highway Corridor Redevelopment Plan and accommodating redevelopment within planning area #3 Nr. Hudson stated that Items A and B would be combined. City Attorney Cherof administered the oath to all persons who would be testifying. Nr. Hudson pointed out that the regulations being presented were heard by the Commission last year and deal with areas 2 and 4 of the Federal Highway Corridor Study. These two areas would be eligible for the mixed-use Iow density. The mixed-use high density would be in the CBD. The regulations do not inwolve any property rezonings. They are being adopted to permit developers to take advantage of the regulations if they so desire. There is no area identified as yet for the mixed-use high. This will come back to the Commission at its first meeting in .luly. The property would only be rezoned if the property owner requested it. Commissioner Fisher inquired if this would require changes to the Comprehensive Plan. Mr. Hudson responded that there would be a change to the Comprehensive Plan to allow the mixed-use high density to go into effect. This is not being heard tonight and would probably only involve a text change. IVlr. Bressner noted that the second part of the request is to establish different criteria for a PUD within the CBD. At this time, there is no proposal that any existing properties in the City would be rezoned by these regulations. Mary Law, 625 $. Federal Highway, Boynton Beach, requested that all U.S. I property owners be notified in writing about the amendments. The notice in the ,oa/m Bea£/~ Post stated that there would be two public hearings before the CRA. ]:f that was correct, she wanted to know why the Commission was hearing this tonight. She also Meeting Minutes Regular City Commission Meeting Boynton Beach, Florida May 21, 2002 requested that the City put in writing how the amendments wouJd affect the current property owners and the use of their property. Mr. Hudson responded that the notice in the paper stated that the item would go to the CRA once and two dates for the City Commission. He further responded that these amendments would have no effect upon the property owners. Mr. Bressner also responded with regard to a notice in writing to the property owners, it is available in writing in the agenda packet, which is :[tem A, Part VI under "Public Hearing." Lloyd Powell, representing the property owner at 1112 N. Federal Highway, thought that the property owners along N. Federal Highway would be pleased to know that there will be no zoning changes whatsoever. Mr. Powell asked for an explanation of what an :[nfill Planned Unit Development (:[PUD) was. He questioned why the property owners were not notified as they had been when previous publiC hearings took place. Commissioner Ferguson noted that the Michele Meilgren Study suggested that the height limits be based upon a tier system with 150' being allowed in District 3. :[f a tier system is being recommended, Commissioner Ferguson suggested that areas 2 and 4 be allowed a height limit of 100' instead of 75' and that areas 1 and 5 be allowed to go from 50' to 75'. He asked if there could be exceptions to the 75' rule. Mr. Hudson responded that this was not contemplated. Mr. Ferguson suggested this be allowed by requiring additional setbacks or other conditions to obtain the extra height. Mr. Hudson felt this could be done if this is what the Commission wanted. Mr. Bressner stated if there was going to be an amendment to the height limits, the exception would have to come with an enhanced setback and/or enhanced landscaping in order to establish some standards to the height limitations. Also, a public hearing would be required. Commissioner Fisher inquired if the zones in the north and south could go higher than 75'. Commissioner Ferguson said he is requesting that this be allowed on an exception basis, subject to approval of extra landscaping or setbacks. Mr. Hudson pointed out that the maximum height in the :[PUD is 45'. Mayor Broening agreed with Commissioner Ferguson that the density east of 1-95 must be accommodated somehow as the City continues to grow in order to preserve the areas west of the City. 7 Meeting Minutes Regular City Commission Meeting Boynton Beach, Florida May 21, 2002 Motion Commissioner Ferguson moved to approve both requests to Chapter 2, Zoning, Section 6, establishing the mixed-use Iow and the mixed-use high densities. Motion seconded by Vice Mayor Weiland. Mayor Broening pointed out that Commissioner Ferguson did not include his height exception changes in the motion. Commissioner Ferguson requested that this be brought back to the Commission. Vote The motion unanimously passed. B. Project: Federal Highway Corridor Community Redevelopment Plan Infill Planned Unit Development District (:[PUD) Agent: City of Boynton Beach Description: Request for an amendment to Chapter 2, Zoning, Section 5 to establish the Infill Planned Unit Development (:[PUD) zoning district