A RESOLUTION OF TI-L[ CITY COUNCIL OF ~ CITY
OF BOYNTON BEACH, FLORIDA, REQUESTING PERMISSION
FROM THE BOARD OF COUNTY COMMISSIONERS, PURSUANT
TO.FLORIDA STATUTES 171.062, TO REZONE LA_ND TO
BE AATNEXED TO T~E CITY OF BOY'TON BEACH FROM THE
COUNTY ZONING CLkSSIFICATION CG (GENERAL COMMERCIAL
DISTRICT) TO THE CITY'S ZONING CLASSIFICATION C~'3
(COMMUNITY COMMERCIAL DISTRICT).
WHEREAS, the City of Boynton Beach, Florida, de~lres to
~nnex the tract of land more particularly described in the attach-
sd Exhibit A, which is hereby made a part hereof to its municipal
limitations.
WHEREAS, the City Council at its Regular Meeting on
February 19, 1980 considered this annexation request and determine,
zhat the proper City zoning for this parcel would be C-3 (Community
~ommercial District) which is similar in form and intentJwith t~e~
current Palm Beach County Zoning Classification CG (General
Commercial District) and;
W}IEREAS, based on an analysis and report prepared by the
2ity Planner, the City Council has determined that there is no
~onflict in future land use between the Boynton Beach Zoning
~lassification C-3 (Community Commercial District) and the Palm
Beach County adopted Future Land Use Plan and;
WHEREAS, Chapter 171.062 Florida Statutes impl.ie~ that i~
zhe spirit of Intergovernmental Coordination a municipality notify
~he Board of County Commissioners of its intent to annex property
to ~ts corporate limits and zone it accordingly even though said
zoning classification does not increase the intensity of land use
)ermitted under the adopted County Future Land Use Plan.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THEI
2ITY OF BOYI~TON BEACH, FLORIDA, AS FOLLOWS:
Section 1: That the City Council of the City of Boynton
Beach, Florida, hereby ~equests permission from the Palm Beach
~ounty Board of County Commissioners to zone, when annexed, the
roperty herein described C-3 (Community Commercial District) which
;ill not result ~n an increase in the intensity of ~and cse allow-
ed on said land as related to the a~o~p~e~ Future Land Use element.

Section 2: That a certified copy of this resolution is
being sent to each mem3oer of the Board of County Commission~rs~
the County Administrator and the Director of Planning, Zoning and
Building.

Less and not including the right-of-way for Gulfstream B6utevard
