82-NNNA RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BOYNTON BEACH, FLORIDA, STATING THE AGGREGATE MILLAGE RATE TO BE LEVIED AGAINST PROPERTY OWNERS WITHIN THE CITY FOR THE 1982- 1983 FISCAL YEAR; PROVIDING THAT THE CITY MA.NAGER_SPIALL HAV~ THE ~AUT~ORITY TO ADJUST THE AGGREGATE MILL~GERA, TE'_UPON RECEIPTOF T~EFINAL TAX ROLL; PROVII)~iNG~FOR AN EFFECTTVE DATE AND FOR OTHER PURPOSES. WHEREAS, Florida Statutes Section 200.065(2) (d) requires that prior to the adoption of the final budget that a resolution stating the aggregate millage rate proposed by the municipality be passed; and WHEREAS, said resolution must also state the per cent of increase in property taxes adopted by the governing body; and WHEREAS, said aggregate millage rate must be adOpted separately and before the budget of the community; and WHEREAS, the City of Boynton Beach, Florida, has followed the procedures as outlined in Florida Statutes Section 200.065; and WHEREAS, Florida Statutes Section 200.065(5) provides for a ministerial adjustment of the aggregate millage rate after receipt of the final tax roll. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BOYNTON BEACH, FLORIDA: Section 1. That the City Council of the City of Boynton Beach, Florida, hereby adopts ~,/~2_~__ mills as the official millage rate of the City for the 1982-1983 fiscal year. Section 2. That in accordance with Florida Statutes Section 200.065, the City Council of the City of Boynton Beach, Florida, hereby states that said millage does not exceed the rolled back rate as defined by Florida Statutes Section 200.065. -1- Section 3. That upon receipt of the final tax roll if said roll indicates that the certified taxable value within the district is at a variance by more than 3% from the original tax roll presented to the City by the property appraiser's office, that the City Manager shall within three (3) days make the ministerial adjustment to the aggregate millage rate to assure that the same amount of taxes shall be collected by the City. Said adjustment shall be reported to the property appraiser within three (3) days of receipt of the final tax roll. Section 4. upon its passage. PASSED AND ADOPTED this -~'~ 1982.
