3 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOYNTON
4 BEACH, FLORIDA, APPROVING THE WAIVER OF PROCUREMENT
5 PROCEDURES EXEMPTION AND AUTHORIZING A PURCHASE ORDER
6 TO ELK CREEK TRAILERS FOR TWO (2) ADA-COMPLIANT FIVE-
7 STATION PORTABLE RESTROOM TRAILERS FOR AN AMOUNT NOT TO
8 EXCEED $139,460.00; AND FOR ALL OTHER PURPOSES.

10 WHEREAS, the City requires two (2) ADA-compliant five-station portable restroom trailers
11 to enhance the accessibility and convenience of City-sponsored events; and
12 WHEREAS, City staff conducted an extensive procurement search through Sourcewell, a
13 well-established government organization that provides efficient purchasing solutions to
14 government entities, but was unable to locate suitable suppliers capable of manufacturing the
15 requested five-station ADA-complaint facilities; and
16 WHEREAS, the specialized nature of the required equipment proved to be a substantial
17 limiting factor in the procurement process; and
18 WHEREAS, the City obtained only three quotes for two (2) ADA-compliant five-station
19 portable restroom trailers; and
2(1 WHEREAS, Elk Creek Trailers submitted the lowest quote with the shortest delivery time
21 of 14-18 weeks; and
22 WHEREAS, the City's Purchasing Policy Manual, page 13, item 86, allows for a "waiver of
23 Procurement Procedures" when approved by the City Commission based on factors such as time
24 constraints and the nature of the goods or services; and
25 WHEREAS, the City Commission, upon the recommendation of staff, has deemed it in the
26 best interests of the city's citizens and residents to approve the waiver of procurement procedures
27 exemption and authorize a Purchase Order for two (2) ADA-compliant five-station portable
28 restroom trailers from Elk Creek Trailers, for a total not to exceed $139.460.00.
29 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF BOYNTON
30 BEACH, FLORIDA, THAT:
31 SECTION 1. The foregoing "Whereas" clauses are hereby ratified and confirmed as
32 being true and correct and are hereby made a specific part of this Resolution upon adoption.
33 SECTION 2. The City Commission of the City of Boynton Beach, Florida, does hereby
34 approve a waiver of procurement procedures exemption and a Purchase Order for two (2) ADA-
35 compliant five-station portable restroom trailers from Elk Creek Trailers, for a total not to exceed
36 $139.460.00.
37 SECTION 3. The City Commission of the City of Boynton Beach, Florida, hereby
38 authorizes the Mayor to execute any ancillary documents as may be necessary to accomplish the
39 purpose of this Resolution.
40 SECTION 4. This Resolution shall take effect in accordance with law.
