25-007 1 ORDINANCE NO. 25-007 2 AN ORDINANCE OF THE CITY OF BOYNTON BEACH, FLORIDA, 3 REPEALING ARTICLE XIII, SECTION 15-134 THROUGH 15-137 OF 4 CHAPTER 15, AND ANY AMENDMENTS THEREAFTER, WHICH 5 ESTABLISHED AND REVISED THE PROHIBITION OF CONVERSION 6 THERAPY ON MINORS IN THE CITY OF BOYNTON BEACH; 7 PROVIDING FOR CONFLICTS; SEVERABILITY; AND AN EFFECTIVE 8 DATE. 9 10 WHEREAS, Article XIII of Chapter 15 of the Code of Ordinances of the City of Boynton 11 Beach currently prohibits the practice of conversion therapy on minors; and 12 WHEREAS, the United States Court of Appeals for the Eleventh Circuit in Otto v. City 13 of Boca Raton, 981 F.3d 854 (11th Cir. 2020), has provided new guidance regarding local 14 regulation of professional counseling services; and 15 WHEREAS, the City Commission finds the repeal of Article XIII, Sections 15-134 through 16 15-137 of Chapter 15, and any amendments thereafter, are in the best interest of the citizens 17 and residents of the City of Boynton Beach. 18 NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF 19 BOYNTON BEACH, FLORIDA, THAT: 20 Section 1. The foregoing "WHEREAS" clauses are hereby ratified and confirmed as 21 being true and correct and are hereby incorporated herein and made a part hereof. 22 Section 2. The City Commission of the City of Boynton Beach hereby repeals Article 23 XIII, Sections 15-134 through 15-137 of Chapter 15 and any amendments thereafter. 24 Section 3. The appropriate members of the City staff are hereby authorized to take 25 any and all steps necessary to effectuate the intent of this Ordinance. 26 Section 4. All Ordinances or parts of Ordinances, Resolutions, or parts of Resolutions 27 in conflict herewith be, and the same are hereby repealed to the extent of such conflict. 28 Section 5. If any clause, section, or other part or application of this Ordinance shall 29 be held by any court of competent jurisdiction to be unconstitutional or invalid, such 30 unconstitutional or invalid part or application shall be considered as eliminated and so not affect 31 the validity of the remaining portions or applications remaining in full force and effect. 32 Section 6.
