R24-200 RESOLUTION NO. R24-200 3 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOYNTON BEACH, 4 FLORIDA, APPROVING THE COMMUNITY IMPROVEMENT DIVISION COMMUNITY 5 DEVELOPMENT BLOCK GRANT (CDBG) PROGRAM CORONAVIRUS AID, RELIEF AND 6 ECONOMIC SECURITY ACT (CARES ACT) FISCAL YEAR 2020 ANNUAL ACTION PLAN 7 AMENDMENT; AND FOR ALL OTHER PURPOSES. 8 9 WHEREAS, on August 3, 2021, the City Commission approved Resolution No. R21-092 10 rescinding Resolution No. R20-059 and approving the First Amendment to the CDBG Annual 11 Action Plan for Fiscal Year 2019 for CDBG Care Act allocations 1 and 3; and 12 WHEREAS, the City of Boynton Beach was allocated in Fiscal Year (FY) 2019 and FY 2020 13 a combined total of $911,184.00 in additional CDBG Coronavirus (CDBG-CV) funds under the 14 CARES Act to provide citizens with supplemental funds to prevent, prepare for, and respond (PPR) 15 to coronavirus. The City of Boynton Beach was awarded two rounds of funding from HUD in the 16 following amounts: 17 • CDBG-CV Round 1 - $351,815 18 • CDBG-CV Round 3 - $559,369; and 19 WHEREAS, these funds aimed to assist low-to-moderate-income (LMI) individuals and 20 families impacted by the coronavirus. City Commission allocated these funds to the following 21 eligible activities which directly responded to Coronavirus (Resolution R21-092): 22 • Emergency Rental Assistance $370, 645.00 23 • Public Services/Food Distribution $358,303.00 24 • Planning and Administration $182,236.00; and 25 WHEREAS, the City currently has $123,022.08 in leftover funds from Planning and 26 Administration that must be (re)allocated. These funds were planned for expenditure in CDBG FY 27 2019 and FY 2020. The U.S. Department of Housing and Urban Development (HUD), instructed 28 Entitlement Communities to reprogram these CDBG-CV leftover funds to activities with PPR 29 tieback to coronavirus, including activities to prevent eviction or stabilize LMI neighborhoods 30 affected by economic disruption since January 2020; and 31 WHEREAS, the City is required to amend its Annual Action Plan when significant changes 32 are identified for any new activities or current activities that require a change in the budget 33 amount in excess of 50 percent. In addition, the City must follow the Federal Regulations 24 CFR 34 91.105(c)(2) and (k), 24 CFR 91.115(c)(2) and (i), and 24 CFR 91.401, regarding citizen participation 35 and all applicable waivers and flexibilities made available under the CARES Act; and 36 WHEREAS, Staff is recommending reprogramming these Planning and Administration 37 leftover funds to assist with up to 6 months of Emergency Rental Assistance to eligible individuals 38 or families that are or were affected directly or indirectly by COVID; and 39 WHEREAS, priority will be given to eligible applicants who are 50% or below the Area 40 Median Income, homeless individuals or families, or those at risk of being homeless who have 41 received either a past due notice or an eviction notice. Eligible applicants must demonstrate that 42 they don't have the ability to pay rent. The assistance will be given based on need and cover only 43 necessary and reasonable costs. The assistance will be paid to the housing provider on behalf of 44 the eligible individual or family; and 45 WHEREAS, the City Commission, upon the recommendation of staff, has deemed it in the 46 best interests of the city's citizens and residents to approve the Community Improvement Division 47 Community Development Block Grant (CDBG) Program Coronavirus Aid, Relief and Economic 48 Security Act (CARES Act) Fiscal Year 2020 Annual Action Plan Amendment. 49 50 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF BOYNTON 51 BEACH, FLORIDA, THAT: 52 SECTION 1. The foregoing "Whereas" clauses are hereby ratified and confirmed as 53 being true and correct and are hereby made a specific part of this Resolution upon adoption. 54 SECTION 2. The City Commission of the City of Boynton Beach, Florida, does hereby 55 approve the Community Improvement Division Community Development Block Grant (CDBG) 56 Program Coronavirus Aid, Relief and Economic Security Act (CARES Act) Fiscal Year 2020 Annual 57 Action Plan Amendment (the "Amendment"), in form and substance similar to that attached as 58 "Exhibit A. " 59 SECTION 3. The City Commission of the City of Boynton Beach, Florida, hereby 60 authorizes the Mayor to execute any ancillary documents as may be necessary to accomplish the 61 purpose of this Resolution. 4 r 62 SECTION 4.
