3 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOYNTON
4 BEACH, FLORIDA, APPROVING THE DISPOSITION OF LAND FOR THE
5 USPS PROJECT BY THE BOYNTON BEACH COMMUNITY
6 REDEVELOPMENT AGENCY TO MAPLE TREE INVESTMENTS, LLC, OF
7 PROPERTY LOCATED AT 401 E. BOYNTON BEACH BLVD., 407 E.
8 BOYNTON BEACH BLVD., AND 411 E. BOYNTON BEACH BLVD., FOR A
9 PURCHASE PRICE LESS THAN FAIR MARKET VALUE; AND FOR ALL
10 OTHER PURPOSES.

12 WHEREAS, pursuant to section 163.380, Florida Statutes, in the event the value of such
13 real property being disposed of is for less than the fair value, such disposition shall require the
14 approval of the governing body, which approval may only be given following a duly noticed public
15 hearing; and
16 WHEREAS, the Boynton Beach Community Redevelopment Agency ("CRA") Board
17 approved the Purchase and Development Agreement for the sale and development of the CRA
18 property located at 401 E. Boynton Beach Blvd., 407 E. Boynton Beach Blvd., and 411 E. Boynton
19 Beach Blvd.; and
20 WHEREAS, the property appraised at$917,000.00, and the Board approved the sale of the
21 property to Maple Tree Investments, LLC for $817,000.00 for the construction of a new USPS retail
22 site; and
23 WHEREAS, since the sale amount is below fair market value, the City Commission, as the
24 governing body, is required to approve the disposition; and
25 WHEREAS, the City Commission, upon the recommendation of staff, has deemed it in the
26 best interests of the city's citizens and residents to approve the disposition of land for the USPS
27 Project by the Boynton Beach Community Redevelopment Agency to Maple Tree Investments,
28 LLC of property located at 401 E. Boynton Beach Blvd., 407 E. Boynton Beach Blvd., and 411 E.
29 Boynton Beach Blvd., for a purchase price less than fair market value.

31 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF BOYNTON
32 BEACH, FLORIDA, THAT:
33 SECTION 1. The foregoing "Whereas" clauses are hereby ratified and confirmed as
34 being true and correct and are hereby made a specific part of this Resolution upon adoption.
35 SECTION 2. The City Commission of the City of Boynton Beach, Florida, does hereby
36 approve the disposition of land for the USPS Project by the Boynton Beach Community
37 Redevelopment Agency to Maple Tree Investments, LLC of property located at 401 E. Boynton
38 Beach Blvd., 407 E. Boynton Beach Blvd., and 411 E. Boynton Beach Blvd., for a purchase price less
39 than fair market value.
40 SECTION 3. The City Commission of the City of Boynton Beach, Florida, hereby
41 authorizes the Mayor to execute any document as may be necessary to accomplish the purpose
42 of this Resolution.
43 SECTION 4. This Resolution shall take effect in accordance with law.
