AN ORDINANCE OF THE CITY COMMISSION OF THE
CITY OF BOYNTON BEACH, FLORIDA, AMENDING
CHAPTER 10, GARBAGE, TRASH AND OFFENSIVE
CONDITIONS, ARTICLE II, SECTION 10.29 RATES
AND CHARGES FOR CITY SERVICES, OF THE CODE OF
ORDINANCES OF THE CITY OF BOYNTON BEACH, TO
AMEND RATES AND CHARGES FOR RESIDENTIAL AND
COMMERCIAL CUSTOMERS; ESTABLISH RATES FOR EXTRA
PICK-UPS; ESTABLISH RATES FOR COMMERCIAL
RECYCLING SERVICE; PROVIDING THAT EACH AND
EVERY OTHER PROVISION OF CHAPTER 10 NOT
SPECIFICALLY AMENDED HEREIN SHALL REMAIN IN
FULL FORCE AND EFFECT AS PREVIOUSLY ENACTED;
PROVIDING FOR CONFLICTS, SEVERABILITY,
CODIFICATION, AND AN EFFECTIVE DATE.
WHEREAS, Palm Beach County has, as a part of its budget
process adopted a new tipping fee at the landfill; and
WHEREAS, the City is beginning a commercial recycling program,
necessitating an additional rate structure; and
WHEREAS, the categories of commercial rates have been
compressed to more closely mirror the rate structure used by the Solid
Waste Authority; and
~EREA$, the City of Boynton Beach annually establishes a
Sanitation budget and establishes Sanitation rates to generate funds
for the budget; and
W~EREA$, it is necessary to amend the various rates and
charges to reflect these changes.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE
CITY OF BOYNTON BEACH, FLORIDA:
Section 1: That Chapter 10, Garbage, Trash, and Offensive
Conditions, Article II, Section 10-29 Rates and Charges for City
Services, paragraphs A, D, E, F, are amended by deleting the pre-
sent language in its entirety in the paragraphs noted, and substi-
tuting, therefore, the following new language in the paragraphs noted.
Sec. 10-29 Rates and Charges for City Service.
The rates and charges for refuse collection service provided
by the City shall be as follows:
A. Commercial containerized, excluding multi-family residen-
tial units:
1. Monthly commercial charges shall consist of a total
of the following three {3} items:
(a) Container Rental Charge - A monthly flat fee
charge to cover the cost of the container by
size as follows:
2 cubic yard - $19.40 per month
3 cubic yard - $21.44 per month
4 cubic yard - $22.21 per month
6 cubic yard - $25.53 per month
8 cubic yard - $27.00 per month
(b) Disposal Charge - A fixed charge per cubic yard
as charged by the Palm Beach County Solid Waste
Authority. The amount for FY 1993-94 is
established at $46.00 per ton or $3.08 per
cubic yard.
(c) Operating Charge - A fixed charge per cubic
yard to cover all other expenses and charges of
the Sanitation budget. The rate is established
at $2.71 per cubic yard.
Partial monthly service will be charged on a
prorated basis, based on the rates in subsection {1)
above.
Mechanical compressed or compactor refuse shall have
the disposal rate computed at a three-to-one ratio
of the disposal rates set forth in subsection one.
Containers with compactors shall be furnished by the
owner, therefore, no rental cost shall be charged.
Two {2) or more business establishments sharing a
single container shall be charged based on the size
and number of pick-ups as outlined in subsection
one {I} above. Provided, however, any joint use
generating two cubic yards or less per month shall
be charged a minimum of $65.72 per month to be
shared equally.
D. Residential Rates (Containerized, multi-family):
Six dollars ($6.00) per month per each family unit
for apartment and condominiums that are served by
dumpster containers.
2. Six dollars ($6.00) per trailer in trailer parks.
E. Special Pick-Up:
Special pick-ups of items not normally handled by the
weekly garbage, trash or recycling pick-up, whether due
to the type of waste or the volume of waste, may be sche-
duled bY contacting the Public Works Department and the
rate for such pick-up shall be established by the
Director depending on the size and type of removal needed.
Section 2: That Chapter 10, Article II, Section 10-29 is
hereby amended by the creation of two new paragraphs to be labeled H
and I entitled Commercial Recycling Charges, and School Charges
respectively, and which shall contain the following language:

Commercial Recycling - For commercial establishments who
participate in the commercial recycling program the
monthly rates shall be as follows:

The Public Works Director may establish extra pick-up
charges for commercial recycling based on the size and
type of service needed.
School Rates - A separate rate category for school ser-
vice shall be established, by the Public Works Director
as the Solid Waste Authority has established separate
disposal charges for the public school system. These
rates shall be based on the size of the container and
number of pick-ups per month.
Section 3: That each and every other provision of Chapter 10
Garbage, Trash and Offensive Conditions., Article II, not specifically
amended herein shall remain in full force and effect as previously
enacted.
Section 4:'That all ordinances or parts of ordinances, or
resolutions in conflict herewith be and the same as hereby repealed.
Section 5: Should any section or provision of this ordinance
or portion hereof, any paragraph, sentence, or word be declared by a
court of competent jurisdiction to be invalid, such decision shall not
affect the remainder of this ordinance.
Section 6: Authority is hereby granted to codify said
ordinance.
