AN ORDINANCE OF THE CITY COMMISSION OF
THE CITY OF BOYNTON BEACH, FLORIDA,
REGARDING THE STORAGE PARTNERS III LTD.
PROPERTY (IN BETWEEN FEDERAL HWY. AND OLD
DIXIE HWY, APPX. 600 FEET NORTH OF
GULFSTREAM BLVD.) AMENDING ORDINANCE 91-
70 OF SAID CITY BY REZONING CERTAIN
PARCELS OF LAND MORE PARTICULARLY
DESCRIBED HEREIN, FROM COUNTY CG (GENERAL
COMMERCIAL) TO C-3 (COMMUNITY COMMERCIAL)
AND C-4 (GENERAL COMMERCIAL); AMENDING
THE REVISED ZONING MAP ACCORDINGLY;
PROVIDING FOR CONFLICTS, SEVERABILITY AND
AN EFFECTIVE DATE.
WHEREAS, the City Commission of the City of Boynton
Beach, Florida has adopted Ordinance No. 91-70, in which a
Revised Zoning Map was adopted for said City; and
WHEREAS, the City Commission of the City of Boynton
iiBeach, Florida, in accordance with the Annexation Program, is
simultaneously herewith adopting an Ordinance annexing certain
parcels of land; and
WHEREAS, the City of Boynton Beach, in connection with
aforesaid Annexation Program, has heretofore filed a Petition,
pursuant to Section 9 of Appendix A-Zoning, of the Code of
Ordinances, City of Boynton Beach, Florida, for the purpose of
rezoning certain parcels of land consisting of approximately
3.52 acres located within the municipal limitS of said City,
said property being more particularly described hereinafter,.
from CG General Commercial to C-3 Community Commercial and C-4
General Commercial, which requests that the 3.52 acres of
property be removed from the boundaries of the CG zone to
allow for the processing of the rezoning application;
WHEREAS, the City Commission deems it in the best
interests of the inhabitants of said City to amend the
aforesaid Revised Zoning Map as hereinafter set forth.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF
THE CITY OF BOYNTON BEACH, FLORIDA, THAT:
Section 1: The following described land, located in the
City of Boynton Beach, Florida, to-wit:
A)
A parcel of land bound as follows: at
the North by the South boundary line of
Trade Winds Estates, amended Plat as in
Plat Book 21, at page 73, of the Public
Records of Palm Beach County, Florida; at
the South by a line parallel to and 250
feet South of said South line of Trade
Winds Estates; at the East by the West
line of U.S. Highway No. 1 right-of-way
being 100 feet; and at the West by the
East line of Old Dixie Highway right-of-
way being 30 feet lying east and adjacent
to the F.E.C. Railroad right~of-way being
100 feet; less the following parcels:
The South 125 feet of West 200 feet
thereof; the North 45 feet of South 125
feet of East 62 feet thereof; and the
North 125 feet of West 250 feet thereof.
Containing 2.81 acres more or less; and
be and the same is hereby rezoned from CG General Commercial
(County) to C-3 Community Commercial.
B)
A parcel of land in Section 4, Township
46 South, Range 43 East more particularly
described as follows: Beginning at the
Southwest corner of Trade Winds Estates,
amended Plat as in Plat Book 21, at page
73, of the Public Records of Palm Beach
County, Florida, thence going Easterly
along the South boundary line of said
Trade Winds Estates a distance of 200
feet to a point; thence Southerly making
an angle of 90° from the preceding line a
distance of 125 feet to a point; thence
Westerly making an angle of 90° from the
preceding line a distance of 250 feet to
the East line of Old Dixie Highway right-
of-way; thence Northerly along said East
line right-of-way a distance of 126.40
feet to a point; thence Easterly making
an angle of 98°33'12'' from the preceding
line a distance of 50 feet to the point
of beginning.
Containing 0.71 acre more or less.
be and the same is hereby rezoned from CG General Commercial
(County) to C-4 General Commercial. A location map is
attached hereto as Exhibit "A" and made a part of this
Ordinance by reference.
Section 2: That the aforesaid Revised Zoning Map of the
City shall be amended accordingly.
Section 3: Ail ordinances or parts of ordinances in
conflict herewith are hereby repealed.
Section 4:
Ordinance
Should any section or provision of this
or any portion thereof be declared by a court of
competent jurisdiction to be invalid, such decision shall not
affect the remainder of this Ordinance.
Section 5: This Ordinance shall
immediately upon its final passage.