for the purposes of implementing the Federal Highway Corridor Redevelopment Plan and accommodating redevelopment within planning areas #1 and #5 Mr. Hudson pointed out that the Code provides for PUDs to have a minimum of five acres. Staff would like to create Infill PUD regulations that would allow for smaller parcels to be developed. This would address the one to five acre parcels that exist along Federal Highway. Developers that have projects would have more freedom for their projects, while giving staff more freedom to request enhancements and changes. There are several developers that have already expressed an interest in bringing projects forward. These _Thrill PUD regulations would apply to the areas south of Woolbright to the City limits and north from the C-16 Canal to the City limits within the CRA area. This would also permit an increase in density in the Coastal Management Area as defined in the Comprehensive Plan that already permits exceptions to the 10.8 units per acre. Motion Commissioner Ferguson moved to approve. Motion seconded by Vice Mayor Weiland and unanimously carried. VII. Seacrest Boulevard - Request for site plan approval to construct a two-story 31,192 square foot expansion to the existing church facility for a total of 54,230 square feet on a 3.84-acre parcel 11 Meeting Minutes Regular City Commission Meeting Boynton Beach, Florida May 2:1.~ 2002 V.E.2. First Baptist Church, 301 North Seacrest Boulevard - Request for a height exception as defined by the Land Development Regulations, Chapter 2, Zoning, Sec. 4.F. 1, to allow for an increase in the building height of a "place of assembly" to exceed the maximum height limit allowed within the R1A Single-Family Residential zoning district; and Request for a height exception as defined by the Land Development Regulations, Chapter 2, Zoning, Sec. 4.F. 1, to allow a church spire to exceed the maximum height limits allowed within the R1A Single-Family Residential zoning district Bradley Hiller, of Hiller Land Planning Consultants, 298 Pineapple Grove Way, Delray Beach, assumed the podium with the architect of the project. Hr. Bradley presented an artist's drawing of the project and pointed out the elevation of the building. The Church purchased all of the property between Boynton Beach Boulevard at the south, Seacrest to the east, Ist Street to the west and 3rd Avenue to the north, which means the Church owns the entire block. The Church is planning to add a new 600-seat sanctuary to the existing buildings. The existing buildings will then be converted to classroom facilities. The property remaining to the north and west will be for parking. There are two access points--one off Seacrest Boulevard and the other off NWIst Street. There was a proposal for an access cut on Boynton Beach Boulevard, but that has been eliminated. Hr. Bradley thanked staff for their assistance and cooperation. The new fac;ade is more contemporary compared to the existing red brick. None of the existing church structure will be visible from the west. Hr. Bradley wished to address Condition #24, which was part of the approval of the item by the CRA. Staff, at an earlier meeting, also had concerns how all the architectural fa(;ade would tie together and this was also a concern of the CRA. Tt will cost the church approximately $4.5 million for the first phase. The church cannot add the entire facade at this time because of the costs. The CRA asked that the applicant come back to their Board with a timeline of when the fa~;ade changes would be made. The applicant is requesting that this condition be modified to allow the applicant to work with staff on coming up with the phasing plan, timeline and schedule for the fa~;ade improvements and the implementation thereof. Staff proposed that this would be provided prior to the issuance of the building permit. This is agreeable to the applicant and they would like the language in condition #24 that reads "and approved by Community Redevelopment Agency" be stricken from that condition. Commissioner Fisher inquired whether there was enough time for the applicant to go back to the CRA. Director of Planning and Zoning, Hike Rumpf, responded that this 12 Meeting Minutes Regular Ci~ Commission Meeting Boynton Beach, Florida May 2:t~ 2002 would depend upon the applicant's schedule. Mr. Bressner pointed out that the CRA only meets once a month. Commissioner Fisher suggested that the CRA could always call a special meeting. He did not want to see the authority of the CRA usurped by staff. Commissioner Fisher requested that the CRA stay involved in the project. Mr. Hiller stated that they needed more time for the design and the costs associated therewith. He stated that since staff has been so cooperative, they would like to continue working with staff in coming up with the schedule. Commissioner Fisher felt that the applicant should continue to work with staff, but that the CRA should have an opportunity to