78-FFRESOLUTION NO. 78-~ WHEREAS, the Building Official of the CITY OF BOYNTON ~EACH, FLORIDA, has heretofore conducted a periodic survey of ~arious structures within the City to determine the existence of ~ny structures which fail to meet minzmum standards of sanitation · nd habitability, or constitute unsafe or dilapidated structures, ~he continued existence of which would constitute violations of ~ection 7(20) of the charter of said City and Section 103.4 of zhe Southern Standard Building Code, previously adopted by the 2ity; and WHEREAS, a report of the Building Official indicating the ~xistence of certain structures within the City which do constitute ziolations of the above provisions of law has been submitted to the 2ity Manager, who has concurred in such findings; and a copy of said report which is attached hereto WHEREAS, ~nd hereby made 2ouncil for its WHEREAS, a part hereof, consideration satisfactory has been submitted to the City and determination; and evidence has been submitted to City Council substantiating the findings of relating to the existence of the violations report; and WHEREAS, the continued existence of said Building Official set forth in the above said conditions zs deemed detrimental to the health, safety and welfare of the inhabitants of the City; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF tHE CITY OF BOYNTON BEACH, FLORIDA: Section 1: That the conditions existing upon the property nore particularly described in the report of the Building Official ~ttached hereto are hereby determined to constitute violations of ~he charter and code of the CITY OF BOYNTON BEACH, FLORIDA, and as ~uch detrimental to the health, safety and welfare of the inhabitants of the City; Section 2: That the City Clerk is hsreby directed forth- ~ith to notify the respective owners of the properties above [escribed by registered mail of the action taken hereunder by the 2ity Council and that they shall within twenty (20) days of the ~ate of the mailing of said notice, at their expense, cause such ~onditions to be abated, removed or repaired, otherwise the City ~hall proceed to abate said conditions and to charge a lien against ~he respective lands for the cost of such abatement. Section 3: The City Council shall further hold a public ~earing on the 5th day of September 1978 at 8:00 PM at the City ~all, Boynton Beach~ Florida, at which time the property owners ~ffected by this Resolution shall be given an opportunity to show ~ause why subject conditions should not be corrected or abated. ~otice of said hearing shall be published by the City Clerk in the Palm Beach Post Times, and shall also be furnished to subject ~wners by registered mail. The Building Official of the City is ~urther directed to post notice of this action upon the effected ~roperties. PASSED AND ADOPTED, this I ~day of July, 1978.
