R24-247 2 3 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOYNTON BEACH, 4 FLORIDA, APPROVING THE PALM BEACH COUNTY CONSENT FORM FOR THE 5 REZONING OF CYPRESS CREEK PLANNED UNIT DEVELOPMENT;AND FOR ALL OTHER 6 PURPOSES. 7 8 WHEREAS, Boynton Beach Utilities has many lift stations within Cypress Creek Golf Course. 9 The rezoning of the site is approved by Palm Beach County, and it is now Cypress Creek PUD. 10 Because the lift stations are contiguous to the property of the overall PUD (Planned Unit 11 Development), the City's consent is required for every application they submit to Palm Beach 12 County. While the project is not affecting or impacting the lift stations, they must be included 13 within the overall body of the developer's application due to their location; and 14 WHEREAS, the City Commission, upon the recommendation of staff, has deemed it in the 15 best interests of the city's citizens and residents to approve the Palm Beach County consent form 16 for the rezoning of Cypress Creek Planned Unit Development. 17 18 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF BOYNTON 19 BEACH, FLORIDA, THAT: 20 SECTION 1. The foregoing "Whereas" clauses are hereby ratified and confirmed as 21 being true and correct and are hereby made a specific part of this Resolution upon adoption. 22 SECTION 2. The City Commission of the City of Boynton Beach, Florida, does hereby 23 approve the Palm Beach County consent form for the rezoning of Cypress Creek Planned Unit 24 Development, in form and substance similar to that attached as "Exhibit A." 25 SECTION 3. The City Commission of the City of Boynton Beach, Florida, hereby 26 authorizes the Mayor or City Manager to execute the Form and any ancillary documents as may 27 be necessary to accomplish the purpose of this Resolution. 28 SECTION 4. A copy of the fully executed Form shall be retained by the City Clerk as a 29 public record of the City. The fully executed original of the Form shall be provided to Milot Emile 30 for further handling. 31 SECTION 5.
