R24-143 2 3 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOYNTON 4 BEACH, FLORIDA, APPROVING THE CONTINGENT SETTLEMENT 5 AGREEMENT AND RELEASE IN THE MATTER OF ANTHONY VERRIGNI V. 6 CITY OF BOYNTON BEACH AND COMMERCIAL RISK MANAGEMENT, INC., 7 OJCC CASE NO. 23-021760BKC CLAIM NO.06340022, IN THE AMOUNT OF 8 $119,450.67; AUTHORIZING COUNSEL FOR THE CITY TO EXECUTE A 9 CONDITIONAL SETTLEMENT AGREEMENT ON BEHALF OF THE CITY AND 10 SUBMIT THE CONDITIONAL SETTLEMENT TO THE JCC FOR APPROVAL; 11 PROVIDING AN EFFECTIVE DATE;AND FOR ALL OTHER PURPOSES. 12 13 WHEREAS, the Code of Ordinances of the City of Boynton Beach, Florida, requires 14 settlement of all claims in excess of $50,000 to be approved by the City Commission; and 15 WHEREAS, Anthony Verrigni ("Claimant") brought a claim for workers' compensation 16 stemming from a work-related accident that occurred while in the course and scope of 17 employment on or about January 12, 2021, to wit: Anthony Verrigni v City of Boynton Beach and 18 Commercial Risk Management, Inc., in the State of Florida, Division of Administrative Hearings, 19 Office of Judge of Compensation Claims Claim No.: 23-021760BKC, Claim No. 06340022; and WHEREAS, a Contingent Settlement Agreement and Release was reached with the 21 Claimant for a total amount of $119,450.67 in exchange for a general release of all claims, 22 including all attorney's fees and costs; and 23 WHEREAS, the City Commission of the City of Boynton Beach, Florida, deems it to be in 24 the best interest of the citizens and residents of the City of Boynton to approve the Contingent 25 Settlement Agreement and Release in the amount of $119,450.67 in the matter of Anthony 26 Verrigni v. City of Boynton Beach and Commercial Risk Management, Inc. and authorize counsel 27 for the City to execute the Conditional Settlement on behalf of the City and submit it to the Judge 28 of Compensation Claims for approval. 29 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF BOYNTON 30 BEACH, FLORIDA, THAT: 31 SECTION 1. The foregoing "Whereas" clauses are hereby ratified and confirmed as 32 being true and correct and are hereby made a specific part of this Resolution upon adoption 33 hereof. 14 SECTION 2. The City Commission of the City of Boynton Beach hereby approves the 35 Contingent Settlement Agreement and Release in the amount of $119,450.67 in the matter of 36 Anthony Verrigni v. City of Boynton Beach and Commercial Risk Management, Inc., attached as 37 "Exhibit A" and "Exhibit B." 38 SECTION 3. The City Commission of the City of Boynton Beach directs counsel for the 39 City to execute the Contingent Settlement Agreement on behalf of the City, submit it to the JCC 40 for approval, and provide copies of the fully executed Contingent Settlement Agreement, Release, 41 and Final Order Approving Settlement to the City Clerk. 42 SECTION 4. The fully executed Contingent Settlement Agreement, Release, and Final 43 Order Approving Settlement shall be retained by the City Clerk as a public record of the City. 44 SECTION 5.
