R25-022 2 3 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOYNTON 4 BEACH, FLORIDA, RATIFYING THE CONFUCT OF INTEREST WAIVER 5 RELATING TO WEISS SEROTA, ET AL.'S REPRESENTATION OF THE CITY OF 6 BOCA RATON IN CONNECTION WITH MELISSA LAVAGLIO V. CITY OF BOCA 7 RATON, CITY OF BOYNTON BEACH, ET AL., CASE NO. 9:24-CV-81352, IN 8 THE UNITED STATES DISTRICT FOR THE SOUTHERN DISTRICT OF FLORIDA, 9 AND WAIVE ANY CLAIM OF CONFUCT ARISING FROM SUCH 10 REPRESENTATION; PROVIDING AN EFFECTIVE DATE; AND FOR ALL OTHER 11 PURPOSES. 12 13 WHEREAS, the City of Boynton Beach is represented by Weiss Serota Helfman Cole and 14 Bierman P.A. (the "firm") as Outside Counsel for Labor and Employment investigations; and 15 WHEREAS, the firm desires to represent the City of Boca Raton in regard to in connection 16 with MELISSA LAVAGLIO v. CITY OF BOCA RATON, CITY OF BOYNTON BEACH, ET AL., Case No. 17 9:24-CV-81352, in the United States District for the Southern District of Florida. The firm requests 18 that the City of Boynton Beach waive any potential conflict and has stated that it is able to provide 19 competent and diligent representation to both the City of Boynton Beach in unrelated matters 20 and the City of Boca Raton in the matter described herein; and 21 WHEREAS, the City of Boynton Beach desires to waive the potential conflict of interest 22 between the City of Boynton Beach and the firm; and 23 WHEREAS, the Commission, upon recommendation of staff, has deemed it to be in the 24 best interests of the citizens and residents of the City to waive a potential conflict of interest 25 relating to the firm's representation of the City of Boca Raton in regards to MELISSA LAVAGLIO v. 26 CITY OF BOCA RATON, CITY OF BOYNTON BEACH, ET AL., Case No. 9:24-CV-81352. 27 28 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF BOYNTON 29 BEACH, FLORIDA, THAT: 30 SECTION 1. The foregoing "Whereas" clauses are hereby ratified and confirmed as 31 being true and correct and are hereby made a specific part of this Resolution upon adoption. 32 SECTION 2. The City Commission of the City of Boynton Beach, Florida, does hereby 33 waive the potential conflict of interest between the City and the firm and ratifies the Conflict of 34 Interest Waiver as provided in the waiver attached hereto as Exhibit A. 35 SECTION 3. The City Commission of the City of Boynton Beach, Florida, hereby ratifies 36 the City Attorney's execution of the written waiver. 37 SECTION 4.
