A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF BOYNTON BEACH, FLORIDAr APPROVING
AND AUTHORIZING THE EXECUTION OF THE 911
MUTUAL AID AGREEMENT BETWEEN THE CITY OF
BOYNTON BEACH AND PALM BEACH COUNTY.
NOW~ THEREFORE, BE AND IT iS HEREBY RESOLVED BY THE
CITY COUNCIL OF THE CITY OF BOYNTON BEACH, FLORIDA:
Sectio~ 1. That the Mayor and City Clerk are hereby
authorized and directed to execute on behalf of the City of
Boynton Beach, Ftorida~ the 911 Mutual Aid Agreement between
The City of Boynton Beach and Palm Beach County.

PALM BEACH COUNTY, FLORIDA.
THIS AGRFJV.,K~T is made and entered into on this 3rd day of
, 1983_, by and between PAL~~, BEACH COUrt,fY, a political
subdivision of the State of Florida, herein referred to as "COUNTY," the
PAI2JI BEACH COUNR~f SHERIFF'S OFFICE, herein referred to as SHEP~FF," and
the ~-'~nicipalities of Atlantis, Belle Glade, Greenacres, Jupiter, Lake
Park, Lake Worth, Lantana, ~na!apan, North PaLm Beach, Ocean Ridge,
Pmhokee, Palm Beach, Palm Beach Gardens, Palm Beach Shores, Palm
Springs, Riviera Beach, South Bay, Tequesta, and West Palm Beach, along
with the Municipalities of Boca Raton, Boynton Beach, Delray Beach,
~i~end Beach, and Gulf Stream, which have collectively formed the
S~u+~h county cooperative Dispatch Center, an intergovenmrental entit]~
created pursuant to Section 163.01, Florida Statutes, for the purpose of
participating in the E-911 System.
WITNESSETH:
WYqERFAS, the Parties hereto desire to implement Chapter
365.171, Florida Statutes, relating to a State-wide. Emergency Telephone
N~.L~er "911" System Plan; add
WHEREAS, the Parties hereto desire to ensure that all of their
citizens receive emergency services in time of need; and
WHEP~AS, the Parties hereto desire to lay a framework of
reslkonsibilities necessary to implement this County-wide Program;
NOW, Th~REFORE, IN CONSIDERATION of the mutual obligations
here-;.nafter set forth, the Parties hereto agree as follows:
1. PURPOSE
The prima~f purpose of this Agreement is to specify the
app~-~priate actions to be taken by the Participant in the County-wide
E-9!t System in the event that an emergency call relating to public
safety is manually or electronically misrouted to the improper Public
safety Answering Point. Further, this Agreement is intended to ensure
that E-911 participants cooperate in providing the necessary data
pe~'~caining to changes in nmnicipal boundaries and layouts w.hich occur as
a result of annexation, deannexation, or land development of any kind.
2. RELATIONSHIP OF PARTIES
Each Party to this Agreement operates as a Public Safety
Answering Point in the E-911 System (hereinafter called PSAP), smd does
receive or shall be receiving e~ergency calls relating to public safety
as those calls are routed through the central E-911 S%~itching System
operated by the Southern Bell Telephone Company. After receiving a
properly routed emergency call, each PSAP shall attempt to dispatch that
call to the appropriate agency or agencies.
3. RECO(R~ITION OF ERROR
Ail Parties to this Agreement recognize that there is a slight
poss~_ollzty that a call for emergency service may be inadvertently
~ -~ou~ by reason of an electronic or manual error to the wrong PSAP.
4. b~ISROUTED EMERGENCY CALLS
(A) To ensure that the citizen iD_ need receives the
fastest possible response tiwe, all Parties herein agree to
immediately, upon the determination that a call for assistance
has been misrouted, to attempt to transfer or conference such
caller to the appropriate PSAP, or refer the appropriate
J~nformstion to the appropriate PSAP.
(B) In those instances where a determination that the
call is misrouted is not or cannot be made until after the
receiving PSAP has terminated the phone connection with ~-he
caller or has dispatched one of its public safety units, or
both, that PSAP shall immediately attempt to contact the
appropriate PSAP, and provide it with at least the information
given by the caller.
(C) Each PSAP agrees to establish necessa~ procedures or
enter into necessary agreements with the Public Safety
Agencies operating within its jurisdiction to ensure the
timely detection of misrouted calls and facilitate the rerout-
lng of the information to the appropriate PSAP as required by
paragraph 4 (B).
5. EACH P~f TO BEAR~NNCOSTS AND EX!~ENSES
NO Party to. this Agree~ent shall charge another for rendering
the services or actions required by this Agreement, nor shall there be
reimbursement or liabiliby from one Party to another for any loss or

