R24-221 1 RESOLUTION R24-221 2 3 A RESOLUTION OF THE CITY OF BOYNTON BEACH, FLORIDA 4 ADOPTING A FINAL MILLAGE RATE FOR THE CITY'S GENERAL 5 OPERATING FUND FOR THE FISCAL YEAR BEGINNING 6 OCTOBER 1, 2024 AND ENDING SEPTEMBER 30, 2025, 7 PROVIDING THAT FINAL MILLAGE RATE OF 7.800 MILLS IS 8 5.08% ABOVE THE ROLLED-BACK RATE OF 7.4229 MILLS; 9 PROVIDING FOR SEVERABILITY, CONFLICTS, AND PROVIDING 10 AN EFFECTIVE DATE. 11 12 WHEREAS, a final budget has been prepared estimating expenditures and revenues 13 of the City of Boynton Beach, Florida, for the ensuing year, with detailed information, 14 including revenues to be derived from sources other than ad valorem levy, and the 15 administrative staff of the City has made recommendations as to the amount necessary to 16 be appropriated for the ensuing year; and 17 WHEREAS, the City Commission has given notice of and conducted the public 18 hearings required by law and has considered the recommendations of staff and the 19 comments of the public, the suggested budget, and the proposed millage necessary to be 20 levied to carry on the government of the City for the ensuing year; 21 WHEREAS, the City of Boynton Beach, Florida, has followed the procedures as 22 outlined in Section 200.065, Florida Statutes. 23 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF 24 BOYNTON BEACH, FLORIDA THAT: 25 Section 1. The foregoing "Whereas" clauses are hereby ratified and confirmed as 26 being true and correct and are hereby made a specific part of this Resolution upon adoption 27 hereof. 28 Section 2. The City Commission of the City of Boynton Beach, Florida, hereby 29 adopts the final millage rate of 7.800 for the General Fund for the fiscal year beginning October 30 1, 2024, and ending September 30, 2025. The final millage rate is 5.08% above the computed 31 rolled-back rate of 7.4229. Such millage shall be levied upon the dollar amount of the assessed 32 valuation of all non-exempt taxable property in the City of Boynton Beach, Florida, as returned 33 by the Palm Beach County Property Appraiser as shown on the assessment roll for the City, 34 allowing homestead and other lawful exemptions. All such taxes so specified and levied are 35 ordered extended upon the assessment roll to show the tax attributable to all taxable property, 36 and shall be collected by the Palm Beach County Tax Collector as provided by law. 37 Section 3. Pursuant to Section 200.065 (5), Florida Statutes, the City Manager, or 38 in his absence, the Finance Director, is hereby authorized, but not required, to adjust the 39 adopted millage rates set forth herein if the taxable value within the jurisdiction of the City of 40 Boynton Beach, as certified by the Property Appraiser, is at variance by more than one percent 41 from the taxable value shown on the assessment roll to be extended, such that the taxes 42 computed by applying the adopted rate against the certified taxable value are equal to the 43 taxes computed by applying the adjusted adopted rate to the taxable value on the roll to be 44 extended, except that no adjustment shall be made to levies required by law to be a specific 45 millage amount. The City Manager or Finance Director shall certify to the property appraiser 46 the adjusted adopted rate not later than three days after receipt of notification from the 47 Property Appraiser of the aggregate change in the assessment roll and taxable value, if any, 48 from that certified. 49 Section 4. The required Florida Department of Revenue (DOR) forms may be 50 signed by the City Manager or Finance Director, either in paper form and/or electronically 51 utilizing the DOR eTRIM system. 52 Section 5. The Finance Director shall provide a certified copy of this Resolution 53 to the Property Appraiser and Tax Collector within three (3) days after the adoption of this 54 Resolution. 55 Section 6. If any clause, section, or other part of this Resolution shall be held by any 56 Court of competent jurisdiction to be unconstitutional or invalid, such unconstitutional or 57 invalid part shall be considered as eliminated and shall in no way affect the validity of the 58 other provisions of this Resolution. 59 Section 7. All resolutions or parts of resolutions in conflict herewith are hereby 60 repealed to the extent of such conflict. 61 Section 8.
