79-MRESOLUTION NO. 79- ~ A RESOLUTION OF'THE CITY OF BOS1YiON BEACH, FLORIDA ~Ii~G P~RA~HS 5, 7 AND 9 OF SEL'f±ON 13 OF RULE 8 OF THE CIVIL SERVICE RIR~S AND REGULATIONS OF THE CITY OF BOY~ON BEAm, AND CREATING PAR~- GRAPH 11 OF SECTION 13 OF RULE 8 OF THE SAID CIVIL SERVICE I~DLES PROVIDII~G REQ~ CONCERNING PR~mT~ON~Z EX~NATZ~ FOR, CERTAIN POSIT~S n~ THE CITY FZPg DEP~i~qT, PROVIDZNG A REPEAn~ PROVISION, PROVIDING A SAVI~i]GS ClAuSE, PROVIDING ~iN E~'~'KCTIvE DAlE AiqD FOR OTHF~ PURPOSES. WH~RtEAS, pursuant to the Charter of the City of Boynton Beach, Florida, the Municipal Personnel Officer has heretofore recormnended certain amendments end additions to the rules and regulations of the civil service system of the City concerning promotional examinati~ for certain positions in the City Fire I~srtment; end ~_AS, the City M~nager has reviewed the said proposed amendments additions and has approVed them without modificanion; and WHEREAS, after a thorough review of said proposed amendments and addi- tions, the Council deems that the enactment and adoption of the same is in the best interests of the efficient administration of the municipal personnel system; NOW, THEREFORE. BE A~ IT IS ~K~EBY RESOLVED BY ~ CITY COUNCIL OF THE CITY OF BOYNTON BEACH, FLOILIDA, AS FOI2flgS: Section 1: That Paragraph 5 of Section 13 of Rule 8 of the City Civi[ Service Rules and Regulations be amended to read as follows: "5. No person shall be admitted to promotional exsmination for lieutenant until he shall have served a minimom of three (3) consecutive years on the local force and shall have earned at least twelve (12) college cre dits ~in the'~ major study area at an accredited junior college or upper level oniversity offering a degree program in fire engineering or fire science. Candidates mast also have completed all training requirements for fire fighter driver. ' ~ Section 2. That Paragraph 7 of Section 13 of Rnle 8 of the City Civil Service Roles and Regulations be amended to read as follows: "7. No person shall be sdm~tted to promotional examination for captain tntil he shall have served a mini~m~n of three (3) consecutive years as lieutenant on t~e local force, and shall have earned at least eighteen (18) college credits in the mai or study area at an .accredited junior college or upper level university offering a degree program in fire engineering or fire science, and shall have successfully completed specialized training programs conducted by the deparrm~n.t and the state fire eollege in fire in- spection detection and control, modern methods of fire fighting, public relations, administration end report analysis. ~' Section 3. That Paragraph 9 of Section 13 of Rule 8 of the City Civil Service Rules and Regulations be amended to read as follows: "9. No person shall be admitted to prcmotional examination for deputy chief until he shall have served a minimum of three (3) consecutive years as captain or in another rank of equal stature on the local force, and shall have earned at least forty-five (45) college credits toward a Bachelors Degree in Business Administration. Credits eazmed in fire engineering or fire science at an accredited junior college may be counted toward total credits required." Section 4. That Paragraph 11 of Section 13 of Rule 8 of the City Civil Service Rules and Regulations be created to read as follows: "11. In the event that circunstances or conditions arise that make it impossible to certify an individual fire officer or fire officers for entrance to promotional examinations for the next higher position because of lack of time-in-grade, and the waiver of such requirement is deemed essen- tial in order to efficiently administer the City's merit system, the City Manager may, at the request of the City Personnel Director, reconmend that time-in-grade requirements be waived by the City Council. Provided, however, that the applicant or applicants involved possess all other qualifications recked by these rules for promotion." Section 5. That all Resolutions and parts of Resolutions in conflict herewith, be ~nd the same are hereby repealed. Section 6. That should any section or provision of this Resolution, or part thereof, be declared by a Court of competent jurisdiction to be in- -2- valid, such decision shall not effect the validity of the remainder of the Rmsolution.