approve the project. Mayor Broening suggested a language change that would not link the approval of the fagade changes to the building permit. He proposed that the building permit process continue and after the design changes have been agreed upon, they would go back to the CRA and then the Commission. Mayor Broening also wanted to keep the CRA involved. The architect for the project stated that they were not planning on making any changes, and the CRA was referring to a schedule to complete the fagade enhancements on the existing buildings. Commissioner McCray inquired why the egress on Boynton Beach Boulevard was eliminated from the plan, as he had concerns about the traffic. The architect stated that this was addressed with the FDOT extensively, and it was their agency that requested that the Boynton Beach Boulevard egress be eliminated. This would also have required a variance from the FDOT, and they discouraged the applicant from proceeding with this. Commissioner McCray would also like to have a guard when the church patrons exit to keep the traffic flowing. This request did not appear to be a problem with the Church. Mr. Miller also addressed comment #26 in the conditions of approval where the CRA recommended right-in and right-out driveways at both entrances, which had never been discussed at the TRC reviews. Mr. Miller felt that this comment would not accomplish its intent, which was to keep the traffic moving. Mr. Miller requested that this comment be deleted. Mr. Rumpf stated that staff supports this request. Mr. Hiller said he also discussed this with the City's Engineer who also agreed that this comment should be deleted. Discussion of water and wastewater rate options Hr. Bressner reported that staff would be making a brief presentation of the results of the water and wastewater rate study done by Camp, Dresser & HcKee. The Commission requested that the study include (:[) options to promote water conversation (2) evaluate whether or not any rate options could remain as is, (3) and to distribute the rate structure equitably, while accomplishing those goals. Hr. Bressner announced that there is no consideration for a rate increase for the next five years, unless the City goes to a different aquifer. Assistant City Manager Dale Sugerman noted that last November he made a presentation on water conservation strategy issues. That presentation included three main topics: (1) the source of the supply water; (2) the permitting process to get the additional source of water; and (3) a discussion on rates and costs. The City Commission requested that staff undertake a complete cost-of-service and rate study for water, wastewater and stormwater. The final study was forwarded to the Commissioners two weeks ago. The report is available in the City Clerk's Office and in the Boynton Beach Library. of the highlights of the report are as follows. ,/ No overall rate increases for any of the three utility systems are considered. Some being There will be some increases and decreases in fees for ancillary services. To encourage conservation, a structural modification to the existing water rate chart is being recommended in order to be prepared for any future drought restrictions that may be imposed by the South Florida Water Management District (SFVVMD). 14 Meeting Minutes Regular City Commission Meeting Boynton Beach, Florida May 2~., 2002 The minimum 3,000-gallon usage charge would be eliminated. The commodity blocks would be reduced from eight to three. This would include a modification in the relative differentials among the three new commodity blocks. Provides a thorough analysis of the capital facilities charges, as well as an analysis of the ancillary charges. This is set forth in Section 3 of the report. The present rates are adequate to meet all of the needs of the utility system for the next five years, which is set out in Section 4. A portion of Section 4 deals with the future expansion of the water system and the costs associated with going to the Floridan Aquifer. The Floridan Aquifer could be an unlimited source of water for the future, but is very costly. Recommends that the Commission adopt a flow of funds statement for the accounting of all utility revenues and expenditures. Staff plans to include a flow of funds statement in the next draft rate Ordinance. Contains a complete overview of the combined system revenues, expenditures and cash flows at the current rates. There is a cash surplus of approximately $500,0oo. There are three alternative rate table modifications comparing what the customers are currently charged. In addition to eliminating the 3,000-gallon usage charge, it also recommends reducing the base customer charge from $6.65 per month to $4.00 per month. All three alternatives reduce the number of rate blocks from eight to three. The commodity rate blocks being proposed are 50,000, 35,000 or 30,000. The Leadership Team recommends that the highest rate block should