83-BBB RESOLUTION NO. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BOYNTON BEACH, FLORIDA, ENDORSING ~ LOCAL, COUNTYWIDE AND STATEWIDE EFFORTS ~ TO REGULATE OR PROHIBIT THE BLOWING OF ~ TRAIN WHISTLES DURING EVENING AND NIGHT ~ HOURS AT SIGNALIZED RAILROAD CROSSINGS; k PROVIDING AN EFFECTIVE DATE; AND FOR OTHER \ PU OSES. \WHEREAS, The City of Boynton Beach has determined that the blowing of train whistles at signalized railroad crossings is~f negligible safety value and infringes upon the right of perso~residing adjacent to or near signalized railroad \ crossings to the\quiet enjoyment of their homes, including the right to sleep during the nighttime hours without the intrusion \ of loud railroad wh~tles; and WHEREAS, th% City of Boynton Beach supports efforts \ to regulate or prohibi~ train whistles at signalized intersection~ during late evening and n~ghttime hours, NOW THEREFORE BE~T RESOLVED BY THE CITY COUNCIL OF THE CITY OF BOYNTON BEACH, F~ORIDA THAT: sac.on su or s° Beach, Florida, hereby endorses ~nd the efforts of local and county governments to regula~ the use of railroad train whistles at signalized intersectio~ during late evening and nighttime hours, and requests the Bo~rd of County Commissioners of Palm Beach County and members of th~ Palm Beach County legislative delegation to work on measu~s to control the use of train whistles at signalized intersect~0ns in order to protect the rights of residents to the qui~ enjoyment of their homes. ~ Section 2: The City Clerk is hereby~directed to send a copy of this Resolution to each member of the~oard of County Beach County and each membe~ of the Palm Commissioners of Palm Beach County legislative delegation. ~ Section 3: This Resolution shall take effect immediately upon passage. ~ \ PASSED AND ADOPTED by the City Council of the City of Boynton Beach, Florida, this .... day of ~7~ / 1983.
