3 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOYNTON
4 BEACH, FLORIDA, DESIGNATING THE PALM BEACH COUNTY
5 SUPERVISOR OF ELECTIONS AS THE CITY'S CANVASSING BOARD FOR
6 THE MARCH 2025 MUNICIPAL ELECTION; AND FOR ALL OTHER
7 PURPOSES.

9 WHEREAS, the Palm Beach County Supervisor of Elections requires that the City
10 Commission designate, by Resolution, a Canvassing Board for the City Municipal Elections; and
11 WHEREAS, designating the Palm Beach County Supervisor of Elections as the City's
12 Canvassing Board for Municipal Elections would remove redundancy of Officials attending to the
13 same election activities such as the pre-election testing of tabulation equipment, and opening,
14 tabulation, duplication, and the canvassing of ballots and is the preference of the Supervisor of
15 Elections; and
16 WHEREAS, the City Commission has determined that the responsibility to "canvass the
17 returns" is a ministerial and non-legislative function that can be delegated by the City Commission;
18 and
19 WHEREAS, the City Commission, upon the recommendation of staff, has deemed it in the
20 best interests of the city's citizens and residents to designate the Palm Beach County Supervisor
21 of Elections as the City's canvassing board for the March 2025 municipal election.

23 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF BOYNTON
24 BEACH, FLORIDA, THAT:
25 SECTION 1. The foregoing "Whereas" clauses are hereby ratified and confirmed as
26 being true and correct and are hereby made a specific part of this Resolution upon adoption.
27 SECTION 2. The City Commission of the City of Boynton Beach, Florida, does hereby
28 designate the Palm Beach County Supervisor of Elections as the City's canvassing board for the
29 March 2025 municipal election. The Canvassing Board will handle the canvassing of ballots for the
30 general municipal election and for runoff elections, if necessary.
31 SECTION 3. The City Commission of the City of Boynton Beach, Florida, hereby
32 authorizes the Mayor to execute any ancillary documents as may be necessary to accomplish the
33 purpose of this Resolution.
34 SECTION 4. If any clause, section, or other part or application of this Resolution shall be
35 held by any court of competent jurisdiction to be unconstitutional or invalid, such unconstitutional
36 or invalid part or application shall be considered as eliminated and so not affecting the validity of
37 the remaining portions or applications remaining in full force and effect.
38 SECTION 5. The City shall indemnify and hold harmless the members of the canvassing
39 board in the event either or both are the subject of litigation arising from their duties as canvassing
40 board members.
41 SECTION 6. This Resolution shall take effect in accordance with law.