be at 30,000 gallons per month. Provides for a drought rate schedule that would go into effect automatically in the event that the SFWMD imposes drought restrictions. Mr. Sugerman thanked Dan Anderson of Camp, Dresser & McKee, and John Guidry, Barbara Conboy, Bob Kenyon, Mark Law and Peter Mazzella, who comprised the Leadership Team and were responsible for bringing the report to fruition. Vice Mayor Weiland had concerns about the rate structure for three different blocks when considering large Iow-income families. He did not want to penalize people who needed to use a large amount of water, but could not afford it. Commissioner Fisher felt that a "reasonable amount" needed to be defined, exclusive of irrigation use. He would like to have a sampling of what a large family would use and asked if this was possible. Mr. Sugerman responded that no families were surveyed and if this were undertaken, it would have to be voluntary. Commissioner McCray would like a study undertaken as well and people who abuse water consumption should be penalized. 15 Meeting Minutes Regular City Commission Meeting Boynton Beach, Florida May 21~ 2002 MaYor Broening stated that water is the number one issue in the State and this is something the City is going to have to face eventually. The City also needs to look at the reuse of water for irrigation purposes and this is another huge expenditure. Mr. Sugerman pointed out that the difference between the cost of 30,000 and 35,000 gallons of water is 79¢ per thousand times 5, which would be $3.95. Commissioner Fisher asked if there are any cities that are getting their water from the Floridan Aquifer. Bob Kenyon, Deputy Utilities Director, stated that Jupiter and Hollywood Florida are getting water from the Aquifer. Mr. Kenyon stated that "reasonable use" is approximately 100 gallons per person, per day. Per capita usage in the City is 162 gallons per person, per day due to the watering of the medians and ballparks. The 100 gallons per person, per day also includes irrigation. Therefore, using this formula, a family of eight would use 24,000 gallons per month. Bob En$1er, 26 Woods Lane, Boynton Beach, spoke about a town in Georgia that is running out of water and may have to cut some of their customers off. Mr. Ensler stated that his household of two uses between 5,000 and 6,000 per month without an irrigation system. He suggested that the personal needs of the family be separated from the landsCape needs. Dom Desiderio, owner of Atrium Place, 2755 South Federal Highway, Boynton Beach had concerns for the small business person and how they would be charged. He would like a separate rate schedule for small businesses.* Mr. Desidedo referred to the pervious and impervious in the study. This has been a bone of contention to him ever since the City passed the ERUs. On the wastewater, don't misund_erstand me, ! want to pay my fair share. When you have an ERU and you charge a business owner for 1937 square feet of impervious area, yet he has to follow a code and he has to have a parking space for every 150 square feet of retail space. So as far as the code goes, he has to pay, he has to meet that obligation and then he is penalized by the ERU because he is charged for every square foot of impervious area. You did that to the business community and everybody is beinq charqed. Mr. Sugerman pointed out that there are examples of usage in the appendix B to the report that include residential and commercial. Tf this is not sufficient after the Commissioners look this over, Mr. Bressner said that staff could come up with some additional data. An update would be presented at the second City Commission meeting in June. B. Lake Eden Canal Maintenance Options Mr. Bressner reported that staff has determined that the question of ownership of some existing canals in the City needs to be addressed, as well as determining who would maintain these canals. This has been unclear since it was originally addressed over 20 years ago. The City maintains some canals and not others. Even though the canals are on private property, there is some public benefit and use of the canals and staff is asking the Commission to consider a policy that would effectively allow the City to provide aquatic weed maintenance for the canals. No dredging would be involved. Tn order to perform the aquatic weed maintenance, the property owners must authorize the public to have access to the canals. Since there is no homeowners' association that the City could deal with, it is necessary that the City come up with some guidelines to perform the work. City Attorney Cherof pointed out that this would also provide the City with an opportunity to study canal maintenance, stormwater retention and relocation. This is the public purpose that he is recommending to the Commission to justify the expenditure of public funds. Vice Mayor Weiland would also like the City to maintain the canals that it acknowledges are City