25-001 1 ORDINANCE NO. 25-001 2 3 AN ORDINANCE OF THE CITY OF BOYNTON BEACH, 4 FLORIDA, APPROVING THE ABANDONMENT OF THE 5 TWENTY-FOOT(20')WIDE ALLEY ABUTTING THE APPROVED 6 VILLAGES OF EAST OCEAN (NORTH) MIXED-USE 7 DEVELOPMENT AS RECORDED IN PLAT BOOK 1, PAGE 23 OF 8 THE PUBLIC RECORDS OF PALM BEACH COUNTY; 9 AUTHORIZING THE CITY MANAGER TO EXECUTE A 10 DISCLAIMER, WHICH SHALL BE RECORDED WITH THIS 11 ORDINANCE IN THE PUBLIC RECORDS OF PALM BEACH 12 COUNTY, FLORIDA; AND PROVIDING AN EFFECTIVE DATE. 13 14 WHEREAS,Applicant is requesting the abandonment of the remaining portion of the 15 twenty-foot (20') wide alley located between the Villages of East Ocean (North) and 401 E 16 Ocean Avenue, as recorded in Plat Book 1, Page 23 of the Public Records of Palm Beach 17 County, Florida, lying between Lots 6 and 7 of said Block 5; and 18 WHEREAS,staff has determined that the requested abandonment would not adversely 19 impact traffic or other City functions, and would not adversely impact other adjacent property 20 owners; and 21 WHEREAS, comments have been solicited from the appropriate City Departments, 22 and public hearings have been held before the City Commission on the proposed abandonment; 23 and 24 WHEREAS, staff has determined that the subject right-of-way no longer serves a 25 public purpose and therefore recommends approval of the request,subject to the accompanying 26 conditions. 27 NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF 28 THE CITY OF BOYNTON BEACH, FLORIDA THAT: 29 Section 1. The foregoing"Whereas"clauses are true and correct and incorporated 30 herein by this reference. 31 Section 2. The City Commission of the City of Boynton Beach, Florida, does 32 hereby abandon the twenty-foot (20') wide alley located between the Villages of East Ocean 33 (North) and 401 E. Ocean Avenue, as recorded in Plat Book 1, Page 23 of the Public Records 34 of Palm Beach County.
