Director Stone clarified outside storage in a rear yard cannot be viewed by anyone per City ordinances and codes. She emphasized that the code applies to all residents. Attorney Weiner referenced state statute and argued the tiki hut does not need a permit. He added that the tiki hut was hardly visible from the public roadway. He explained the setback was unique to this property and a variance was not possible. He argued the original builder installed the tiki hut without the correct setbacks and they have worked with the City for a reasonable accommodation. Attorney Weiner requested a 12-month extension in order to continue to work with the City. A copy of the original notice of violation with the date was presented to Attorney Weiner. The notice was issued on September 26, 2022 with compliance by October 2022. Ms. Zalman asked Officer Guillaume for his opinion on an extension request. Officer Guillaume recommended a 90-day extension. Ms. Zalman agreed.