canals, which are not being properly maintained at the present time. Beverly Agee, 832 SW 33rd Place, Boynton Beach, thanked the City for opening up the process to resolve the canal maintenance situation. Ms. Agee noted that there was a meeting last January with staff and homeowners to discuss the situation. She pointed out that currently there is drainage from the public streets going into the canals and felt that the maintenance of the canals by the City would provide a public benefit. Gary Fishman, 3504 Diane Dr., Boynton Beach, thanked the City for addressing the situation. He noted that a tremendous amount of work and effort went into the report. Mr. Fishman pointed out that canal maintenance is a big issue in the entire State and on behalf of himself, and his neighbors, everyone was grateful for the City's assistance. Wayne E. Puls, 83:L SW 34th Ave., Boynton Beach, appreciated the work done by the City staff in clearing up the canal maintenance problems that have existed for many years. Hary Law, 625 S. Federal Highway, Boynton Beach, stated that the City requires property owners to maintain the right-of-ways in front of their properties. She feels that the owners of Lake Eden should be responsible for maintaining their own canals. The City should not set a precedent of spending tax dollars to maintain private properties. She suggested if the property owners wanted the canals maintained by the City, they should deed the canals to the City. She is also opposed to using chemicals to clean up the canals. Chemicals can harm the water supply and cause damage to the fish and animals. Commissioner Fisher asked if the chemicals being used are killing the fish and animals in the canal. .lohn Wildner, Parks Director, responded that all the chemicals used are fully permitted in accordance with the regulations established of the Florida Department of Environmental Protection and do not harm the animals and fish in the canals. Motion Commissioner Ferguson moved to authorize staff to proceed with the agreement with the property owners to support the staff recommendations. Mayor Broening requested that after tonight's discussion, the City Manager come back to the Commission with a specific contract. Vice Mayor Weiland requested that both issues be discussed tonight and not have the contractual aspect come back at another time. Commissioner Fisher was agreeable to separating the discussion of the two items. Commissioner Ferguson would like to discuss both items tonight. Commissioner McCray had no reservations about the issues being addressed separately. Mr. Bressner said that he would prefer to have an evaluation of his performance by the Commission and after the evaluation, the Commission could decide on his salary. He also would like the issues separated and after tonight, he would bring back to the Commission what he would be looking for contractually. Tt was agreed to proceed with the discussions separately. Bob Ensler, 26 Woods Lane, Boynton Beach, said that the City was fortunate to have Mr. Bressner as its City Manager. He complimented the City Commission on their selection of Mr. Bressner as City Manager. Mr. Ensler read some of the items that were included in the agenda back-up regarding Mr. Bressner's accomplishments since he came onboard. Mr. Ensler requested that Mr. Bressner add to his plans for next year to include completing an alternative zoning profile for Congress Avenue. Herb Suss equated Mr. Bressner's performance to that of former New York Mayor Fiorello LaGuardia. The City Manager is always available to speak with and the City is very fortunate to have Mr. Bressner as its City Manager. Mr. Suss does not want the City to lose Mr. Bressner. He complimented Mr. Bressner for his continuing education 19 Meeting Minutes Regular City Commission Meeting Boynton Beach, Florida May 21, 2002 accomplishments, which is very important. He urged the Commission to do right by Mr. Bressner. Mr. Bressner thanked Messrs. Ensler and Suss for their support. He reported that he had provided the Commission with 26 specific activities, but there were a lot more, and 21 activities for next year as an overview of what the City Manager does. Boynton Beach is fortunate in that it has such an active and concerned community. This is one of the best Commissions that he has ever worked with. They are responsive and caring about the community and understanding about what needs to be done. Mr. Bressner said that he was proud of what staff has accomplished and of the leadership that he has provided. He enjoys being a City Manager and is pleased to be Boynton Beach's City Manager. This has been a good year and a lot has been accomplished. He would like to continue as City Manager. Commissioner Fisher noted that Mr. Bressner has brought with him many years of experience and he has heard nothing but compliments about the change in Boynton Beach over the past couple of years. He noted that the attitude has changed