A REDOLUTION OF THE CITY COUNCIL OF THE CITY OF
BOYNTON BEACH~ FLORIDA, VACATING AND ABANDONING
A PORTION OF NORT~E~EST 4th STREET WITHIN SAID CITY.
WHE.REAS~ the City Council of the City of Boynton Beach~
Florida~ has received a petition from owner of lands abutting
%he-area of publicly dedicated road right-of-way more particular
described hereinafter:
WHEREAS~ after thorough p~blic znvestigation and public
hearing on said abandonment, it appears that no hardship will be
occasioned by such abandonment~ that said abandonment will be for
the best interests of the general public, and that no valid reason
exists why same should no~ be vacated~
NOW~ THEREFOP~, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF BOYNTON BEACH~ FLORIDA:
Section t: That portion of Northwest 4th Street lying
North of Northwest 1st Avenue and South of Northwest 2nd Avenue~
is hereby vacated and abandoned and said area is hereby returned
to acreage for purposes of taxation~ subject~ however, to agree-
ment and obligation of abutting property owner to relocate at his
expense all existing public utility facilities lying within said
area and to furnish any and all required easements over his
property in order to relocate said utilities.