damage of any kind whatsoever resulting from good faith actions related
to this Agreement. Nothing in this paragraph, however, is intended to
relieve a Party from liability which may result from the %.{illful, wanton
or reckless actions of an officer, agent, or employee.
6. MAINTEN3~ OF DATA BASE
All Parties agree that the effective operation of the E-9tl
System recfaires the accurate maintenance of a o~q~rehensive locational
data base to ensure precise operation of the master switching equipment. '
As the County is the implementing agency responsible for supplying
relevant boundary and location data to Southern Bell Telephone Company,
all Parties agree to cooperate fully in this regard by supplying to the
Co~m~ty_ on at least a quarterly basis all relevant information of any
cli~nges concerning street additions and creations resulting frcm new
l~%d developn-ent, street name changes, municipal boundary changes, ~nd
other pertinent information as may be reasonably available to the
reo?ective Parties. The County Shall also promulgate the data required
by ~n~s paragraph with respect to unincorporated areas and the en~re
data shall then be made reasonably available for inspection and consul-
tation by interested Parties to this Agreement. Further, each Party
agrees ~aintain procedures necessary for the continuous communication of
such data.
7, 911 FOR ~ERGENCY USE O~LY
Recognizing the potential for interference with the effective
operation of the 911 System which may result from um~ecessary or
non-~rgen~3 use, all Parties agree to preserve the integrity of the
911 System by actively discouraging such calls through the maintenance
of traditional non-emergency telephone numbers, and the dissemination of
public information as may be necessary to distinguish the two systmms.
8. A~NDME~f, MODIFICATION, RESCISSION, OR NOTIFICATION
This Agreement may be modified or amended by %~itten addendum
only, effective upon the joinder of all Ps=~ties hereto at the time of
~e proposed change. Any Party may be discharged frc~ responsibility
under this Contract and no longer be a Party hereto, upon the withdrawal
of participation in the County-wide E-91t System. All parties to this
agreement shall be notified by Palm Beach County if and when any PSAP(s)
withdraw(s) from the Countywide E-9!! System.

9. INCLUDING ADDITIONAL PUBLIC SERVICE ANSWE2RZNG POINT(S)
Not withstanding the foregoing, PALM BEACH COUNTY may allow the
joinder of additional Public Safety Answering Point (s) in the
Counby~ide E-911 System. without obtaining the consent of %he Parties to
this Agreement. Additional Public Safety Answering Points shall be
required to execute a counterpart agreement identical to this Agreement
with Palm Beach County. All parties to this Agreement shall be notified
by Palm. Beach County if and when an additional Public Safety Answering
PoLnt(s) are joined in the County-wide E-911 System.
10. EXECUTION BY RESOLUTION
The Parties hereto shall join and execute this Agreerpent by the
-Adoption._ of a formal resolution of the governing body of each such
Pa~Jy, which incorporates the terms of this Agreement and attaches a
copy t2~ereto.
11. EFFECTIVE DATE: TERM
· i-~e effective date of this Agreement shall be. upon the execution
and joinder of all parties listed herein, or upon the official date of
~i~...w~ntation of the Palm Beach County expanded 911 System, whichever
cco2rs soor~r. The term of this Agreement shall be perpetual, or until
such'tLmes as the operating parameters of the E-911 System make such an
Agreement unnecess~ary.
