3 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOYNTON
4 BEACH, FLORIDA, APPROVING A SUBSTANTIAL AMENDMENT TO THE
5 COMMUNITY DEVELOPMENT BLOCK GRANT, FISCAL YEAR 2022;AND
6 AUTHORIZING THE MAYOR TO EXECUTE THE REQUIRED HUD FORMS
7 AND CERTIFICATIONS;AND FOR PROVIDING AN EFFECTIVE DATE.

9 WHEREAS, the City of Boynton Beach receives an annual allocation of federal Community
10 Development Block Grant ("CDBG") funding from the U.S. Department of Housing and Urban
1 ► Development ("HUD"); and
12 WHEREAS, City staff proposes a substantial amendment to its HUD Fiscal Year 2022
13 Program year to reprogram unused funds; and
14 WHEREAS, City staff proposes to amend CDBG Fiscal Year 2022 Annual Action Plan to
15 reprogram $503,484.97 of unused funds from a canceled CDBG Public Facilities and Improvements
16 funded project, the Hester Center Airnasium; and
1? WHEREAS, a substantial plan amendment is required when significant changes are
18 identified for any new projects or current projects that require a change in the budget amount in
19 excess of fifty percent (50%); and
20 WHEREAS, HUD recommended to City staff that funds be reprogrammed to meet the
21 timely performance of CDBG funds; and
22 WHEREAS, City staff recommends that the City Commission reprogram funds on two
23 Public Facilities and Improvement projects, to wit: Galaxy Park Lighting Improvements in the
24 amount of $567,482.17 and the acquisition of Real Property located at 235 SW 6th Avenue,
25 Boynton Beach, Florida 33435 in the amount of $300,000; and
26 WHEREAS, the two aforementioned activities are eligible under 24 C.F.R. 570.201(c) and
27 meets the national objective under C.F.R. 570.208(a)(1)(i); and
28 WHEREAS, approval of the amendments will continue to promote the improvement of
29 living environments primarily for low-income households and neighborhoods through Public
30 Facilities and Improvements Projects; and
31 WHEREAS, the City Commission, upon the recommendation of staff, has deemed it in the
32 best interests of the City's citizens and residents to amend the Fiscal Year 2022 budget as explicitly
33 noted in "Exhibit A."
34 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF BOYNTON
35 BEACH, FLORIDA, THAT:
36 SECTION 1. The foregoing "Whereas" clauses are hereby ratified and confirmed as
37 being true and correct and are hereby made a specific part of this Resolution upon adoption.
38 SECTION 2. The City Commission of the City of Boynton Beach, Florida, does hereby
39 approve the Substantial Amendment to the CDBG Program, as further described in "Exhibit A"
40 attached hereto.
41 SECTION 3. The City Commission of the City of Boynton Beach, Florida, authorizes the
42 Mayor to execute any HUD forms and certifications necessary to effectuate the intent of this
43 Resolution.
44 SECTION 4. This Resolution shall take effect as provided by law.

Community Development Block Grant (CDBG) Program
Annual Action Plan Substantial Amendment—FY 2022
Annually, the City of Boynton Beach (the City) receives an allocation of federal Community Development
Block Grant (CDBG) grant funding from the U.S. Department of Housing and Urban Development (HUD).
Staff proposes to do a Substantial Amendment to its HUD FY 2022 Program Year to reprogram unused
funds.
A substantial plan amendment is required when significant changes are identified for any new projects
or current projects that require a change in the budget amount in excess of 50 percent. Staff is
proposing to amend CDBG FY 2022 Annual Action Plan to reprogram $503,484.97 of unused funds from
a cancelled CDBG Public Facilities and Improvements funded project (Hester Center Airnasium).These
funds are coming from the following years:
Prior Year Resources
FY 2020 $258,540.18
FY 2021 $6,684.62
FY 2022 $238,260.17
Total $503,484.97
HUD recommended staff to reprogram these funds to meet the timely performance of CDBG funds. Staff
is recommending City Commission to reprogram these funds on two Public Facilities and Improvements
projects:
1. Galaxy Park Field Lighting Improvements—$567,482.17
The original price assessment for this project was$450,000.00 of which $363,997.20 to be
funded with CDBG funds and $86,002.80 from Park Impact Fee approved by Resolution R24-089.
The Galaxy Park improvement project went out for bid, the lowest bid proposal is $515,892.88
plus 10% contingency$51,589.29 totaling$ 567,482.17. Staff is recommending to use
$567,482.17 of CDBG funds to pay fully for the Galaxy Park Field Lighting Improvements.
2. Acquisition of Real Property-$300,000.00
The City of Boynton Beach desires to purchase a property to construct a new park.The Property
is located at 235 SW 6th Avenue, Boynton Beach, Florida 33435. Staff is recommending to use
$300,000.00 of CDBG funds to pay for this purchase.
These are two eligible activities per 24 CFR 570.201(c) and meets the National objective under
570.208(a)(1)(i)
