AN ORDINANCE OF THE CITY OF BO~TON BEACH
A~IENDING ORDINANCE #220 OF Tk~ SAID CiTY
REGULATING THE ERECTION, LICENSING, LOCATION
AND CONTROL OF GASOLINE FILLING STATIONS
NITHIN THE CITY LI~ITS OF THE CITY OF BOYNTON
BEACH, REPEALING ALL ORDINANCES OR PARTS OF
ORDINANCES IN CONFLICT P~REWITH AND PROVIDING
PENALTY FOR VIOLATION HEREOF.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BOYNTON BF~CH,
FLORIDA:
Section 1. Definitions: Gasoline and oil
filling stations are hereby d~fi~ed to mean anybusiness' wherein
bulk gasoline, oil and petroleum products are stored for sale to
the general public as retail or wholesale sale.
Distances: For the purpose of this
ordinance in measuring'distanCes between location or establish-
ment of gasoline filling stations, the point of measurement shall
be defined as the center of the principal building or improvement
located on the parcel of land in question.

through which gasoline or oil can be dispensed.
Section 2. No gasoline and oil filling stations or
service stations for dispensing such products shall~be erected
or located within ~00 yards of any church, hospital, school or
other instituli6n where large number of persons congregate nor
within ~00 yards of the location of another gasoline and oil
filling station or service station that is located on the same
side of the street. Establishing distances between gasoline and
oil filling stations shall apply Separately to~ each side of the
right of w ~
ay of the highway upon which said gasoline filling
station is facing.
Section 3. It shall be unlawful for any person, firm
or corporation to locate or cause to be located any qasoline
pump, oil pump, grease pump or compressed air statioD wifhin
I0 feet of the right of~ way line, and that the said location
of such gasoline pump, oil pump, grease pump or compressed air
station shall be located in such a manner so as the vehicle
being serviced shall not encroach upon any public right of way.
Section ~. Separability. Each of the Provisions of
this ordinance are inseparable including word, clause, phrase
or sentence and if any provisions shall be declaredinvalld,'
the remaining portion shall not be effected but shall remain in
force '~and effect.
Sec±ion $. Repealing provisions. Ail ordinances or
parts of ordinances in conflict herewith are hereby repealed.
Section 6. Pena!~ies. Any person, firm or
corporation convicted of the vilation of any of the terms or
provls~ons of this ordinance may be fined in a sm~ ~ot to exceed
~$00.00 or may be imprisoned f?r jot more than 90 days or may
be both fined and imprisoned wl±hzn the discretion of the Trial
Court.