in the City and that many things have been accomplished. The Commission does not run the daily operations of the City; this is done by the City Manager. Commissioner Fisher pointed out that during the past year there have been at least six openings in various municipalities in Palm Beach County for City Managers that paid more and the cities were smaller. Commissioner Fisher pointed out that everything the Commission asked of Mr. Bressner this past year has been accomplished. Vice Mayor Weiland thought that tonight's discussion was going to cover Mr. Bressner's evaluation and a salary increase. Although they don't always agree, he commended Mr. Bressner for his accomplishments and feels that he has done a good job. Commissioner McCray noted that he meets with Mr. Bressner every Tuesday morning and he always tries to answer his questions. Commissioner McCray urged the Commission to give Mr. Bressner his "just dues." He has done a great job for the City and he does not want the City to lose him. He has learned a great deal from Mr. Bressner and has nothing but the utmost respect for him. Mayor Broening noted that Mr. Bressner treats each Commissioner equally, and each Commissioner receives the same level of information. Mayor Broening noted that the salary analysis of city manager salaries revealed that Mr. Bressner's salary is on the lower quartile compared to cities of equal size. Mr. Bressner could have gotten a job in any City in this State that would pay a higher salary. Mayor Broening commended him for his loyalty to the City and stated that he is an asset to the City that must be retained. His performance has been above and beyond expectations. Mr. Bressner will bring something back to the Commission for consideration. 20 Meeting Minutes Regular City Commission Meeting Boynton Beach, Florida May 21, 2002 Authorize City Manager to submit a Development Regions Core Grant application on behalf of High Ridge Properties, ]:nc. to Palm Beach County, Department of Economic Development Ms. Octavia Sherrod, Community Redevelopment Manager, stated that both applications are eligible for CDBG funds if the grant applications are approved. High Ridge Properties, ]:nc. is the property known as Ocean Plaza on Ocean Avenue. The principal of High Ridge Properties, ]:nc., Mark Fender, purchased the property and would use the funding to renovate the property. The Regions Core Grant allows for fa~;ade improvements to buildings that provide for businesses that indirectly create jobs. This is also permitted under the Community Development Block Grant program. The project itself costs $273,000 and the applicant has applied for $50,000 from the County. ]:f the grant is approved, the City would have to match the grant by 50%, or $25,000. ]:f the next applicant were also approved for a grant, the City would also have to match that grant by 50%, or $25,000. This would mean that the total impact on the City would be SS0,000. There will be two other economic development rounds coming up this fiscal year. Palm Beach County Housing and Community Development has set aside 10% of all their CDBG funds for economic development that would require a :[00% match from the City. ]:f any business owner in the City applied and received grant funding, the City would have to pay $50,000. The Core Grant is also going to have another round in the Fall, which could impact the City. Ms. Sherrod asked for direction on how much money the City would like set aside for these matching grants. Mr. Bressner said that both applicants warrant serious consideration and he would recommend that the City move forward if they are approved. He pointed out that the only exposure to the CDBG funds this year for these grants would be $50,000. Hr. Bressner also ointed out that there is 637 000 is available in the Utili Fund whi-~ .could be a tied to these actiwties. Ms. Sherrod responded that these funds wouici ~mpact fiscal year 2002/2003. The application deadline of grants for the Palm Beach County Housing and Community Development is .luly 26th, This would impact next year's CDBG funds as well and possibly the Core Grant in the Fall. Mr. Bressner said it was important that the County knows that Boynton Beach wants to participate in the program and is willing to provide local funding. Commissioner Fisher had concerns about using the CDBG funds for redevelopment and that other eligible uses would be left out, such as small businesses. Ms. Sherrod did not think this was the case. When she appeared during Public Audience at the last meeting, she requested that the fine be rescinded so that she could use the money to make more repairs to the house. She did inform Commissioner Fisher that she paid the fine because she closed on the purchase of the property. Mr. Blasie confirmed Commissioner Fisher's interpretation of the case. Commissioner Fisher requested that she attend tonight's meeting, but she was unable to find a sitter for the children.
